Home My WebLink AboutCC Ord 1368 1993-06-14 I I I ORDINANCE NO. /,3/,8 AN ORDINANCE OF THE CITY OF SEAL BEACH, CAliFORNIA AMENDING CHAPTER 13D, ADDING A NEW SECTION 13D-ll TO THE CODE OF THE CITY OF SEAL BEACH REGARDING THE SOUNDING OF MOTOR VEHICLE BURGLAR ALARMS AND RENUMBERING EXISTING SECTIONS 13D-ll THROUGH 13D-15 TO NEW SECTION 130-12 TO 130-16, RESPECTIVELY, AND MAKING TECHNICAL AND CLERICAL AMENDMENTS TO NEW SECTIONS 130-15 AND 130-16 THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: Section 1. Exiting Sections 13D-11 through Section 13D-15 of Chapter 13 of the Code of the City of Seal Beach are hereby renumbered to new Section 13D-12 through 13D- 16, respectively. Section 2. A new Section 13D-11 of Chapter 13 of the Code of the City of Seal Beach is hereby added to read as follows: "Section 13D-l1. Motor Vehicle Burl!lar Alarms. (a) It shall be unlawful for any person to cause, allow, or permit aily alarm located in a motor vehicle registered in the name of or driven by such person to emit any audible sound within the City for a period of more than ten (10) minutes. The time shall be calculated based upon the emission of the first audible sound, and end ten (10) minutes thereafter, notwithstanding any variation or delay in the emissions of audible sound. (b) The Police Department, in order to abate the public nuisance created by a vehicle in violation of this section, may take such steps as are reasonably necessary to enter the vehicle, discoMect the alarm, and remove the vehicle for safekeeping in the manner permitted by law. (c) Except as provided in subdivision (d). any person violating this section shall be guilty of an infraction. Any person convicted of an infraction under this section shall be punishable by a fine of not more than twenty-five dollars ($ 25.(0) for the first offense, a fine of not more than seventy-five dollars ($ 75.(0) for a second offense within one year. and a fine of not more than one hundred- fifty dollars ($ 150.(0) for a third offense within one year. (d) Any person violating this section who has been previously convicted of three (3) or more violations of this section shall be guilty of a misdemeanor. " Ordinance Number / ~ Section 3. New Section 130-15, paragraph 3, of Chapter 13 of the Code of the City of Seal HP.lIch is hereby amended to amend the referenced subsections from existing Sections 130-12 and 130-13 to new subsections 130-13 and 130-14, respectively. Section 4. New Section 130-16 of Chapter 13 of the Code of the City of Seal ~ is hereby amended to read as follows: .Section 130-16. Violations: Infractions and Misdemeanors. Any person violating any of the provisions of this Chapter, with the exception of Section 130-11, shall be deemed guilty of a misdemeanor. Violation of Section 130-11 shall be an infraction or misdemeanor as set forth in subsections 130-11.(c) and 130- 11.(d). Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such. The provisions of this Chapter shall not be construed as permitting conduct not prescribed herein and shall not affect the enforceability of any other applicable provision of law. . I Section 5. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance or any part thereof is for any reason held to be invalid, such invalidity shall not affect the validity of the remaining portions of this ordinance or any part hereof. The City Council of the City of Seal Beach hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that anyone or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared invalid. Section 6. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be posted as required by law.
