RESOLUTION NUMBER 06-13
A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE
CITY OF SEAL BEACH RESCINDING PRIOR RESOLUTION NO.
06-06 AND APPROVING A GRANT OF EASEMENT TO
HELLMAN PROPERTIES, LLC FOR ACCESS ACROSS A
WESTERLY PORTION OF THE CITY OF SEAL BEACH
CORPORATION YARD PROPERTY

THE REDEVELOPMENT AGENCY OF THE CITY OF SEAL BEACH DOES
HEREBY RESOLVE:
WHEREAS, prior Resolution No. 06-06 included an incorrect statement in the seventh
"WHEREAS" paragraph which Hellman Properties, LLC requested be changed and
which the Redevelopment Agency of the City of Seal Beach desires to correct by
rescinding prior Resolution No. 06-06; and
WHEREAS, with the development of the Hellman Subdivision Tract No. 15402 access
to the easterly oil wells along Seal Beach Blvd. had to be relocated to the northerly side
of the Hellman property which eliminated direct access to the Hellman property from
Seal Beach Blvd.; and
WHEREAS, the Hellman oil field still needs access to and from Seal Beach Blvd. in
order to be able to better service and maintain their oil wells; and

WHEREAS, it was agreed as part of the Hellman Subdivision Tract No. 15402
Agreement that the Redevelopment Agency of the City of Seal Beach would allow
Hellman Properties, LLC access across a westerly portion of the City of Seal Beach
Corporation Yard property to provide access to and from Seal Beach Blvd by way of
Adolfo Lopez Drive; and
WHEREAS, an access easement across the westerly portion of the City of Seal Beach
Corporation Yard property will provide for, and will allow Hellman Properties, LLC, the
agreed to access; and
WHEREAS, the area of an access easement is proposed to be located along the westerly
side of the Animal Shelter Property which will provide access from Adolfo Lopez Drive
to the Hellman property and does not interfere with any of the active area of the City of
Seal Beach Corporation Yard; and
WHEREAS, the proposed Grant of Easement also sets forth conditions for Hellman
Properties, LLC to repair and maintain the surface improvements, such as pavement and
driveway approach, and to repair any damage done by Hellman Properties, LLC to
surface or underground facilities at HeUman Properties, LLC expense; and

WHEREAS, a similar easement, by separate deed, over this same easement area, and
separate deed will also be recommended to the Redevelopment Agency of the City of
Seal Beach to be granted to the Orange County Flood Control District (District) to allow
the District access from Adolfo Lopez Drive to an access easement on the HeUman
property being granted by HeUman Properties, LLC to the District which will allow the
District access to the storm drain outlet pipe that connects the Heron Pointe retention
basin to the Los Alamitos Retention Basin (OCFCLARB); and
WHEREAS, HeUman Properties, LLC has executed the aforementioned Grant of
Easement acknowledging and agreeing to the conditions of approval set forth in said
Grant of Easement; and
WHEREAS, the City Engineer recommends that the Redevelopment Agency of the City
of Seal Beach approve the Grant of Easement to Hellman Properties, LLC.
NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Agency of the City
of Seal Beach that the aforementioned Grant of Easement to Hellman Properties, LLC is
hereby approved; and

BE IT FURTHER RESOLVED by the Redevelopment Agency of the City of Seal
Beach that the Chairman is hereby authorized to execute the aforementioned Grant of
Easement to Hellman Properties, LLC on behalf of the Redevelopment Agency of the
City of Seal Beach; and
BE IT FURTHER RESOLVED by the Redevelopment Agency of the City of Seal
Beach that the City Clerk of the City of Seal Beach shall have the aforementioned Grant
of Easement duly and properly recorded in the official records of the office of the
Recorder of the County of Orange; and

BE IT FURTHER RESOLVED by the Redevelopment Agency of the City of Seal
Beach that upon return of the aforementioned recorded Grant of Easement from office of
the Recorder of the County of Orange that a copy of the aforementioned recorded Grant
of Easement be forwarded to Hellman Properties, LLC.
PASSED, APPROVED AND ADOPTED by the Redevelopment Agency of the City of
Seal Beach this 11 th day of December , 2006 by the following vote:
