Re: Revision of Personnel Rules
Dear Ginger:
Thank you for the opportunity to submit our proposal for revision of the City's
Personnel Rules. As discussed more fully below, we propose a comprehensive review
and revision at a cost not to exceed $7,500.
Scope and Work Plan
I
We propose to review, update, supplement and redraft the City's Personnel
Rules to provide a comprehensive, up-to-date set of rules that complement the other
elements of the City personnel system. The requirements of the Personnel Rules will
be coordinated with the City's employment policies, both to eliminate overlap and to
fill any gaps that may exist. The revisions will also take into account changes in
employment laws and personnel administration that have occurred since the City's
Personnel Rules were last revised. Finally, the revisions will address problem areas
identified by you and other City staff.
Subject to your approval, we propose the following work plan:
· Review existing personnel rules and policies to outline needed changes
and topics to be addressed. Review Charter, MuniCipal Code and
Memoranda of Understanding to coordinate changes with the City's
other requirements and commitments.
· Solicit changes and problem areas from you and other interested City
personnel that you designate. Discuss our proposals with you and the
designated City personnel.
· Analyze the existing rules, based on our review and input from you and
other City personnel. Compare to standards used in both publi~ and
private personnel systems, with an emphasis on the experience of other
public sector employers. Determine the details of the changes that will
be made.

· Prepare draft rules for your review and comment. Review, explain and
revise draft rules.
· Revise draft rules. Prepare final draft of personnel rules and provide in
electronic format (Microsoft Word).
· Attend two (2) on-site meetings, if requested.
We understand that you want to have this work completed this fiscal year. We
are prepared to work with you and City staff to meet this deadline.

Staffing .
I will be the attorney primarily responsible for this project and I will perform
most of the work. Quinn M. Barrow will supervise and also work on the project. We
may call on other attorneys in our firm to assist if the need arises, but we do not
anticipate this need at present. As you know, Quinn and I have worked extensively
with the City and we anticipate that our contact and communications with City
personnel for this project will be similar to our other work for the City.
Rates and Price
I
We propose to use our standard billing rates for this work, subject to a riot-to-
exceed limit of $7,500. We do not bill separately for secretarial, word processing or
other support staff. Rates are reviewed and adjusted annually, but we do not anticipate
any change before the project is complete.
We bill for certain costs, including copying ($0.1 O/page), facsimile
transmission ($lIpage, outgoing only), messenger and delivery services (actual
charge). We bill for other charges, such as long distance telephone and preparation of
transcripts, but do not anticipate that these other charges will apply to this project.
All time and charges for this project will be billed to a separate billing number
and invoiced separately to the City. Our current time estimate indicates that this
project is likely to result in total charges of at least $7,500. However, in the event that
it can be completed for less than this amount, the City will have the advantage of the
savings generated by the use hourly rates. Obviously, if work within the scope of the
project requires more hours, the City's cost will be capped at $7,500.
Additional Services
Prior to adoption, the City will need to notifY represented employees of
changes to the Personnel Rules that are within the scope of bargaining. Ifrequested
by the unions, the City may be required to meet and confer over certain changes. In
addition, the City will probably want to consult with non-represented employees
regarding the changes. We are aware that the City handles labor relations with the
assistance of an outside negotiator and labor relations specialist. As a result, we have
not included these services in our proposal. We can, of course, include such services
in addition to the not-to-exceed amount or in another manner that is mutually
agreeable.
Our services for this project will be complete once the City accepts the Rules
in final draft form. Future revisions or updates and help in applying the Rules can be;
provided as part of our regular services for the City.

Conclusion
We hope this letter answers your questions concerning the work we propose
for revision of the Personnel Rules. Quinn and I are very interested in working with
you and the other City staff on this project. If you have any questions or need
additional information, please let me know. We are prepared to start work on this
project upon receiving authorization.
