RESOLUTION NUMBER~
A RESOLUTION OF THE CITV COUNCIL OF THE CITY OF
SEAL BEACH AUTHORIZING THE DESTRUCTION OF
CERTAIN POLICE DEPARTMENT RECORDS
THE CITV COUNCIL OF THE CITY OF SEAL BEACH DOES RESOLVE AS
FOLLOWS:
Section 1.
Findine:s.

A. The Seal Beach Records Retention Policy (as revised by City Council Resolution
No. ) authorizes the City to destroy certain types of records that are obsolete and not'
required by law to be retained. Under the policy, no such record may be destroyed without the
prior approval of the City Council and the written consent of the City Attorney.
B. The Chief of Police has presented a report to the City Council identifying
particular records that are obsolete and not required by law to be retained by the City. A general
description of these records (hereinafter referred to as "the subject records") is set forth in the
attached Exhibit "A."
Section 2. City Attornev Consent. The signature of the City Attorney on this Resolution
shall evidence such official's written eonsent to the destruction of the subject records.
Section 3. Authorization To Destrov Reeords. The Chief of Police, or such official's
designee, is hereby authorized to destroy the subject records without retaining a copy thereof.
Upon destruction of the subject records, the Chief of Policy shall certify in writing to their
destruction and shall file such certification with the City Clerk.

11 Pursuant to Resolution No. 4951 of the City Council of the City of Seal Beach, the
records authorized to be destroyed on this list shall not include any documents relating to
citizen complaints, inclllding internal affairs investigation files, which are in evidence in
any claim filed or pending litigation, and any international affairs files, capital crimes,
embezzlements of public funds, bribery of public officials, and child abuse reports.

Pursuant to Resolution No. 4951 ofthe City Council of the City of Seal Beach, a
misdemeanor crime report may only be destroyed provided that:
a.) No warrant related to the report is outstanding
b.) No property related to the report is outstanding in the DOlor NCIC
databases.
c.) No death is connected with the report
d.) The report is not involved in pending litigation
e.) The report docs not relate to Penal Code Section 799 or Section 800 violations
f.) The report does not related to Penal code Section 290 or 457.1 violations
g.) The report does not related to a Health and Safety Code Section 11590
