Ingram, City Manager FROM: Patrick Gallegos, Assistant City Manager SUBJECT:, ADOPTION OF A RESOLUTION SUPPORTING SENATE CONSTITUTIONAL AMENDMENT 2 TO PROHIBIT BANNING THE U.S. FLAG ON STATE- FUNDED COLLEGE CAMPUSES IN CALIFORNIA SUMMARY OF REQUEST: That the City Council adopt a resolution to support Senate Constitutional Amendment 2 (SCA 2), introduced by State Senator Janet Nguyen, to prohibit banning the U.S. flag on state-funded college campuses in California. BACKGROUND AND ANALYSIS: In March, the University of California at Irvine's Legislative Student Council passed a resolution that banned the display of the American flag, citing potential negative interpretations of the flag. While the Executive Cabinet of the Associated Students of UC Irvine ultimately vetoed the flag ban, this incident has drawn attention to a potential problem that could occur at another campus in the future. To ensure the American flag is not banned from display at another campus, State Senator Janet Nguyen introduced SCA 2, which prohibits the ban of the U.S. flag on any state-funded campus of higher education. A constitutional amendment is needed because the UC system is a constitutionally independent system and can ignore statutory direction from the legislature. For more than 200 years, millions of brave service men and women have made great sacrifices so that the American flag can be flown with dignity and pride. Today, thousands more have left families and jobs behind to defend the principles of freedom and democracy. Our Veterans deserve that every effort be made to ensure the American flag is proudly displayed at public universities and colleges throughout California. Supporting SCA 2 is consistent with the City's ongoing efforts to honor our Veterans. Agenda Item F ENVIRONMENTAL IMPACT: There is no Environment Impact related to this item. LEGAL ANALYSIS: The City Attorney has reviewed and approved as to form. FINANCIAL IMPACT: There is no financial impact. Resolution No. 6558 Page 2 RESOLUTION NUMBER 6558 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH IN SUPPORT OF SENATE CONSTITUTIONAL AMENDMENT 2 TO PROHIBIT BANNING THE U.S. FLAG ON STATE-FUNDED COLLEGE CAMPUSES IN CALIFORNIA WHEREAS, the City of Seal Beach proudly displays and supports the honorable flag of the United States of America; and WHEREAS, for than 200 years brave men and women have made great sacrifices to protect the principles of freedom and democracy which the flag of the United States of America represents; and WHEREAS, in an effort to ensure that the flag of the United States is proudly displayed at campuses throughout California, Senate Constitutional Amendment 2 has been introduced; and WHEREAS, Senate Constitutional Amendment 2, amends the Constitution of the State of California to prohibit State-funded Post-Secondary Educational Institutions from banning the display of the American flag; and NOW, THEREFORE IT BE RESOLVED THAT THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council of the City of Seal Beach, State of California, supports Senate Constitutional Amendment 2 and urges the California State Legislature to pass this legislation in protection of the American Flag. Section 2. The Clerk of the City of Seal Beach is directed to send this resolution to the Honorable Members of the California State Senate and the California Assembly representing the City of Seal Beach; and Section 3. The resolution shall take effect immediately upon its adoption by the City Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution.
