Home My WebLink AboutCC Ord 1300 1990-02-12 I I I WHEREAS, WHEREAS, , OkUL~ANCE NUMBER ~J2__ A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, CALLING AND ~IVING NOTICE OF THE HOLDING OF A SPECIAL MU~ICIPAL ELECTION ON TUESDAY, JUNE 5, 1990, FOR THE SUBMISSION OF A PROPOSED CHARTER AMENDMENT AND ORDERING THE CONSOLIDATION OF SUCH SPECIAL MUNICIPAL ELECTION WITH THE STATEWIDE PRIMARY ELECTION TO BE HELD ON JUNE 5, 1990. pursuant to authority provided by Article XI of the Constitution, Title 4, Division 2, Chapter 3 of the Government Code and Division 5, Chapter 3, Article 3 of the Elections Code of the State of California, the City Council of the City of Seal Beach, desires to submit to the voters a proposed Charter Amendment relating to City Council Compensation 1 and the City Council is authorized by statute to submit the proposed charter amendment to the votersl NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. SECTION 2. SECTION 3. That p~:suant to Article XI of the Constitution, Tit]. 4; Division 2, Chapter 3 of the Government Code ana Division 5, Chapter 3, Article 3 of the Elections Code of the State of California, there is call~d and ordered to be held in the City of Seal Beach, California, on Tuesday, June 5, 1990 a Special Municipal Election for the purpose of submitting the following proposed Charter Amendment: '. Charter Amendment Shall Section 402 of the Charter of the City of Seal Beach be amended to read: "Compensation. Compensation for the members of the City Council shall be established by ordinance in accordance with provisions of Section 36516 and 36516.5 of the YES State of California Government Code as such provisions now exist or may thereafter be amended? NO Each member of the City Council shall receive reimbursement for Council authorized expenses in accordance with provisions of Section 36514.5 and 37201 through 17!~J of the the State of California G:.ve:cnment Code."? ,', Tho. the text of the Charter Amendment submitted to tha ~~ters is as set forth above. The Special Municipal Election hereby called for and the date ~ereinbefore specified shall be and is hereby ordered consolidated with the Statewide primary Election to be held on June 5, 1990. The election precincts, polling places, and officers Ordinance Number ~~~O SECTION 4. SECTION 5. SECTION 6. SECTION 7. of election shall be the same as those set forth in the notice calling or providing for or listing or designating the precincts, polling places and election officers in the City of Seal Beach for the Statewide primary election with which the Special Municipal Election called by this Ordinance is consolidated. The Board of I Supervisors of Orange County is hereby authorized to order the consolidation of the Special Municipal Election hereby called with said Statewide Primary Election, and the Election Department of Orange County is hereby authorized to canvass the returns of said Special Municipal Election, and said election shall be held in all respects as if there were only one election, and only one form of ballot, namely the ballots used at said Primary Election shall be used. Said Elections Department of Orange County shall certify the results of the canvass of the returns of said Special Municipal Election to the City Council of said City and shall thereafter declare the results thereof. The polls for said election shall be opened at 7:00 o'clock a.m. of the day of said election and shall remain open continuously from that time until 8:00 o'clock p.m. of said day, when said polls shall be closed except as provided in Section 14301 of the Election Code of the State of California. Notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed, and directed to give such further notice of said election as required by law. I Pursuant to Section 416 of the City Charter, this Ordinance shall take effect and be in force immediately upon it adoption.
