Crumby P.E., Director of Public Works SUBJECT: WESTMINSTER AVENUE BICYCLE LANE AND RESURFACING IMPROVEMENTS PROJECT CIP NO. ST1409 SUMMARY OF REQUEST: That the City Council adopt Resolution No. 6523: 1. Approving the plans and specifications for the Westminster Avenue Bicycle Lane and Resurfacing Improvements Project CIP No. ST1409; 2. Rejecting the apparent low bid from All American Asphalt on the grounds that its bid was incomplete and nonresponsive; 3. Awarding a construction contract to R.J. Noble Company in the amount of $1,462,242.50 for the Westminster Avenue Bicycle Lane and Resurfacing Improvements Project CIP No. ST1409; 4. Authorizing the City Manager to execute the contract on behalf of the City and to approve contract changes in a cumulative amount not to exceed $145,000. BACKGROUND AND ANALYSIS: The Bicycle Corridor Improvement Grant Program (BCI) is a grant that is offered the State of California and Orange County Transportation Authority (OCTA) that provides funds available for bicycle improvement projects to local agencies. Projects eligible for the BCI include bicycle facilities, trails, and safety/outreach programs. At the June 11, 2012 City Council meeting, the City Council approved a resolution approving an application for the Westminster Avenue Bicycle Lane and Agenda Item J Resurfacing project within this Call for Projects. In addition, the resolution stated that if awarded the City will commit to the required matching contribution. Based upon the specific criteria, City staff submitted an application for Westminster Avenue between Seal Beach Boulevard and Bolsa Chica Road. The Westminster Avenue Bicycle Lane and Resurfacing Improvements Project No. ST1409 (the "Project") consists of replacing and upgrading the existing 3-4 ft. wide Class-III bike route with a 6 ft. wide Class-II bike lane, reconstruction of failed sections, edge-grind/cold planning, street side resurfacing of the pavement, and strip ing/signage replacement. At the February 10, 2014 City Council meeting, the City Council authorized the City Manager to execute a Cooperative Agreement with OCTA for the Project. The 5 Year Capital Improvement Program and Pavement Management Program Report identified Westminster Avenue as a facility that will need resurfacing. This grant will combine the resurfacing funds and upgrade the existing bicycle route facility. On November 13, 2014, the City Clerk's office received four bids with the following results: ......... ........... Rank Contractor Total Bid 1 All American Asphalt $ 1,438,775.00 2 R.J. Noble Corn an $ 1,462,242 50 ... .. m ....... 3 .. _ Hardy & Harper, Inc. $ 1,590,520.00 4 Excel Paving $ 1,614,388.50 After a review of each bid package, the low bidder All American Asphalt failed to submit the Local Agency Bidder Disadvantages Business Enterprise (DBE) Commitment form with the bid. The DBE commitment form was included with the bid documents and is a requirement of the grant. Accordingly, the bid from All American Asphalt is incomplete and nonresponsive. Based upon the references, qualifications, and work experience, staff recommends selecting the 2nd low bidder R.J. Noble Company, who submitted a complete bid package, as the lowest responsive bidder at $1,462,242.50. The plans and specifications are available in the City Engineer's office for review. ENVIRONMENTAL IMPACT: The project qualifies for a Class 1 categorical exemption from the requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15301 of the State CEQA Guidelines because it consists of the maintenance and minor alteration of existing public streets. Page 2 Because federal grant funds are being used for the project, it has also been reviewed pursuant to the National Environmental Protection Act (NEPA). In February 2014, Caltrans determined that the project is qualifies for a categorical exclusion from NEPA pursuant to federal regulation 23 C.F.R § 771.117(c). LEGAL ANALYSIS: The City Attorney has reviewed the proposed resolution and construction contract and approved each as to form. FINANCIAL IMPACT: In the approved FY 2014/15 Budget, $2,000,000 of Measure M, State Gas Tax and Citywide Grants Funds were allocated for the Project. A breakdown of the financing for the project is as follows: Description Amount Construction $ 1,462,242.50 Contingency $ 145,000.00 Inspection/Material Testing $ 145,000.00 Total $ 1,752,242.50 As shown in the above chart, project financing includes allocation of an additional $145,000 for project inspection and materials testing in addition to the construction contract and the $145,000 allocated to project contingencies. Project inspection and materials testing will be implemented through a combination of existing contracts and smaller contracts that fall within the City Manager's purchasing authority. RECOMMENDATION: That the City Council adopt Resolution No. 6523:. 1. ST1409; Page 3 4.
