HomeMy WebLinkAboutCC Res 5265 2004-08-09 I I I RESOLUTION NUMBER :5 ;)ip5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AWARDING A CONTRACT AND AUTHORIZING THE DISPENSING OF BIDDING FOR AN ON- SITE SODIUM HYPO-CHLORITE GENERATION SYSTEM THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. In 1999, the City's Water Department switched from a chlorine gas method to chlorinate the City's water supply to an on-site sodium hypo-chlorite generation system. On-site generation provides the City the power of chlorine gas without the danger of storing or handling hazardous materials while providing a safe, efficient and economical alternative. It operates automatically requiring only water, salt and electricity. In order for the system to function more efficiently and reduce the transporting of liquid brine from other stations because of high water demand, a new system is needed. Severn Trent Water Purification, Inc is the sole manufacturer and producer of the Chlotec sodium hypo-chlorite generation system. Section 2. Pursuant to Section 3.2~:025 oqhe Seal Beach Municipal Code, the purchase of a commodity is exempt from the bid requirements of Chapter 3.20 of the Municipal Code where such commodity can be obtained only from one vendor. Further, pursuant to Section 3.20.045 of the Seal Beach Municipal Code, the city council may award a contract for the purchase of supplies and equipment without satisfaction of Chapter 3.20's bid requirements upon making a finding that, due to the circumstances applicable to the patiicular purchase, the net cost to the city will be reduced by dispensing with bidding. Moreover, pursuant to Section 1010 of the Official Charter of the City of Seal Beach, the City Council may declare and detennine that in its opinion, based upon estimates provided by the City Manager, supplies or material may be purchased more economically on the open market. Section 3. Based upon the foregoing and the infol1nation contained in the staff report, and in accordance with Sections 3.20.025 and 3.20.045 ofthe Seal Beach Municipal Code, the Council finds, declares and determines that the purchase of the on-site sodium hypo-chlorite generation system is exempt from the bid requirements of Chapter 3.20 of the Municipal Code because such commodity can be obtained only from one vendor and that, due to the circumstances applicable to the particular purchase, the net cost to the city will be reduced by dispensing with bidding. Section 4. The City Council hereby approves the contract between the City atld Severn Trent Water Purification, Inc dated August _, 2004, and directs the City Manager to execute the contract on behalf of the City. Section 5. The City Clerk shall certify to the passage and adoption of this resolution.
