AN INTERIM ORDINANCE OF THE CITY OF SEAL BEACH EXTENDING INTERIM ORDINANCE NUMBER 1304, AS AMENDED BY ORDINANCE NUMBER 1307, PROHIBITING THE ISSUANCE OF PERMITS ALLOWING CERTAIN COVERED ROOF ACCESS STAIRWELLS AND DECLARING ~HE URGENCY THEREOF THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: Section 1. Section 2. I I Ordinance Number 1304, as amended by Ordinance Number 1307, is hereby extended to and including April 23, 1991. The Findings set forth in Ordinance Number 1304 are hereby incorporated by this reference. With the exception of Interim Ordinance Number 1304, which, if not extended hereby, would expire on June 7, 1990, there is at the present time no ordinance sufficiently regulating covered roof access stairwells. Due to an exception to Code standards, such structures have exceeded maximum height standards. Such covered roof access stairwells have obstructed views, have adversely affected neighboring properties; access to light and air, and have been developed without clear standards for their height and bulk. The zoning ordinance presently lacks adequate land use controls to ensure the orderly development of such structures. Development of such structures in the absence of clear standards has generated conflict among neighbors which poses a current and immediate threat to the peace, harmony, and welfare of the City. Unregulated development of additional covered roof access stairwells will cause adverse impacts on the use, enjoyment and value of property within the City. Development of additional covered roof access stairwells that would conflict with future regulations would be detrimental to the welfare of the community. A revision of the applicable portions of the zoning ordinance permitting such structures is now being prepared. City staff has undertaken studies to review the impact of such structures and has heretofore recommended that such structures be permitted in the Surfside areas of the City. However, the necessary studies have not been completed. It would defeat the purposes of Interim Ordinance Number 1304 to permit the Ordinance to expire until the studies are completed and a permanent ordinance is prepared and adopted. Expiration of the regulations contained in Ordinance Number 1304 would permit development of covered roof access stairwells that would be inconsistent and incompatible with existing uses in the City. The public peace, health, safety and welfare require that no further covered roof access stairwells, except those permitted by Ordinance Number 1307, be constructed in the City until the City adopts adequate land use controls regulating such structures. Therefore, there is a current and immediate threat to public health, safety and welfare and Ordinance Number ~ B . Section 3. Section 4. Section 5. Notwithstanding the provisions of Section 28- 2317 (3) (D)or any other provision of the Seal Beach Municipal Code, no building permits or other entitlements of use which would permit covered roof access stairwells, except as permitted by Ordinance Number 1307, shall be issued. I This ordinance is hereby declared to be an emergency measure for preserving the public peace, health, safety and welfare and shall take effect immediately and shall remain in effect until April 23, 1991, unless it is extended or repealed by this City Council.
