Home My WebLink AboutCC Res 4964 2001-12-10 RESOLUTION NUMBER 4I96~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, RECITING THE FACTS OF THE SPECIAL LANDOWNER ELECTION HELD IN THE CITY OF SEAL BEACH ON THE 27th DAY OF NOVEMBER, 2001, DECLARING THE RESULTS THEREOF, AND SUCH OTHER MATTERS AS PROVIDED BY LAW. I WHEREAS, A Special Landowner Election was held and conducted in the City of Seal Beach, County of Orange, State of California, on Tuesday, the 27th day of November, 2001, as ordered by Ordinance Number 1478 of the City of Seal Beach, California, adopted September 24th,2001;,and WHEREAS, Said Special Landowner Election was neld in the City of Seal Beach for the purpose of submitting to the landowners proposed measures relating to an increase of the street sweeping fee aria the tree trimming fee; and WHEREAS, Notice of said election was duly and regularly given in time, form, and manner as provided by law; in all respects said election was held and conducted and - votes were cast, received and canvassed, and the returns made as set forth by the provisions of the Elections Code of the State of California, more specifically Sections 4000 and 4100 et seq. for the I holding of mail ballot elections; and WHEREAS, pursuant to Resolution Number 4936, adopted the 24th day of September, 2001, the City Clerk canvassed the returns of said election and has certified the results of same, the results are received, attached, and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. That the measures voted upon at the Special Landowner Election were as follows: MEASURE A Shall Resolution Number 4932 be ratified to: increase street sweeping fees; prohibit the City Council from YES increasing such fees in any future year by more than the increase in the Consumer Price Index; and require the NO City Council to hold a public hearing prior to enacting any future increase? I MEASURE B Shall Resolution Number 4933 be ratified to: increase tree trimming fees; prohibit the City Council from increasing such fees in any future year by more than the increase in the Consumer Price Index; and require the City Council to hold a public hearing YES -' NO I I I Resolution NUmber ~~ prior to enacting any future increase?; and Section 2. That the number of votes given in the City for and against Measure A and Measure B are as set forth in Exhibit "Au attached hereto; and Section 3. The City Council does declare and determine that: That as a result of the election, a majority of the voters voting on Measure A relating to the proposed increase of street sweeping fees did not vote in favor of it, therefore the Measure was not carried, and Resolution Number 4932 shall not be deemed adopted and ratified; and That as a result of the election, a majority of the voters voting on Measure B relating to the proposed increase of tree trimming fees did not vote in favor of it, therefore the Measure was not carried, and Resolution Number 4933 shall not be deemed adopted and ratified; and Section 4. The City Clerk shall enter in the records of the City Council of said City, a statement of the results of said election showing: (1) The whole number of ballots cast in the City; (2) The Measures voted upon; (3) The total number of votes given for and against each Measure. Section 5. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
