Home My WebLink AboutCC Res 4976 2002-01-14 RESOLUTION NUMBER /!91Co A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AMENDING SEAL BEACH BOULEVARD UNDERGROUND UTILITY DISTRICT 99-1 ON SEAL BEACH BOULEVARD TO BE FROM A POINT 1931.92 FEET SOUTHERLY OF THE CENTERLINE OF ADOLFO LOPEZ DRIVE TO ELECTRIC A VENUE WHEREAS, on May 24,1999 the City Council adopted Resolution No. 4712 which established the I Seal Beach Boulevard Underground Utility District 99-1 on' Seal Beach Boulevard between Adolfo Lopez Drive and Electric Avenue being approximately 6,626.72 feet long; and WHEREAS, the establishment of underground utility districts allows for the undergrounding of existing overhead utilities through the use of the California Public Utilities Commission (PUC) Rule 20A funding program which is administered by,the Soulhern Califomia Edison Company; and WHEREAS, tbe Seal Beach Boulevard Underground Utility District 99-1 includes the Seal Beach Boulevard 1,699.70 foot frontage of the Hellman Ranch Development Tentative Tract No. 15402, located on the west side of Seal Beach Boulevard at Forrestal Lane and the City of Seal Beach Police Department 232.22 foot frontage on the west side of Seal Beach Boulevard northerly of the Hellman Ranch Development to Adolfo Lopez Drive; and WHEREAS, the Hellman Ranch Development Tentative Tract conditions require the developer to underground the existing overhead utilities along the Seal Beach Boulevard frontage of the development, or to reimburse the City for the Rule 20A funds expended to do that work if the undergrounding is accomplished through Seal Beach Boulevard Underground Utility District 99-1 Rule 20A funding program; and , the Hellman Ranch Development developer has requested that their Seal Beach Boulevard frontage be removed from the Seal Beach Boulevard Underground Utility District 99-1 and that they be allowed to accomplish the undergrounding of their existing overhead utilities on their Seal Beach Boulevard frontage with their own forces and at their own expense; and 1 WHEREAS, WHEREAS, the City of Seal Beach frontage on Seal Beach Boulevard northerly of the Hellman Ranch Development to Adolfo Lopez Drive has already been undergrounded and therefore should be removed from the Underground Utility District 99-1; and WHEREAS, the City staff recommends that the boundary of the Seal Beach Boulevard Underground Utility District 99-1, which describes the area where Rule 20A funds can be used for undergrounding of existing overhead utilities, be amended by removing the Hellman Ranch Development frontage on Seal Bcach Boulevard and by atso removing the City of Seal Beach Boulevard frontage on Seal Beach Boulevard located northerly of the Hellman Ranch Development to Adolfo Lopez Drive from the Seal Beach Boulevard Underground Utility District 99-1; and WHEREAS, a public hearing was called for January 14, 2002 at the hour of 7:00 p.m., or as soon thereafter as the matter could be heard. in the Council Chambers of City I-hill to I consider amending the Seal Beach Boulevard Underground Utility District 99-1, and to ascertain whether the public necessity, health, safety or wel fare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service to the proposed Amended Seal Beach Boulevard Underground Utility District 99-1 described, as amended, comprised of property within the public right of way on Seal Beach Boulevard from a point 1931.92 feet southerly of the centerline of Adolfo Lopez Drive to Electric Avenue, as shown on the attached Exhibit "A" entitled "Amended Seal Beach-Boulevard Underground Utility District 99-1 Boundary Map" dated January 14, 2002; and I I I Resolution Number .f'?1'~ WHEREAS, notice was given to all alTected property owners and utilities concerned in the manner and for the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Seal Beach does hereby find and determine that the Seal Beach Boulevard Underground Utility District 99-1 needs to be amended. BE IT FURTHER RESOLVED that the City Council of the City of Seal Beach does hereby also find and determine that the public necessity, health, safety and welfare requires the removal of poles, overhead wires and associated structures and the underground installation of wires and facilities for supplying electric, communication or similar or associated service within the area of the Amended Seal Beach Boulevard Underground Utility District 99-1 described, as amended, comprised ofproperty within the public right of way on Seal Beach Boulevard from a point 1931.92 feet southerly of the centerline of Adolfo Lopez Drive to Electric Avenue, as shown on the attached Exhibit "A" entitled "Amended Seal Beach Boulevard Underground Utility District 99-1 Boundary Map" dated January 14, 2002. BE IT FURTHER RESOLVED that the City Council of the City of Seal Beach finds that: a) Such undergrounding will avoid or eliminate an unusually heavy concentration of overhead transmission facilities; and b) Said streets and avenues are extensively used by the general public and cony a heavy volume of pedestrian and vehicular traffic. BE IT FURTHER RESOLVED that the Amended Seal Beach Boulevard Underground Utility District 99-1 described, as amended, comprised of property within the public right of way on Seal Beach Boulevard from a point 1931.92 feet southerly of the centerline of Adolfo Lopez Drive to Electric Avenue, as shown on the attached Exhibit "A" entitled "Amended Seal Beach Boulevard Underground Utility District 99-1 Boundary Map" dated January 14, 2002 is hereby approved and adopted and that all poles, overhead wires and associated overhead structures shall be removed and underground installations made in said underground utility district no later than June 30, 2003 by all affected utility companies. BE IT FURTHER RESOLVED that the City Clerk, within ten (10) days after the adoption of this resolution shall mail a copy hereof and a copy of the Seal Beach Municipal Code Section 25A to affected property owners, if any, as shown on the last equalized assessment roll and to the alTected utilities.
