SUBJECT: AUTHORIZING AN APPLICATION FOR THE
WESTMINSTER AVENUE PAVING REHABILITATION
PROJECT
SUMMARY OF REQUEST:
That the City Council adopt Resolution No. 6515 authorizing an application for
grant funds under the Westminster Avenue Paving Rehabilitation Project.
BACKGROUND AND ANALYSIS:
The Arterial Pavement Management (APM) Program by the Orange County
Transportation Authority (OCTA) provides grant funds to local agencies; used to
address pavement maintenance and improve the functional pavement condition
in Orange County. Projects eligible for APM Program must be identified on the
Master Plan of Arterial Highway (MPAH) and able to receive federal funding.
Based upon the specific criteria, an application was submitted for pavement
rehabilitation on Westminster Avenue from West City Limit to Seal Beach Blvd
program for fiscal years 2015-16. Westminster Avenue is identified as a
secondary arterial within the MPAH and identified for rehabilitation within the
City's 2014 Pavement Management Program Report.
The Westminster Avenue Paving Rehabilitation Project consists of rehabilitating
the failed pavement sections and then removing and replacing the surface of the
pavement. Also, all sidewalks and curb ramps will have failures replaced and
improved to comply with current American with Disabilities (ADA) requirements.
ENVIRONMENTAL IMPACT:
Submittal of a grant application is not a project within CEQA, but this project will
comply with all requirements of the California Environmental Quality Act (CEQA).
Detailed information will be presented at the appropriate time.

LEGAL ANALYSIS:
No legal analysis is required for this item.
FINANCIAL IMPACT:
The APM Program requires a 50% minimum local match. The project cost
estimate is $1,000,000 and the City's contribution is $500,000. Funds have not
yet been budgeted for this project. If the grant is approved, funding options will
be presented during the FY 2015-16 budget study sessions and included into the
future budget.
RECOMMENDATION:
That the City Council adopt Resolution No. 6515 authorizing an application for
grant funds under the Westminster Avenue Paving Rehabilitation Project.

A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
AUTHORIZING AN APPLICATION FOR FUNDS FOR THE
ARTERIAL PAVEMENT MANAGEMENT PROGRAM FUNDED
WITH REGIONAL SURFACE TRANSPORTATION PROGRAM
FUNDING UNDER THE MOVING AHEAD FOR PROGRESS IN
THE 21ST CENTURY FEDERAL TRANSPORTATION ACT FOR
WESTMINSTER AVENUE PAVING REHABILITATION PROJECT
WHEREAS,the United State Congress enacted the Moving Ahead for Progress
in the 21 st Century(MAP-21) Federal Transportation Act on July 6, 2012,which
makes Regional Surface Transportation Program funds available to the Orange
County Transportation Authority (OCTA); and
WHEREAS, OCTA has established the procedures and criteria for reviewing
proposals; and
WHEREAS, the City of Seal Beach possesses authority to nominate projects
funded using Regional Surface Transportation Program funding, provide
sufficient local match, and to finance, acquire, and construct the proposed
project; and
WHEREAS, the City of Seal Beach possesses authority to nominate projects
funded using Regional Surface Transportation Program funding, provides
sufficient local match, and to finance, acquire, and construct the proposed
project; and
WHEREAS, by formal action the City Council authorizes the nomination of
Westminster Avenue Paving Rehabilitation Project, including all understanding
and assurances contained therein, and authorizes the person identified as the
official representative of the City of Seal Beach to act in connection with the
nomination and to provide such additional information as may be required; and
WHEREAS, the City of Seal Beach will maintain and operate the property
acquired, developed, rehabilitated, or restored for the life of the resultant facility
or activity; and
WHEREAS, with the approval of the California Department of Transportation
(Caltrans) and/or OCTA, the City of Seal Beach or its successors in interest in
the property may transfer the responsibility to maintain and operate the property;
and
WHEREAS, the City of Seal Beach will give Caltrans and/or OCTA's
representatives access to and the right to examine all records, books, papers or
documents related to the arterial pavement management project; and
WHEREAS, the City of Seal Beach will cause project work to commence within
six months following notification from the State or OCTA that funds have been
authorized to proceed by the Federal Highway Administration and that the project
will be carried to completion with reasonable diligence; and
WHEREAS, the City of Seal Beach commits $500,000 of M2 Fair Share and will
provide 50% of the total project cost as match to the requested $500,000 in
OCTA RSTP funds for a total project cost estimated to be$1,000,000; and
WHEREAS, the City of Seal Beach is responsible for preparing and submitting all
necessary Caltrans-required documentation include E-76 request. City of Seal
Beach agrees to submit an E-76 Request to Caltrans District 12 by February 1 of
the fiscal year identified; and

WHEREAS, the City of Seal Beach will comply where applicable with provisions
of the California Environmental Quality Act, the National Environmental Policy
Act, the American with Disabilities Act, Federal Title VI, Disadvantaged Business
Enterprise (DBE), Buy America provision, and any other federal, state, and/or
local laws, rules and/or regulations; and
WHEREAS, the City of Seal Beach's City Council authorize the execution of any
necessary cooperative agreements between the City of Seal Beach and OCTA to
facilitate the delivery of the project.
NOW, THEREFORE, THE SEAL BEACH CITY COUNCIL DOES HEREBY
RESOLVE:
Section 1. The City Council hereby authorizes the City Manager as the official
representative of the City of Seal Beach to accept funds for the
Westminster Avenue Paving Rehabilitation ; and,
Section 2. The City Council agrees to fund its share of the project costs and
any additional costs over the identified programmed amount.

Westminster Avenue(divided arterial) runs in east-wc,,thound direction and currently has 4 lanes(2 lanes in each direction) with a
landscape median and Class-11 bike lane in each direction.The proposed project between West City Limit to Sea[ Beach Blvd. will
reconstruct failed pavement sections,cold-planing and thick overlay,replace in kind damaged curbs,gutters,driveway approaches,
pavement striping,markings and signage. Lastly, reconstruct sidewalks and curb ramps to comply ADA requirements,
