BACKGROUND AND ANALYSIS: This section does not apply to this item, ENVIRONMENTAL IMPACT: There is no environmental impact related to this item, LEGAL ANALYSIS: No legal analysis is required for this item. FINANCIAL IMPACT: There is no financial impact for this item. RECOMMENDATION: That the City Council approve the minutes for the regular meeting of the City Council held on April 27, 2015. ROLL CALL Present: Mayor Deaton Council Members: Sloan, Miller, Massa-Lavitt, Varipapa City Staff: Steven L. Flower, City Attorney Jill R. CLOSED SESSION The City Attorney announced that the City Council would meet to discuss the item identified on the closed session agenda: A. CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION Government Code§54956.9(d)(2) A point has been reached where, in the opinion of the Seal Beach City Council on the advice of its legal counsel, based on existing facts and circumstances, there is a significant exposure to litigation against the City(1 case). ADJOURNMENT It was the order of the Mayor, with consent of the Council, to adjourn the meeting at 7:00 p.m. City Clerk City of Seal Beach Approved: Mayor Attest: City Clerk Seal Beach, California April 27, 2015 The City Council met in regular session at 7:00 p.m. in the City Council Chambers with Mayor Deaton calling the meeting to order and Ryan Lowe, Eagle Scout being recognized tonight, leading the Salute to the Flag. AYES: Deaton, Sloan, Miller, Massa-Lavitt, Varipapa NOES: None Motion carried PRESENTATIONS/RECOGNITIONS WAVE Awards—Seal Beach Cable Foundation, SBTV3 Robin Fort-Lincke, Station Manager "National Public Safety Dispatcher Week"—April 12—18, 2015 Recognition of Ryan Lowe, Eagle Scout Orange County Fire Authority— "Wildfire Awareness Week" — May 3 — 9, 2015 Orange County Fire Authority—Drowning Prevention Awareness Summer 2015 (May—September) CITY ATTORNEY REPORT Steven L. Flower, City Attorney The City Attorney reported that the City Council met in Closed Session prior to the regular meeting and discussed the item identified on the agenda. Direction was given to the City Attorney giving authorization to consider challenging the adequacy of the 1-405 Environmental Impact Report/Environmental Impact Study (EIR/EIS). The City Attorney also reported that Councilmember Varipapa recused himself from this item. No other action was taken. ORAL COMMUNICATIONS Mayor Deaton opened oral communications. Speakers: Carla Watson reported that the Centennial golf tournament is sold out and thanked individuals for their assistance in planning the tournament; Elizabeth Kane thanked Robin Fort- Lincke for chronicling the Run Seal Beach event; an individual from Leisure World expressed appreciation for the Expo event held over the weekend and indicated that a vote would be forthcoming on a location for Centennial bricks in Page 2—City Council 04/27/15 Leisure World and the farmers' market; an individual spoke about electric bicycles and their use on bike paths; Les Stark spoke about the work he would like to do on his home and the direction he was given by the City that the work was not allowed; Brad Luke expressed frustration by activities he has seen on the beach; Joyce Ross Parque spoke about the sand nourishment project and transparency in government; and 15 individuals spoke about the 1-405 Improvement Project, specifically about the impact to College Park East and the sound wall. There being no other speakers; Mayor Deaton declared oral communications closed. CITY MANAGER REPORT Jill R. Ingram, City Manager No report at this time. COUNCIL COMMENTS Mayor Deaton indicated that the issues related to the 1-405 Improvement Project are of the utmost importance to the City Council and they are working for solutions for the Seal Beach community. Councilmember Miller made comments regarding the 1-405 Improvement Project related to toll roads and the Environmental Impact Report/Environmental Impact Study. Councilmember Massa-Lavitt indicated that she supports keeping the sound wall and understands how pollution and noise will increase depending on what is done with the sound wall. Massa-Lavitt also expressed appreciation for the Expo that was held in Leisure World over the weekend and reported that it was a great event and was well-attended. Mayor Pro Tern Sloan shared concerns regarding the sound wall issue. Councilmember Varipapa thanked Councilmember Miller for his commitment to the OCTA Board, reported that the Expo at Leisure World was a great event, as was the Car Show. Mayor Deaton asked the City Manager for information regarding the sand nourishment project, to which the City Manager asked the Director of Public Works to respond. The Director of Public Works reported that the sand originates from the Santa Ana River, which is used to nourish all beaches in Orange County. The sand is tested for chemical composition, grain size, and to make sure it is free of contaminants before being placed on the beach. Many regulatory agencies are involved and must approve the efforts. Mayor Deaton continued her comments by reporting what a great event the Expo at Leisure World was and that the Car Show was one of the best ever. She also indicated that the Mayor's pick for the Car Show was a 1946 Woody. COUNCIL ITEMS No items at this time. CONSENT CALENDAR The City Manager reported that the minutes of the April 13, 2015 meeting were amended to clarify the vote on Item J. Massa-Lavitt moved, second by Sloan, to approve recommended actions on the consent calendar, as amended, and with the separate vote indicated for Item G. AYES: Deaton, Sloan, Miller, Massa-Lavitt, Varipapa NOES: None Motion carried A. Minutes of the Regular City Council meeting of April 13, 2015 —Approve by minute order. B. Demands on City Treasury—Ratification. Monthly Investment Report—March 2015—Receive and file, D, Appointments to the Seal Beach Audit Committee — Approve Resolution No. 6551 confirming the appointments to the Seal Beach Audit Committee. Page 3-City Council 04/27/15 E, Emergency Repair of West-End Storm Water Pump Station — Notice of Completion —Adopt Resolution No. 6552 accepting the emergency repair of the West-End Storm Water Pump Station by Southern Contracting Company, Inc. in the amount of $84,825; and approving Budget Amendment BA 15-10-02 allocating $84,825 for the replacement of a variable frequency drive at the City's West-End Storm Water Pump Station; and directing the City Clerk to file a "Notice of Completion" with the Orange County Clerk-Recorder within ten (10) days from the date of acceptance and to release retention in 35 days. F, Amendment to the Waste Disposal Agreement with the County of Orange —Adopt Resolution No. 6553 approving an Amendment to the 2009 Waste Disposal Agreement(WDA)with the County of Orange and authorizing the City Manager to execute the Agreement. G. City Clerk Appointment — Second reading of Ordinance No. 1645, which would vest the power to appoint the City Clerk in the City Manager.
