HomeMy WebLinkAboutPC Min 2014-11-17 City of Seal Beach - Planning Commission November 17, 2014 Chair Massa-Lavitt called the regular meeting of the Planning Commission to order at 7:00 p.m. in the City Council Chambers and led the Salute to the Flag. ROLL CALL Present: Chair Massa-Lavitt; Commissioners: Campbell, Cummings, Goldberg, Sloan Staff Present: Jim Basham, Director of Community Development Steven L. Flower, City Attorney Crystal Landavazo, Senior Planner Steven Fowler, Assistant Planner Will Chen, Staff, Community Development Department Linda Devine, City Clerk APPROVAL OF AGENDA The City Attorney pulled item 3 from the agenda due to an error in the description of the item on the agenda and indicated this item will be re-noticed for the December 1, 2014 Planning Commission meeting. Goldberg moved, second by Sloan, to approve the agenda, as amended. AYES: Campbell, Cummings, Goldberg, Massa-Lavitt, Sloan NOES: None Motion Carried ORAL COMMUNICATIONS Chair Massa-Lavitt opened oral communications and stated that those audience members present for item 3 can speak at this time and the minutes will be included in the staff report. Speaker(s): Seth Eaker, Black Marble Consulting — applicant for CUP 14-7 (Phenix Salon Suites), expressed his concerns regarding the error in the agenda and delaying the process — provided information to support the request of the conditional use permit — asked those audience members present and are in support of the CUP to stand — 7 of the 14 present stated their support; and Lisa Roden, Todd Maris, and Elizabeth Burnett spoke regarding Taco Surf, on Pacific Coast Highway, be allowed to have live amplified music. There being no other speakers, Chair Massa-Lavitt declared oral communications closed. CONSENT CALENDAR Campbell moved, second by Sloan, to approve the recommended actions on the consent calendar as presented. SCHEDULED MATTERS No items at this time. NEW BUSINESS 2. Minor Use Permit (MUP) 14-1 313 Central Avenue Applicant: Natalie Murphy Property Owner.' Erin and Natalie Murphy Request: Minor Use Permit 14-1 requesting minor alterations to a structure that is nonconforming due to density. The applicant proposes to convert a closet and portion of the kitchen into a second bathroom for the primary residence. Staff provided a brief analysis regarding the request for a minor use permit stating that the remodel lies within the parameters set in the municipal code and does not increase the number of bedrooms and does not add new square footage to the residence, it creates a second bathroom, and the applicant is the property owner that will continue to occupy the primary residence. Natalie Murphy, applicant and owner, was present to answer any questions. Campbell moved, second by Cummings, to adopt Resolution No. 14-8 approving Minor Use Permit (MUP) 14-1 to permit an interior remodel of less than 25% within the non-conforming structure. AYES: Campbell, Cummings, Goldberg, Massa-Lavitt, Sloan NOES: None Motion Carried PUBLIC HEARINGS This item was pulled from the agenda. 3. Conditional Use Permit(CUP) 14-7 13947 Seal Beach Boulevard Applicant: Seth Eaker on behalf of Phenix Salon Suites Property Owner: Burnham, USA Request: Conditional Use Permit 14-7 requesting live entertainment(two musical performers with non-amplified music) in an existing restaurant with a Type 47 on-sale alcohol license. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 14-7, approving Conditional Use Permit 14-5 with Conditions. DIRECTOR'S REPORT Discussion Item — Live Entertainment The Director of Community Development indicated that at the request of the Planning Commission, this discussion item was brought forwarded — provided the Commission the current language in the municipal code that prohibits live amplified music — stated there is a process to move forward to make any Page 3 - Planning Commission 11/17/14 changes to the municipal code. The Commissioners discussed their options to allow live music with a conditional use permit (CUP). The City Attorney clarified that any action considered would be for businesses citywide and not for a single site. Massa-Lavitt moved, second by Campbell, directing staff to begin the process to notify the City Council that the Planning Commission would like to recommend that a zone change to municipal code be considered regarding Chapter 11.4.05.010(D)2 — Standards for Specific Uses — Allowable Incidental Business Activities — Prohibited Uses. AYES:. Campbell, Cummings, Goldberg, Massa-Lavitt, Sloan NOES: None Motion Carried COMMISSION CONCERNS Commissioner Sloan inquired about the pier structure.
