HomeMy WebLinkAboutRDA Res 70-8 Not Passed .. ~ " " , -II j \, ,-:t~ HJ')\S 1 RESOLUTION NUMBER 70- A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SEA L BEA CH FINDING AND DETER- MINING THE PUBLIC INTEREST AND NECESSITY FOlt AND DIRECTING THE ACQUISITION BY EMINENT DOMAIN OF REAL PROPERTY ~1 I BE IT RESOLVED, by the Redevelopment Agency of the City of Seal Beach: Section 1. It is found and determined that the public interest and necessity re- quire the acquisition of that certain real property described hereinbelow as Parcell and Parcel 2 in fee simple absolute for the construction, use, and maintenance of streets, highways, public thoroughfares, and related public uses, Section 2. Said real property is located within the Project Boundaries of the Riverfront Redevelopment Project of the Redevelopment Agency of the City of Seal Beach, a California community redevelopment agency, and within the City of Seal Beach and County of Orange and is more particularly described as follows: Parcell 1 All that portion of that certain strip of land 100 feet in width conveyed by Bayside Land Company to Pacific Electric Rail- way Company by deed recorded on Page 8 in Book 103 of Deeds, Records of said County of Orange, included within a strip of land 60 feet in width, being 30 feet on each side of the northeasterly prolongation of the center line of Eighth Street, as said Eighth Street is shown upon map of Bay City recorded in Book 3, Page 19 of Miscellaneous Maps of said Orange County, Parcel 2 All that portion of that certain strip of land 100 feet in width conveyed by Bayside Land Company to Pacific Electric Rail- way Company by deed recorded on Page 8, in Book 103 of Deeds, Records of said County of Orange, included within a strip of land 60 feet in width, being 30 feet on each side of the northeasterly prolongation of the center line of Tenth Street, as said Tenth Street is shown upon map of Bay City recorded in Book 3, Page 19 of Miscellaneous Maps of said Orange County, Section 3. It is found and determined that said public improvement and works are planned and located in the manner which is and will be most compatible with the greatest public good and the least private injury, 1 Section 4, The legal counsel of the Redevelopment Agency of the City of Seal Beach is authorized and directed to (a) commence an action or actions in eminent domain in the name of the Redevelopment Agency of the City of Seal Beach in a proper court to acquire, in fee simple, said property described herein; (b) ex- cept and reserve from the taking such noninterferring rights to the owners as will not substantially impair the use of said lands for the construction, use and maintenance of said public improvements and works; and (c) do such further acts 1 1 I ~ " ," " . and things and take such further steps as may be necessary or convenient in connection therewith, PASSED, APPROVED and ADOPTED by the Redevelopment Agency of the City of Seal Beach at a meeting thereof held on the day of ,197 by the following vote: - AYES: NOES: MEMBERS MEMBERS A BSENT: MEMBERS ATTEST: Chalrman .I!lxecutlve Dlrector-Secretary
