February 17, 2015
Chair Sloan called the regular meeting of the Planning Commission to order at
7:00 p.m. in the City Council Chambers and led the Salute to the Flag.
ROLL CALL
Present: Chair Sloan;
Commissioners: Cummings, Machen, Campbell
Absent: Commissioner Pratt
Staff Present: Steven L. Flower, City Attorney
Crystal Landavazo, Senior Planner
Steven Fowler, Assistant Planner
Will Chen, Code Enforcement Officer
Tina Knapp, City Clerk
With no objections, Chair Sloan so ordered Commissioner Pratt be excused from
the meeting.
APPROVAL OF AGENDA
With no objections, Chair Sloan so ordered the approval of the agenda, as
presented.
ORAL COMMUNICATIONS
Chair Sloan opened oral communications. There being no speakers, Chair Sloan
declared oral communications closed.
CONSENT CALENDAR
Campbell moved, second by Cummings, to approve the recommended actions
on the consent calendar as presented.
1. Approve the Planning Commission Meeting Minutes of January 20, 2016
and December 1, 2014.
AYES: Sloan, Cummings, Campbell, Machen
NOES: None
ABSENT: Pratt Motion Carried
PUBLIC HEARINGS
2. Conditional Use Permit (CUP) 14-8 981 Pacific Coast Highway
Applicant: Larry Drum
Property Owner: Regency Center

Request: Conditional Use Permit 14-8 requesting to serve beer
and wine (Type 41 Alcohol License) in conjunction with
a proposed sandwich shop with outdoor dining area.
Recommendation: After conducting the Public Hearing, staff recommends
that the Planning Commission adopt Resolution No. 15-
4, approving Conditional Use Permit 14-8.
Steven Fowler, Assistant Planner, presented the staff report on this item and
indicated that correspondence received regarding this item was on the dais. The
Commission raised concerns regarding separation and safety of the outdoor
seating from parking lot traffic.
Chair Sloan opened the public hearing. The applicant spoke in support of staff's
recommendation and indicated that -the safety of their patrons has been greatly
considered and addressed. There were no other speakers. Chair Sloan closed
the public hearing.
Cummings moved, second by Campbell, to adopt Resolution No. 15-4, entitled
"A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION
APPROVING CONDITIONAL USE PERMIT 14-8 PERMITTING THE SERVICE
OF BEER AND WINE AND ESTABLISHMENT OF AN OUTDOOR DINING AND
SEATING AREA AT AN EXISTING RESTAURANT AT 981 PACIFIC COAST
HIGHWAY".

The City Attorney advised that the adoption of Resolution No. 15-4 approving
CUP 14-8 is the final decision of the Planning Commission. There is a 10-day
appeal period to the City Council and the appeal period begins February 18,
2015.
3. Variance (VAR) 14-1 717 Ocean Avenue
Applicant: Mark E. Zimmerman
Property Owner: Ralph E. Taylor, Trustee of the Tezel Trust
Request: Variance 14-1 requesting to allow a reduction of the
rear yard setback on a lot with a unique size and
configuration in the RHD-20 (Residential High Density—
20) zone.
Recommendation: After conducting the Public Hearing, staff recommends
that the Planning Commission adopt Resolution No.
15-5, approving Variance 14-1.
Crystal Landavazo, Senior Planner, presented the staff report on this item. Chair
Sloan opened the public hearing. The applicant spoke in support of staffs

recommendation and indicated his desire to complement the area. There were
no other speakers. Chair Sloan closed the public hearing.
Cummings moved, second by Campbell, to adopt Resolution No. 15-5, entitled
"A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION
APPROVING VARIANCE 14-1 TO A REDUCTION OF THE REQUIRED REAR
YARD SETBACK ON A LOT WITH A UNIQUE SIZE AND CONFIGURATION
WITHIN THE RHD-20 (RESIDENTIAL HIGH DENSITY-20) ZONE".

NOES: None
ABSENT: Pratt Motion Carried
The City Attorney advised that the adoption of Resolution No. 15-5 approving

DIRECTOR'S REPORT
Senior Planner Landavazo reported that the Director was out of the office this
week participating in a recruitment process for the Orange County Fire Authroity.
Landavazo also reported that Commission agenda packets will be delivered the
Wednesday prior to a meeting.
COMMISSION CONCERNS
Commissioner Campbell inquired as to the process of changing an address and
Commissioner Cummings commented on Marie Callendar's going out of
business.
ADJOURNMENT
With no objections, Chair Sloan adjourned the Planning Commission meeting at
7:35 p.m.
