ORDINANCE NO. ~
AN ORDINANCE OF THE CITY OF SEAL BEACH,
CALIFORNIAADOYI'lNG BY REFERENCE THE UNIFORM
FIRE CODE, 1991 EDmON, AND AMENDMENTS
THERETO, AMENDING PORTIONS OF CHAPTER 5 AND
DELETING CHAPTER 9 OF THE CODE OF THE CITY OF
SEAL BEACH AND DECLARING THE URGENCY
THEREOF.
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1.
Chapter 9 of the Code of the City of Seal Beach is hereby deleted in
its entirety.
SECI'ION 2.
Chapter S, Article I, Section 5-1 of the Code of the City of Seal Beach
is hereby amended to read as foDows:
.Section 5-1. Codes AdoDted by Reference. Tbe codes listed below are adopted by
reference as the BuDding and Safety Code of the City of Seal Beach:

SECTION 3. Section 5-3S of the Code of the City of Seal Beach is hereby deleted in
its entirety and a new Section 5-35 is hereby adopted to read as follows:

to the Uniform Fire Code as adopted pursuant to Chapter 5, Article I, Section 5-1:

Section 2.206 of the Uniform Fire Code (nu.... in Use) is hereby amended
by identifying the existing paragraph as subsection (a) and adding new
SubsectioDS (b), (c) and (d) as fonows:

"(b) When required by the Chief or BuDding Official, any or all owners of
any occupancy may be required to record with the County Recorder
of the County of Orange a legal instrument of intended use, ThIs legal
Instnunent shan be called a Declaration of Intended Use. The
Declaration of Intended Use shan be In accordance with the
requirements of this section. It shan speclficalIy state, by OCClIpancy
classification, an intended uses of all portioDS of the OCClIpancy and
may not be modified or withdrawn without the approval of the Chief.
Unapproved changes of occupancy or use can be cause for an
Immediate hearing before the BuDding Oft'iclal and the Fire Chief or
their de.dgnees. Such hearing shan be conducted to role on the
revocation of the Certificate of Occupancy and the revocation of all
permits issued to an owners, tenants, operators and occupants of an
portioDS of the occupancy. The Declaration of Intended Use shan be
binding on an pres lilt and future owners, tenants, operators and
occupants.
(e) Any mllti.., occupancy that Is modif'aed in any manner where the I

period, wDl require the filin& of a Declaration of Intended Use.
(d) A certified eopy of the recorded Declaration of Intended Use may be

before any Certificate of Occupancy and/or any permits are issued to
any or all owners, tenants, operators or occupants of the occupancy. n

3. Sec:t1on 2.304 (a) of the Uniform Fire Code (Uniform lire Cede -........)
is hereby amended as follows:
14-1 UFC Standard 14-1 is deleted and whenever it is
referenced in this code or the UFC Standards it shall
mean NFPA 72, 1990 Edition, as adopted by the State
Building Standards Comm;B;on.
I 14-2 UFC Standard 14-2 is deleted and whenever it is
referenced in this code or the UFC Standards it shall
mean NFPA 72 E, 1990 Edition, as adopted by the
State Building Standards Commu..;on.
74-1 UFC Standard 74-1 Part I is adopted as specif'ied in
Appendix V; and Part n is deleted and whenever it is
referenced in this code or the UFC Standards it shall
mean NFPA 50,1990 EditIon, as adopted in Appendix
V.
11-1 UFC Standard 81-1 Part I is adopted as specified in
Appendix V; and Part n is deleted and whenever it is

B(b) Whenever the following UBC Standards are referenced in this
code or in the UFC Standards they shall have the following

and legible from the street or road fronting the property. Said numben shall

than one business shall have numben or addresses placecl on or immediately
atVac:ent to all doors that would allow fire department access in an emergency
situation. In no case shall the numben be less than 4 (four) inches in height
for residential and 6 (six) inches in beight for commercial with a 1 (one) inch
stroke. '
Multiple units (i.e., apartments, condominiums, townhouses, businesses, etc.)
having entrance doors not visible from the street or road shall have approved
numben grouped for all businesses within each structure and positioned 50

8. Section 10.401 of the Uniform Fire Code (Water SIaw'Ied lor lIIre PaU(~.
Geaelid) Is hereby amended by adding a sentence as follows:

personnel in the area.
The regulations of the State Fire Marshal also apply to the testing. service,

Chapters 3 and S)"
10. Sedion 10.507(a) of the Uniform Fire Code (Required T-1JatIoww of

adding the following paragraphs:
"Automatic rU'lHXtinguishing systems shall be installed in accordance with I
the NFPA standards as adopted in Appendix V of this code.
When a residential sprinkler system Is provided as specified in NFPA 13R as
adopted in Appendix V of this code, exceptiODS to. or reductiODS in. code
requirements allowed because of the Installation of an automatic rll'e-
extingulshll1g system are not permitted.
For the purpose of applying this Section a new buDding shall indude: a
buDding which has a constmction value _..-lIng $50.000 and the area
undergoing remodeling or reconstmction Is 75 percent or more of the entire
buDding area. with constmction occurring over a period not to exceed two
years (730 days).
EXuwnON: When it Is determined that the cost of installing the
fire.extinguishing system would create an unreasonable hardship. An
unreasonable hardship would be if the cost of the system exceeds nve
percent of the cost of the constmction."

13. Section IO.!09(b) of the Uniform Fire Code (Permi5sibJe Sprinkler OmilBions)
is hereby amended by adding a sentence as lollows:
ROther approved fire.eKtinguishfng systems compatible with the hazardous
materials being stored or used shaD be instaDed to protect special hazards or
occupancies in Heu of automatic: sprinklers."
14. Section IO.510(b) of the Uniform Fire Code (Standpipes, Where Required)
is hereby deleted and substituted with the lollowing language:
"See:. IO.51O(b) Where Reqnind. Standpipe systems shaD be provided as set
forth in Table No. IO.51~A and the provisions of this section.
Every new buDding with any horizontal dimension greater than 300 feet, shall
be provided with either access doors or hose outlets loc:ated so that aD
portions of the buDding can be reached with 150 feet of hose from an access
door or hose outlet.

Required access doors shaD be loc:ated in the exterior waD of the buDding and
shaD be acc:essibJe without the use of a ladder. The door dimensions shall be
not less than 3 (three) feet in width nor , (six) leet 8 (eight) inches in height.
The hose outlets shaD be 2 1/2 (two and one haIl) inches In size with an
approved valve. The water supply lor the hose outlets shaD be provided:
1. By a separate main supp6ed from the system side of the check
valve at the lire department connection, or

system, or the portion of the system that protects the area

15. Section 10.514 is hereby added to the Uniform Fire Code to read as follows:
"SpedaI Pt....... for High-rise BuiIdinp
~ 10.514. (a) Scope. In addition to other applicable requirements of
these regulations, the provisions of this section shall apply to every new
buDding of any type of construction or occupancy having noors used for
human occupancy located more than 55 (fifty-nve) feet above the lowest level
of fire department building aecess. Such buDdings shall be provided with an
automatic sprinkler system installed In aeeordance with Section 10.514 (c:) of
this code.

:EXownONS: The following stnIctures, whDe classified as high-rise
buDdings, shall not be subject to the provisions of this section but shall
conform. to all other applicable provisions of these regulations.
1. Buildings used exclusively as open parking garages.
2. BuDdings where all noors above the 55 (fifty-five) foot level are
used exclusively as open parking garages.
3.
Floors of buUdings used exclusively as open parking garages
aDd located above all other noors used for human occupancy.

4. Buildings such as power plants, lookout towers, steeples, grain
houses and lIIimillll" structures with noncontinuous human
occupancy, when approved by the Chief.
For the purpose of this subsection, buDding aecess shall mean an exterior
door opening conforming to all of the following:
1. Suitable and avaDable for fire department use.
2. Located not more than 2 (two) feet above the acijacent ground
level.
3. Leading to a space, room or area having foot traff"ac:
communication capabUities with the nonllinder of the buDding.
4. Designed to permit aecess through use of the Orange County
Fire Department emergency aecess Ioc:k box program.
(b) Certificate of 0--.--. The provisions of Section 1807 (b) of the
Uniform Building Code, as adopted In this Munidpal Code, shall I
apply to buDdings desc:ribed In Section 10.514 (a).
(c:) ~ SpriDkIer 8)...... The provisions of Section 1807 (c:) of the
Uniform Building Code, as adopted In this Municipal Code, and the
provisions contained In this section shall apply to buDdings described

sound an appropriate signal transmitted to locations in
accordance with Section 10.514 (e).

be provided with a State Fire Marshal approved and listed fire alarm
system. The alarm and communication systems shaD be designed and
installed so that damage to any 1 (one) speaker will not render any
paging zone of the system inoperative.
The voice alarm and public address system may be a combined
system. When approved by the fire department, communications
~ems may be combined with the voice alarm system and the public
address system.
The fire alarm system shaD include visual indicators for the hearing
impaired in aD public areas of the buDding including but not limited
to elevators, elevator lobbies, rest rooms, corridors, eDt stairways,
and rooms and tenant spaces u..-dlng 1,000 square feet In area.

Voice aIann ...,........ The operation of any smoke detector,
spriDkler, water flow device or manual fire alarm station shall
automatically sound an alert signal to the desired areas
followed by voice instructions giving appropriate information
and direction to the occupants.
Upon activation of the automatic spriDkler system, any
automatic fire.detection device required by this section or any
special hazard fire.protection or atinguishing system, an
automatic voice alarm signal shaD sound on the floor where
activated and on the floor above and below. An audible and
visual signal shall be transmitted to the central control station
and the rll'e department central control station status board.
The content of the voice aIann In each Instance shall be
determined by the fire department in cooperation with the
buDding owner or manager.
The central control station shall contain controls for the voice
aIann system so that a selective or general voice alarm may be
manually initiated.
The system shall be supervised to cause the activation of an
audible trouble signal in the central control station upon

Interruption or failure of the audio path including amplifiers,
speaker wiring, switches and eIec:trica1 contacts and shan detect
opens, shorts and grounds w~ch might impair the function of
the system.
The alarm shan be designed to be heard clearly by an
occupants within the buDding or dellignated portions thereof, I
as Is required for the public address system.
D.u!a"uON: In Den of a voice alarm signal and when
approved by the fire department, the local alarm system
may employ any sounding device or devices which are
approved and listed by the State FIre Marshal. The
sounding devices of such altemate systems shan have a
distinctive tone and shall be lUTllIIIed to emit
Intermittent, prolouged or continuous sound sigDaIs for
a full period of 10 (ten) seconds, to be immMiately
followed by an intermission or period of sllence of 5
(five) seconds, before the signal is repeated. Such signal
shan continue to sound untO manually tennlnated at the
central control station but In no case shall such manual
operation be al'l'llllpd to cause tennlnation In less than
3 (three) minutes.

sound the voice or rll'e alarm shall be so located as to be clearly
beard on the Ooor wbere activated, except as may be otherwise

A pubDc address communication system designed to be clearly
heard by all occupants of the buDding shall operate from the
central control station. It shall be established on a selective or
general basis, as approved by the Chief, to the following paging

areas:
A. Elevators
B. Elevator lobbies.
C. Corridors.
D. EDt stairways.
E. Rooms and tenant spaces ex--'illg 1,000 square
feet In area.
F. Dwelling units in apartment houses.
G. Hotel guest rooms or suites.
3. FIre departmeIIt a,..........L....... 11.1........ A two-way fire
department rnmmuDication system shall be provided for fire
department use. It shall operate between the central control
station and elevators, elevator lobbies, emergency and standby
power rooms and at entries to every enclosed exit stairway.
The commuDication system shall also comply with the I
following:

station Is constantly manneeJ by competent and
experienced operating personnel conforming to
Chapter' of NFPA 72 as adopted by the State

(1) When a building conforms to the
provisions of this section, the manually
operated fire alarm system otherwise
specified by Section 14.104 (g) shall not be
required.

(2) Single-station detectors installed in
dwelling units and hotel or lodging house
guest rooms, as specified in Section 14.104
(g) 6, need not be interconnected to the
fire alarm system required by this section.

OperatioDS shall be provided in a location approved by the fire
department. The central control station shall be separated from the
....."inder of the building by not less than one-hour fire-resistive
constnletion with all openlnp protected by assemblies having a rU'e-
resistive rating of not less than 45 (forty-five) minutes. It shall have
a minim1JDl of one door which is accessible directly from the exterior
portion of the building and sha1I be openable with a fire department

Alarms, supervisory and trouble signals as required by Items 3 and 7 I
above shall be annunciated in compliance with this code in the central
control station by means of an audible and visual indicator. For
purposes of annunciation, zoning shall be in accordance with the
following:
1. When the system serves more than one buDding, each buDding
shall be considered separately.
2. Each floor shall be considered a separate zone. When one or
more sprinkler risen serve the same floor, each riser shall be
considered a separate zone.

dampered relief opening at the top. The stairway shall be
supp6ed mechanically with sufficient air to dFhllrge a
minimum of 2,500 cubic feet per minute through the relief
opening; whUe maintaining a mlnlmQD1 positive pressure of
O.I5-inch water column in the stairway relative to atmospheric
pressure with all doors closed. Activation of the mechanical
equipment shall be initiated by a 1I00ke detector installed
outside the stair enclosure and within 5 (five) feet of the
enclosure door. Such equipment shall also be activated by
actuation of the automatic sprinkler system. Operation of
ventUating equipment shall also be in accordance with Section
3310 (g) 6 of the Uniform BuDding Code, as adopted in this
Municipal Code.
(k) S . ..~ Ccmsidenticms. The provisions of Section 1807 (k) of the
Uniform BuDding Code, as adopted in this Municipal Code, shall I
apply to buDdings described in Section 10.514 (a).

The roof area shall include an emergency access and evacuation
fadUty for helicopters of not less than 15,000 pounds gross
weight. This facility shall have a touchdown pad of at least 50
(fifty) feet by 50 (f'd'ty) feet and a dear unobstnacted landing
and takeoff area with a minimum dimension of 100 feet by 100
feet.

The landing pad shall be designed in accordance with Section
2308 (c) of the Uniform BuDding Code, as adopted in this
Municipal Code. Helicopter landing areas and supports shall

Forest Service.
(d) Engines used to provide motor power for trucks, truck

SECTION 4. The modificatioDS to the Fire Code enacted in this ordinance
are merely a continuation of the Code of the City of Seal Beach. The changes and
modificatioDS to the 1991 Uniform Fire Code, as recommended by the City of Seal
Beach Building Official, are hereby found to be reasonably necessary due to the
following unique local topographic:, geologic: and climatic: conditioDS:
1. The City of Seal Beach is located in a semi-arid Mediterranean type
climatic: zone. It annually experiences extended periods of high
temperatures with little or no precipitation. Bot dry foehn (Santa Ana)
winds, which may reach speeds up to 70 m.p.h, are also enmmon to the
area. These dry climatic: conditioDS and winds contribute to the rapid
spread of even smaR rll'es originating in high density housing and
vegetation, creating a need for inc:reased levels of rll'e protection.
2. Water demand in this densely populated area far uc:eeds the quantity
supplied by natural precipitation; and although the population continues to
grow the already taxed water supply does not. California is projected to
Inc:rease In population by nearly 10 million over the next quarter of a
century with 50 percent of that growth centered in southern California.
These drought conditioDS create a need for tire protection systems which
will reduce the amount of water needed for tire fighting.
3.
Due to its high density development and the InftUll: of visiton to its
beaches, the City of Seal Beach has traffic: and c:in:ulation congestion.

The City of Seal Beach is developed with eertaIn large
.......merciaVindustrlal buildings, with certain horizontal dimensioDS of 300
feet or greater. PortiODS of these buildings cannot be reached with a rll'e
hose One on initial attack.
5. The City of Seal Beach has an urban atmosphere which is reftected in
buDding and buDding complex design and features. Landscaping and
other buDding features often preclude or greatly llmIt approach or
operational access by fire department vehicles.
6. The City of Seal Beach Is located in an area of high .....1OIII1c: activity,
sel10111lc zone 4. The Newport-Inglewood Fault, located within the
boundaries of the clty, poses the greatest hazard to life and property. It is
believed this fault Is capable of generating a mAYInn,un credible 7.5
mApltude earthquake. Because of the clty's degree of urbanization and
location on a ouUor fault, the risk of structural damage and loss of life
due to ground shaking Is coDSiderable.

Ma\jor earthquakes are always accompanied by disnlption of tramc: now
and fires. During a ouUor earthquake, tire department resources would
be extremely taxed, and the ability to respond to fires would be
compUcated and In some cases impossible.
8. The above conditioDS make it necessary to require more extensive on-site
fire extIngulsblng systems in order to protect occupants and property and
to provide a degree of protection from fires even if water mains are
damaged or destroyed..

SECTION S. State law requires that localities adopt the Uniform Fire
Code and any modifications thereto, by August 12, 1992. It Is essential that the City
have in effect on that date a fire code that comports with State law and contains those
modIfications necessitated by unique topographic, geologic and climatic conditions. In
the absence of immediate effectiveness of this ordinance, the provisions of the fire code
unique to the City will not be in place and this will have a detrimental effect on the I
publlc health, safety and welfare. 'lbe modIfications to the Uniform Fire Code contain
vital provisions regarding sprinkler requirements, smoke-detection systems, storage and
handling of flammable and combustible materials, and other similar matters necessitated
by the City's exposure to climatic conditions in Southern California, e.g., long, hot
summers and dry Santa Ana winds. For these reasons, the publlc health, safety and
welfare require that this ordinance take effect immediately. 'ibis is an urgency
ordinance.
SECTION 6.
'Ibis ordinance shall become operative on August 11, 1992.
SECrION 7. If any section, subsection, subdivision, paragraph, sentence, clause
or phrase of this ordinance or any part hereof is for any reason held to be invalld, such
invalidity shall not atTect the valldity of the remaining portions of this ordinance or any
part hereof. Tbe City Counell of the City of Seal Beach hereby declares that it would
have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase
hereof, irrespective of the fact that anyone or more sections, subsections, subdivisions,
paragraphs, sentences, clauses or phrases be declared invalld.
