THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN AS
FOLLOWS:

Article 1. Chapter 5, section 5-1 of the Code of
Seal Beach is amended to read:
"Section 5-1, Codes Adooted bv Reference. The codes listed I
below are adopted by reference as the Building and Safety Code
of the City of Seal Beach:

Appendix.
(B) Uniform Mechanical Code, 1988 Edition.

be considered as part of the Code."

Article II. Chapter 5, section 5-23. Excessive
Inspections, is amended to read:

"Section 5-23. Excessive Inspections. If in
the opinion of the Building Official, the work
is not being coordinated or executed by the
permittee, which then requires an inordinate
number of reinspections, or corrections called
for are not made, or the work deviates from the
approved set of plans, or the Building Code,
the Building Official shall require a
reinspection fee in accordance with the current
resolution adopted by the City Council for
building fee purposes."
Article II. Chapter 5, Section 5-27, special
Inspection--Generally, is hereby amended to read:
"Section 5-27. Special Inspection--Generally.
In addition to the inspections to be made as
sp6cified in sections 5-19 through 5-26, the
owner or his agent shall employ a special
inspector who shall be present at all times
du::ing construction of the types of work noted
in Section 306, of the Uniform Building Code,
as adopted pursuant to Chapter 5, Article 1,

amended to read:

Article V. Chapter 5, Section 5-30.1 is hereby
amended to read:
"I. section 205 is amended to read as follows:
Section 205. It shall be unlawful for any
person, firm, or corporation to erect,
construct, enlarge, alter, repair, move,
improve, remove, convert, or demolish, equip,
use, occupy, or maintain any building or
structure in the City, or cause the same to be
done, contrary to, or in violation of any of
the provisions of this code. Any person, firm,
or corporation violating any of the provisions
of this Code shall be deemed guilty of a
misdemeanor and upon conviction thereof shall
be punishable by a fine not exceeding one
thousand dollars ($1,000) or imprisonment for
a term not exceeding six (6) months, or by both
such fine and imprisonment. Each separate day
or any portion thereof during which a violation
of this Code occurs or continues shall be
deemed to constitute a separate offense and,
upon conviction thereof, shall be punishable
as herein provided."

Article V. Chapter 5, section 5-30.10 is hereby
added to read:
"10. Section 1807(al. Scone. In addition to
other applicable requirements of these
regulations, the prov~s~ons of this
section shall apply to every new building I
of any type of construction or occupancy
having an area where the public might gain
access to await rescue, located more than
55 feet above the level of Fire Department
Vehicle access. Such buildings shall be
provided with an approved automatic
sprinkler system in accordance with
section 1807(c).
EXCEPTION: The following structures, while
classified as high-rise buildings, shall
not be subject to the provisions of this
section but shall conform to all other
applicable provisions of these
regulations.
A. Buildings used exclusively for
open parking garages.
B. Buildings where all floors above
the 55-foot level are used
exclusively as open parking garages.
C. Floors of buildings used
exclusively as open parking garages I
and located above all other floors
used for human occupancy.
D. Buildings such as power plants,
lookout towers, steeples, grain
houses and similar structures with
noncontinuous human occupancy, when
so determined by the enforcing
agency.
(b) Certificate of Occupancy. All mechanical and
electrical equipment and other required life
safety systems shall be approved and installed
in accordance wi th approved plans and
specifications pursuant to this section and
shall be tested and proved to be in proper
working condition to the satisfaction of the
Building Official before issuance of the
Certificate of Occupancy. Such system shall be
maintained in accordance with the Fire Code.
(c) Automatic Sprinkler System.
1. System Design. The automatic sprinkler
system shall be provided throughout the
building. The sprinkler system shall be
designed using the parameters set forth in
U.B.C. Standard No. 38.1 and the following:

1. Shutoff valves and a water-flow device
shall be provided for each floor. The
sprinkler riser may be combined with the
. standpipe riser.

2. In Seismic Zones No.2, No.3, and No.
4, in addition to the main water supply,
a secondary on-site supply of water equal
to the hydraulically calculated sprinkler
design demand plus 100 gallons per minute
additional for the total standpipe system
shall be provided. This supply shall be
automatically available if the principal
supply fails and shall have a duration of
30 minutes.
2. Modifications. The following modifications
of code requirements are permitted:
A: ,The fire-resistive time periods set
forth in Table No. 17-A may be reduced by
one hour for interior bearing walls,
exterior bearing and non-bearing walls,
roofs and the beams supporting roofs,
provided they do not frame into columns.
Vertical shafts other than stairway
enclosures and elevator shafts may be
reduced to one hour when sprinklers are
installed within the shafts at alternate
floors. The fire-resistive time period
reduction as specified herein shall not
apply to exterior bearing and non-bearing
walls whose fire-resistive rating has
already been reduced within Section
1803(a) or 1903(a).

B. Except for corridors in Group B,
Division 2 and Group R, Division 1
Occupancies and partitions separating
dwelling units or guest rooms, all
interior non-bearing partitions required
to be one-hour fire-resistive construction
by Table 17-A may be of noncombustible
construction without a fire-resistive time
period.
c. Fixed tempered glass may be used in
lieu of openable panels for smoke-control
purposes.
D. Travel distance from the most remote
point in the floor area to a horizontal
exi t or to an enclosed stairway may be
300 feet.
E. Fire dampers, other than those needed
to protect floor-ceiling assemblies to
maintain the fire resistance of the
assembly, are not required.
F. Emergency windows required by section
1204 are not required.

(d) Smoke Detection system. at least one approved
smoke detector suitable for the intended use
shall be installed:
1. In every mechanical equipment, electrical,
transformer, telephone equipment, elevator
machine or similar room.
2. In the main return and exhaust air plenum
of each air-conditioning system and located in
a .,erviceable area downstream of the last duct
inlet.

3. At each connection in a vertical duct or
riser serving two or more stories from a
return-air duct or plenum of an air-
conditioning system. In Group R, Division 1
Occupancies, an approved smoke detector may be
used in each return-air riser carrying not more
than 5000 cfm and serving not more than 10 air
inlet openings.
The actuation of any detector required by this
section shall operate the voice alarm system I
and shall place into operation all equipment
necessary to prevent the recirculation of
smoke.
All smoke detectors connected to the alarm
system shall have a light that indicates the
status of the detector. When a detector is
located in a' space above a drop ceiling, the
indicating light shall be located on or below
the ceiling grid.
(e) Alarm and communication systems. The alarm and
communication systems shall be designed and
installed so that damage to any terminal unit
or speaker will not render more than one zone
of the system inoperative.
The voice alarm and public address system may
be a combined system, When approved the fire
department communications system may be
combined with the voice alarm system and the
public address system.
Three communication systems may be combined as
set forth above shall be provided as follows:

1. Voice alarm system. The operation of any
smoke detector other than the single station
detectors located within the dwelling units in
a Group R Division 1 occupancy, sprinkler,
water flow device or manual fire alarm station
shall automatically sound an alert signal to
the desired areas followed by voice
instructions giving appropriate information
and direction to the occupants.

The system shall be supervised to cause the
activation of an audible trouble signal in the
central control station upon interruption or
failure of the audiopath including amplifiers,
speaker wiring, switches and electrical
contacts and shall detect opens, shorts and
grounds which might impair the function of the
system.
The alarm shall be designed to be heard clearly
by all occupants within the building or
designated portions thereof as is required for
the public address system.
The alarm system shall include visual
indicators for the hearing impaired, in all
public areas of the building including but not
limited to elevators, elevator lobbies,

corridors, rest rooms, exit stairways, and
rooms or tenant spaces exceeding 1000 square
feet in area.

2. Public address system. A public address
communication system designed to be clearly
heard by all occupants of the building shall
operate from the central control station. It
shall be established on a selective or general
basis to the following terminal areas:
A. Elevators.
B. Elevator lobbies,
C. Corridors,
D. Exit stairways.
E. Rooms and tenant spaces exceeding
1000 square feet in area.
F. Dwelling units in apartment houses.
G. Hotel guest rooms or suites.
3. Fire department communication system. A two-
way fire department communication system shall
be provided for fire department use. It shall
operate between the central control station and
every elevator, elevator lobby and entry to
every enclosed stairway.

(f) Central Control Station. A central control
station for fire department operations shall
be provided in a location approved by the fire
department. It shall contain:
1. The voice alarm and public address system
panels,
2. The fire department communications panel.
3. Fire detection and alarm system annunciator
panels.
4. Annunciator visually indicating the location
of the elevators and whether they are
operational.
5. status indicators and controls for air
handling systems.
6. Controls for unlocking all stairway doors
simultaneously.

8. A telephone for fire department use with
controlled access to the pUblic telephone
system.
(g)
Smoke control. Natural or mechanical
ventilation for the removal of products of
combustion shall be provided in every story
and shall consist of one of the following:
1. Easily identifiable windows or panels which
are manually openable or approved fixed

exterior walls. They shall be distributed
around the perimeter of the building at not
more than 50-foot intervals at the rate of 20
square feet per 50 lineal feet.
EXCEPTION: In Group R, Division 1 Occupancies
each guest room or suite having an exterior
wall may be provided with a minimum of 2 square
feet of venting area.
2. When a complete and approved automatic I
sprinkler system is installed, the mechanical
air-handling equipment may be designed to
accomplish smoke removal. Under fire
conditions, the return and exhaust air shall
be moved directly to the outside without
recirculation to other sections of the
building. The air-handling system shall
provide a minimum of one exhaust air change
each 10 minutes for the area involved.
3. Any other approved design which will
produce equivalent results.
(h) Elevators. Elevators and elevator lobbies
shall comply with the provisions of Chapter 51
and the following:
Note: A bank of elevators is a group of
elevators or a single elevator controlled by
a common operating system; that is, all those
elevators which respond to a single call button
constitute a bank of elevators. There is no
limit on the number of cars which may be in a I
bank or group but there may not be more than
four cars within a common hoist way.
1. Elevators on all floors shall open into
elevator lobbies which are separated from the
remainder of the building, including corridors
and other exits, by walls extending from the
floor to the underside of the fire-resistive
floor or roof above. Such walls shall be of
not less than one-hour fire-resistive
construction. openings through such walls
shall conform to Section 3305(h).
EXCEPTIONS:
a, The main entrance level elevator
lobby if office building.
b. Elevator lobbies ~ocated within an
atrium complying with the provisions
of section 1715.
In fully sprinklered office
buildings, corridors may lead through
enclosed elevator lobbies if all
areas of the building have access to
at least one require exit without
passing through the elevator lobby.
2. Each elevator lobby shall be provided with
an approved smoke detector located on the lobby
ceiling. When the detector is activated,
elevator doors shall not open and all cars
serving that lobby are to return to the main

floor and be under manual control only. If the
main floor detector or a transfer floor
det.ector is activated, all cars serving the
main floor or transfer floor shall return to
a location approved by the Fire Department and
building official and be under manual control
only. The smoke detector is to operate before
the optical density reaches 0.03 per 'foot. The
detector may serve to close the lobby doors.
3. Eleva'cor hoist ways shall not be vented
through an elevator machine room unless such
venting is accomplished by an approved duct
system installed through the elevator machine
roo~. Cable slots entering the machine room
shall be sleeved beneath the machine room floor
and extend to not less than 12 inches below
the shaft vent to inhibit the passage of smoke
into the machine room.
standby Power, Light' and Emergency Systems.
1. Standby power. Standby power generating system conforming
to U.B.C. Standard No. 18-1 shall be provided. The system
shall be equipped with suitable means for automatically
starting the generator set upon failure of the normal
electrical supply systems and for automatic transfer of all
functions required by.this section at full power within 60
seconds of such normal service failure. Systems supervision
with manual start and transfer features shall be provided at
the central control station.
On-site fuel supply for prime movers of standby power
generator sets shall be sufficient for at least 6 hours at
full demand operation. When electric power is also supplied
to required fire pumps, an 8-hour fuel supply shall be
provided.
The standby system shall have a capacity and rating that would
supply all equipment required to be operational at the same
time. The generating capacity need not be sized to operate
all the connected electrical equipment simultaneously.
All power, lighting, signal and communication facili ties
specified in (d), (e,), (f), (g), (h), (i) and (j) as
applicable; fire p..mps required to maintain pressure, standby
lighting and normal circuits supplying exit signs and exit
illumination shall be transferrable to the standby source.
2. standby lighting. Standby lighting shall be provided as
follows:
a. Separate lighting circuits and fixtures sufficient
to provide light with an intensity of not less than
one (1) footcandle measured at floor level in all
exit corridors, stairways, smoke proof enclosures,
elevator cars and lobbies and other areas which are
clearly a part of the escape route.
All circuits supply lighting for the central control
station and mechanical equipment room.
b.
3. Emergency systems. The following are classified as
emergency systems and shall operate within 10 seconds of
failure of the no~al power supply:
a. Exit sign and exit illumination os required by
Sections 3313 and 3314.
b. Elevator car lighting.

(j) Exits. Exits shall comply with other requirements of this
code and the following:
1. All stairway doors which are locked from the stairway side
shall have the capability of being unlocked simultaneously
wi thout unlatching upon a signal from the central control
station.
2. A telephone or other two-way communications system
connected to an approved emergency service which operates
continuously shall be provided at not less than every fifth I
floor in each required stairway where other provisions of this
code permit the doors to be locked.
(k) Seismic Considerations. In Seismic Zones No.2, No. 3 and
No.4, the anchorage of mechanical and electrical equipment
required for life safety systems, including fire pumps and elevator
drive and suspension systems, shall be designed in accordance with
the requirements of section 2312.

1. The roof area shall include an emergency evacuation
facility for helicopters of not less than 12,000 pounds gross
weight. This facility shall have a touchdown pad of at least
a fifty foot diameter and be surrounded on all sides by a
clear area having a minimum average width at roof level of 15
feet but with no width less than 5 feet.
2. The landing pad shall be designed per Uniform Building
~ section 2308(c). Helicopter landing areas and supports
therefor on the roof of a building shall be of non-combustible
construction.
3. The emergency evacuation facility shall have two approach-
departure paths at a lope of 8 to 1.
4. Any helicopter use of this facility other than as an
emergency evacuation facility shall require prior FAA,
Building Department and Fire Department approval.
(m) All required exit stairways shall be equipped with a
barometric dampered relief opening at the top and the stairway
supplied mechanically with sufficient air to discharge a minimum
of 2500 cubic feet per minute through the relief opening while
maintaining a minimum positive pressure of 0.15-inch water column
in the stairway relative to atmospheric pressure with all doors
closed or shall be in a smoke proof enclosure in accordance with
Uniform Buildina Code section 3310. Activation of the mechanical
equipment shall be in accordance with Uniform Buildina Code section
3310(g)6.

not be obstructed in any manner, including

and clearances established under this section

A violation of this section constitutes an
infraction and any vehicle parked or any object
placed in violation of this section shall be
subject to immediate removal and storage

addresses shall be placed on all' new and
existing buildings in such a position as to be

roar fronting the property. Said numbers shall
contrast with their background. Any commercial
building occupied by more than one business
shall have numbers or addresses placed on or
immediately adjacent to all doors that would
allow Fire Department access in an emergency
situation.
Multiple dwelling units (i.e., apartments,
condominiums, townhouses, etc.) having entrance
doors not visible from the street or road shall
have approved numbers grouped for all dwellings
within each structure and positioned so as to
be plainly visible from the street or road.
Said numbers may be grouped on the wall of the
structure or on a substantial mounting post
independent of the structure.

shall designate the type and number of fire
appliances to be installed and maintained in
and upon all buildings and premises in the
jurisdiction other than private dwellings of

Section 10.305(bl. Approvals. All fire-
extinguishing systems, including automatic
sprinkler systems, Classes I, II and III
combined standpipes, Halon systems and other
special automatic e~tinguishing systems, and
basement pipe inlets shall be approved and
shall be subject to periodic tests as may be
required. A condition of approval of all Halon
systems shall be satisfactory passage of a full
discharge test utilizing an approved test gas,
or other test procedure as approved by the
Chief, prior to final acceptance of the system.

connections shall be approved by the Chief.

impaired, in all public areas of the
building, including but not limited
to elevators, elevator lobbies, rest
rooms, corridors, exi t stairways,
room and tenant spaces exceeding
1,000 square feet in area.
All smoke detectors connected to the
alarm system shall have a light that
indicates the status of the detector.
when a detector is located in a space
above a dropped ceiling, the
indicating light shall be located on
or below the ceiling grid.
3. The activation of any detection
device connected to the alarm system
shall cause the alarm to be sounded
on the floor that the activating
device is on, as well as the floor
above and the floor below the
activating device where these floors
exist.

(e) Emergency evacuation facility.
The roof area shall include an
emergency evacuation facility for
helicopters of less than 12,000
pounds gross weight. This facility
shall have a touchdown pad of at
least a fifty foot (50') diameter and
be surrounded on all sides by a clear
area having a minimum average width
at roof level of fifteen feet (15'),
but with no width less than five feet
(5') .
2. The landing pad shall be designed per
Uniform Bui1dina Code Section
2308(c). Helicopter landing areas
and supports therefor on the roof of
a building shall be of noncombustible
construction.

operated when installed in
existing buildings, or in
buildings without commercial
power. It shall be the
responsibility of the owner to
supply, install and maintain all
required smoke detectors. The
owner shall be responsible for
annually testing all required
smoke detectors.

Every high-rise building shall have an
approved automatic fire-extinguishing
system installed throughout the building
in accordance with the requirements of
NFPA 13 (Standard for the installation of
Sprinkler Systems) 1985 edition. In
addition to the main water supply, a
secondary on-site supply of water equal
to the hydraulically calculated sprinkler
design demand plus 100 gallons per minute
additional for the total standpipe system
shall be provided. This supply shall be
automatically available if the principal
supply fails and shall have a duration of
thirty (30) minutes. Sprinkler control
valves and water flow detecting devices
shall be provided at the lateral
connection to the riser on each floor.

44. Article V. Chapter 5, section 5-35.23 is added to

Section 24 of Aooendix II-A of said Uniform
Fire Code is hereby added to read as follows:
Section 24. Use of Equipment.
( a) Except as otherwise provided in this
section, no person shall use, operate, or cause
to be operated, in upon or adjoining any
hazardous fire area any internal combustion
engine which uses hydrocarbon fuels, unless the
engine is equipped with a spark arrester as
defined in subsection (c) maintained in
effective working order, or the engine is I
constructed, equipped and maintained for the
prevention of fire pursuant to section 24(c).
(b) Spark arresters affixed to the exhaust
system of engines or vehicles subject to this
Section shall not be placed or mounted in such
a manner as to allow flames or heat from the
exhaust system to ignite any flammable
material.
(c) A spark arrester is a device constructed
of non-flammable material specifically for the
purpose of removing and retaining carbon and
other flammable particles over 0.0232 of an
inch in size from the exhaust flow of an
internal combustion engine that uses
hydrocarbon fuels or which is qualified and
rated by the united States Forest Service.
(d) Engines used to provide motive power for
trucks, truck tractors, buses, and passenger
vehicles, except motorcycles, are not subject
to this Section if the exhaust system is
equipped with a muffler as defined in the
Vehicle Code of the State of California.

(e) Turbocharged engines are not subject to
this section if all exhausted gases pass
through the rotating turbine wheel, there is
no exhaust bypass to the atmosphere, and the
turbocharger is in effective mechanical
condition.

of fire in accordance with section 4443

47. Article V. Chapter 5, Section 5-35.26 is added to

Section 27 of Apoendix II-A of said Uniform
Fire Code is hereby added to read as follows:
FUEL MODIFICATION
(a) Development occurring wi thin or
adjacent to County designated Fire Hazard
Severity Zones rated "high" or "very high"
shall require modification of vegetation
at the urban interface. Prior to the
issuance of any building permits, a Fuel
Modification Plan and Program shall be
approved by the Chief. The Fuel
Modification Plan shall show special
treatment of the vegetation required to
achieve an acceptable level of risk in
regard to the exposures of structures to
flammable vegetation and shall delineate
areas selected for specific treatment and
establish provisions for its continued
maintenance. The approved Fuel
Modification Plan shall be installed prior
to the issuance of building permits, under

the supervision of the Fire Marshal, and
pass a final inspection prior to the
issuance of applicable use and occupancy

PERMITS, a precise Fuel Modification Plan

shall include the following information:
a. A plant list of fire
resistant (drought tolerant
suggested) plants to be selected
from the orange County Fire
Department Plan List or as
approved by the Chief.
b. Irrigation plans.
c. Precise delineation of each
fuel modification zone. Brush
shall be cleared as specified
on precise fuel modification
plans.
3 . PRIOR TO THE ISSUANCE OF USE AND
OCCUPANCY PERMITS, the completed fuel
modification installation shall be
approved by the Fire Department.
4. MAINTENANCE. The installed fuel
modification shall be maintained in
accordance with the approved Plan.

54. The modifications to the Building Code that have
previously been enacted are merely a continuation
of the Code of Seal Beach, and all of the changes
and modifications to the Building Code, whether
previously enacted or enacted in this ordinance are
reasonably necessary because of local climate,
characterized by hot, dry summers, followed by
strong santa Ana winds and heavy winter rains, the
location in Southern California and on the Coast,
and the relatively flat topography of the City.
55. State law requires that localities adopt the Uniform
Building Codes and any modifications thereto, by
December 28, 1989. It is essential that the City
have in effect on that date a building code that
comports with state law and contains those
modifications necessitated by unique geographic,
geologic and climatic conditions. In the absence of
immediate effectiveness, the provisions of the
building code unique to the City'S special
circumstances will not be in place and this will
have a detr.;.mental effect on the public health,
safety and welfare. The modifications to the Uniform
Building Code contain vi tal provisions regarding
administrative procedures, roofing materials,
sprin~~ing requirements, and other similar matters
necessi-cated by the City'S exposure to Santa Ana
winds. For these reasons, the public health, safety
and welfare require that this ordinance take effect
immediately. This is an urgency ordinance.
56. This Ordinance shall become operative on December
28, 1989.
