AN ORDINA~CE OF THE CITY OF SEAL BEACH AMENDI~~ "HAPTER 19B OF THE CODE OF THE CITY OF :~.L BEACH RELATING TO SIGNS AND DECLARING THE URGENCY THEREOF 'THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: SECTION 1. Chapter 19B of the Code of the City of Seal Beach, California, is hereby amended by adding Article III as follows: I "Article III. Handbills and Signs on Public Property or Public Utility Property. Section 19B-6. Purpose. The purpose of this Article is to promote the safety of public workers, utility workers, and the public generally by eliminating hazards caused by signs and handbills placed on public and utility p~operty, to promote and enhance the quality of the visual environment and thereby promote the pUblic welfare and maintain the value of properties adjacent to pUblic and utility property, and to promote traffic safety by limiting distracting handbills and signs and forbidding those which obstruct visibility to vehicular or pedestrian traffic, and to otherwise protect and promote the public health, safety, and welfare. Section 19B-7. Prohibited Generally. I N~ - rson shall paint, mark, or write on, or post or . derwise affix, any handbill or sign, as that term is defined in Section 28-271.1 of this Code, to or upon any public right-of-way, sidewalk, crosswalk, curb, curbstone, street lamp post, hydrant, tree, shrub, tree stake or guard, railroad trestle, electric light or power or telephone or telegraph or trolley wire pole or appurtences or apparatus connected therewith, or wire appurtenant thereof or upon any fixture of the fire alarm or police telegraph system or upon any lighting system or public bridge, drinking fountain, life buoy, life preserver, life boat, or other life saving equipment, street sign or traffic sign owned or maintained by any public agency or public utility, as that term is defined in Section 216 of the California Public Utilities Code. Section 19B-8. violations. I Any handbill or sign, as that term is defined in Section 28-271.1 of this Code, found posted, or otherwise affixed upon any public property or property owned or maintained by a public utility, as that term is defined in Section 216 of the California Public utilities Code, contrary to the provisions of this Article is declared to be a public nuisance and may be removed by the City. Th~ p~rson responsible for any such illegal posting shal~ be liable for the cost incurred in the removal thereof and the City Manager is authorized tr, p'fect the collection of that cost. Ordinance Number I~()~ SECTION 2. SECTION 3. Section 19B-9. Exceptions Nothing in this section shall apply to any of the following: (a) the painting of house numbers upon curbs done under permits issued by the City and consistent with standards established by I that permit, (b) signs installed upon or affixed by a public utility, as that term is defined in Section 216 of the California Public utilities Code, to property owned or maintained by that utility which are otherwise in compliance with this Code and other applicable laws and regulations, (c) any sign installed upon or affixed by a public agency created under the law of the State of California or the United States to property owned or maintained by that agency which are otherwise in compliance with this Code and other applicable laws and regulations." The City Council of the City of Seal Beach hereby finds that the proliferation of signs and handbills on pUblic and utility property in the City has produced a hazard to the safety of employees who must work on utility poles and other public and utility fixtures. Moreover, such signs and handbills have impaired visibility of pedestrian and vehicular traffic and contributed to the distraction of vehicle operators and thus created traffic hazards. Unless this ordinance takes effect promptly the City's authority to abate these hazards will not be free from doubt. Accordingly, this ordinance must go into effect without delay in order to protect the public health, safety, and welfare. This is an urgency ordinance and shall take effect immediately upon adoption pursuant to Section 412 of the Seal Beach Official Charter.
