BACKGROUND AND ANALYSIS: This section does not apply to this item. ENVIRONMENTAL IMPACT: There is no environmental impact related to this item. LEGAL ANALYSIS: No legal analysis is required for this item. FINANCIAL IMPACT: There is no financial impact. CLOSED SESSION The City Attorney announced that the City Council would meet tm discuss the items identified on the closed session agenda: Item "A"—Conference with Labor Negutiodor—GC §54g578—Police Management Ammnciabmn� and Item^B^—GC §54956.9(d)(2)Conference with Legal Counsel—Anticipated Litigation—1case. The City Attorney announced that no reportable action was taken. With no objections, K8eymr Deebon called for e recess at 8:28 p.m. and reconvened the meeting at8:4Op.m. ORAL COMMUNICATIONS Mayor Oeaton opened oral communications. Speakers: Jack Outy, 1Om Stnoet, stated his concerns about the traffic problems around 1Um Street—Mayor Deabon indicated that she has requested a traffic study for that area; and Joyce Panque, 8m Street, presented the City Council o request to have an audit of the pension fund— inquired about the in-lieu parking fees—omhed if there is s@| a lobbyist in Washington DC for the city—and oppose the UUT ba||cd measure, There being no other speakers, Mayor Deatondeclared oral communications closed. CITY ATTORNEY REPORT Steven L. Flower, Emq.. City Attorney No report et this time. CITY MANAGER REPORT Jill R. Ingram, City Manager NP report et this time. COUNCIL COMMENTS Councilman Levitt reminded the residents to protect themselves and others during the West Nile Virus season; Mayor Pro Tenn Sloan commended the Lifeguard department for their actions during a lifesaving incident', and Mayor Deaton commended the Police department for msuccessful "National Night Out" Page 2—City Council 08/11/14 event and informed the residents on how to safely dispose of old prescription medication. COUNCIL ITEMS No items at this time. CONSENT CALENDAR Sloan moved, second by Shanks, to approve the recommended actions on the consent calendar as presented. Approved the Minutes of the Adjourned City Council meeting and the Joint Regular City Council and Successor Agency meeting of July 28, 2014. *B. Ratified the Demands on City Treasury. Warrants: 104279-104521 $2,173,409.73 Year-to-Date: $5,536,351.29 Payroll: Direct Deposits&Checks $ 562,710.45 Year-to-Date: $1,189,840.97 Year-to-date are actual cash disbursements and do not reflect actual expenditures due to year-end accruals. Adopted Resolution No. 6496 entitled "A RESOLUTION OF THE SEAL BEACH CITY COUNCIL APPROVING AMENDMENTS TO EMPLOYMENT AGREEMENTS WITH THE CITY MANAGER, ASSISTANT CITY MANAGER, DIRECTOR OF COMMUNITY DEVELOPMENT, DIRECTOR OF PUBLIC WORKS, DIRECTOR OF FINANCE/CITY TREASURER, CHIEF OF POLICE, AND MARINE SAFETY CHIEF". (Section 9.0 - will change written notice to terminate the agreement from 90 days to 30 days). `D. Adopted Resolution No. 6497 entitled "A RESOLUTION OF THE SEAL BEACH CITY COUNCIL DECLARING WORK TO BE COMPLETED PER CONTRACT DOCUMENTS FOR OCEAN AVENUE ALLEY WATERLINE AND SEWER REPLACEMENTS PROJECT NO. WT1401". (Charles King Company-total amount of$951,750.98) ITEMS REMOVED FROM THE CONSENT CALENDAR No items were pulled from the consent calendar. PUBLIC HEARING No items at this time. NEW BUSINESS ITEM "E"/ RESOLUTION NO. 6498 / EMERGENCY WATER CONSERVATION MEASURES/MUNICIPAL CODE X9.35.150 if IMPLEMENT PHASE 1 The Director of Public Works provided the information regarding the emergency requirements enacted by State Order 2014-0038; explained Ordinance 1586 was adopted the last time there was a State water concern and Phase 1 will be implemented; and indicated how enforcement will be done. Joe Berg, representing MWDOC (Municipal Water District of Orange County), presented a background summary and incentive programs offered by MWDOC (www.ocwatersmart.com). John Hunter, John Hunter&Associates— contracted to implement the City's NPDES (National Pollutant Discharge Elimination System) program, was present to answer any questions and introduced Glen Cajar who will be doing the inspections for Seal Beach. Page 3-City Council 08/11/14 Council comments: Need a period to notice the community about the enforcement; would like to have the hours changed; would be allowed to wash cars any time and any day (using a positive shut off valve/nozzle); enforcement would need to be unique to catch those in violation of run-off late at night; no watering on Sundays; make sure minor changes to Phase 1; inquired about the artificial turf; golf course exemption; and suggested using reclaimed water for City watering. Mayor Deaton stated that any member of the audience may address the Council regarding this item. Speakers: Robert Goldberg, Clipper Way, expressed his opinions on what the State is ordering and what the City is implementing; Rickie Layman, 5`h Street, stated she supports the change of the hours; and Jeannie Dennison, Clipper Way, said she supports the comments made and the time change. Staff clarified that State mandated the implementation of Phase 1 of the municipal code and any minor changes to Phase 1. The City Attorney indicated that the action before the City Council is to adopt a resolution to implement Phase 1 of the water conservation ordinance in the municipal code and this is not to amend the code. Levitt moved, second by Shanks, to adopt, as amended, Resolution No. 6498 entitled "A RESOLUTION OF THE SEAL BEACH CITY COUNCIL ADOPTING EMERGENCY WATER CONSERVATION MEASURES AND IMPLEMENTING PHASE 1 OF THE CITY'S WATER CONSERVATION ORDINANCE". (Municipal Code §9.35.150 — with the exception of subsection "G") — amended Section 2 that changed the proposed time from 6:00 p.m. to 6:00 a.m.to the hours between 5:00 p.m. and 9:00 a.m. and delete Section 2.0 — regarding washing cars and renumber resolution. AYES: Deaton, Levitt, Miller, Shanks, Sloan NOES: None Motion carried ADJOURNMENT Mayor Deaton announced that due to a lack of business items in need of City Council action, the August 25, 2014 meeting is hereby cancelled and with no objections, adjourned the meeting at 9:47 p.m. to Monday September 8, 2014 at 5:30 p.m. to meet in closed session, if deemed necessary.
