Home My WebLink AboutCC Ord 1357 1992-08-10 I I I ORDINANCE NUMBER ~Ul AN ORDINANCE OF lHE CITY OF SEAL BEACH APPROVING ZONE TEXT AMENDMENT 92-3, AMENDING SECTIONS 28- 300(2)(k), 28-2000 AND 28-2002(1), RENAMING TIlE PUBLIC LAND USE ZONE TO TIlE PUBLIC LAND USE/RECREATION ZONE AND AMENDING TIlE PERMITfED USES OF SAID ZONE TIlE CITY COUNCIL OF TIlE CITY OF SEAL BEACH DOES HEREBY FIND AS FOLLOWS: WHEREAS, the City Council requested that Section 2002(1) of the Code of the City of Seal Beach be amended to include open space and parks as permitted uses; and WHEREAS, on December 4, 1991, the Planning Commission considered this proposal as part of Zone Text Amendment 91-5 and recommended approval of the subject request; and WHEREAS, on January 13, 1992, the City Council considered the recommendation of the Planning Commission relating to ZTA 91-5, and determined to request further amendments to the Public Land Use Zone, referring that portion back to the Planning Commission for further consideration and amendment; and WHEREAS, the City is proposing to rename the Public Land Use (PLU) zone to the Public Land Use/Recreation (PLU/R) zone and amend the permitted uses to include open space and parks; and WHEREAS, the subject zone text amendment would apply to all properties within the City which are currently zoned or would be zoned in the future as "Public Land Use/Recreation" within the City; and WHEREAS, the proposed Zone Text Amendment is Categorically Exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15305; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on July 1, 1992 to consider Zone Text Amendment 92-3; and WHEREAS, WHEREAS, the said Commission held said aforementioned Public Hearing; and at said public hearing there was no oral or written testimony or evidence received by the Planning Commission; and WHEREAS, the Planning Commission makes the following findings: 1. The proposed Zone Text Amendment will clarify that recreational and open space uses are permitted within the Public Land Use/Recreation zone. 2. This proposal will result in clarification by both amending the name of the Public Land Use zone and the permitted uses to Ordinance Number /357 , clearly indicate the recreation and open space are also desired and allowable land uses within the subject zone. 3. This proposal is Categorically Exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15305; and WHEREAS, the City Council held a duly noticed public hearing on Monday, July 27, 1992; and I WHEREAS, the City Council received into evidence the Report of the Planning Commission, including the Staff Report and Planning Commission Minutes of June 17 and July 1, 1992, and Planning Commission Resolution No. 92-15. In addition, the City Council considered all written and oral evidence presented at the time of the public hearing; and WHEREAS, at. the conclusion of the public hearing, based upon the evidence presented, the City Council determined to approve Zone Text Amendment 92-3. NOW, TIIEREFORE, BE IT ORDAINED that the City Council of the City of Seal Beach does hereby approve Zone Text Amendment 92-3, and amend Chapter 28 of the Code of the City of Seal Beach as indicated below: n(L)" Section 1. Section 28-300(2)~ of the Code of the City of Seal Beach is amended to read as follows: I "J: "~PLU/R Public Land Use/Recreation zone;" Section 2. Article 20 of the Code of the City of Seal Beach is amended to read as follows: "Article 20. Public Land Use/Recreation Zone" Section 3. Section 28-2000 of the Code of the City of Seal Beach is amended to read as follows: "Section 28-2000. Preamble. In order to provide the protection of open space lands and publicly used lands within the City, a designation of Public Land Use/Recreation (PLU/R) is deemed necessary." Section 4. Section 28-2002(1) of the Code of the City of Seal Beach is amended to read as follows: "Section 28-2002.(1) Public parks, parks, open space, green belts, beaches, piers, wildlife refuges, tidal marshlands, bicycle trails, nature trails, flood control basins, f100d-control channels, parking lots or facilities, and earthquake buffer zones;" I NOW, TIIEREFORE, BE IT ORDAINED that the City Council of the City of Seal Beach does hereby approve Zone Text Amendment 92-3.
