BACKGROUND AND ANALYSIS: This section does not apply to this item, ENVIRONMENTAL IMPACT: There is no environmental impact related to this item. LEGAL ANALYSIS: No legal analysis is required for this item. FINANCIAL IMPACT: There is no financial impact for this item. Ingram, City Ma er Agenda Item A Seal Beach, California May 11, 2015 Mayor Deaton called the special meeting of the Seal Beach City Council to order at 4:00 p.m. in the City Hall Conference Room. ROLL CALL Present: Mayor Deaton Council Members: Sloan, Miller, Massa-Lavitt Absent: Council Member Varipapa (arrived at 5:15 p.m.) City Staff: Craig A. Steele, Interim City Attorney Jill R. Ingram, City Manager Patrick Gallegos,Assistant City Manager Sean P. Crumby, Director of Public Works Tina Knapp, City Clerk ORAL COMMUNICATIONS There were no speakers. CLOSED SESSION The City Attorney announced that Councilmember Varipapa would be recusing himself from discussion of Item A on the agenda due to his employer. The City Attorney announced that the City Council would meet to discuss Item A identified on the closed session agenda: A. CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION Government Code§54956.9(d)(2) A point has been reached where, in the opinion of the Seal Beach City Council on the advice of its legal counsel, based on existing facts and circumstances, there is a significant exposure to litigation against the City(1 case). Councilmember Varipapa arrived at 5:15 p.m. RECESS The City Attorney announced that the City Council would meet to discuss Item B identified on the closed session agenda. Councilmember Varipapa joined Closed Session for the discussion of this item. B. AYES: Deaton, Sloan, Miller, Massa-Lavitt, Varipapa NOES: None Motion carried PRESENTATIONS/RECOGNITIONS American Cancer Society Relay For Life of Los Alamitos/Seal Beach National Public Works Week/May 17—23, 2015 Peace Officers' Memorial Week/May 11 —15, 2015 Seal Beach/New Zealand Exchange Lifeguard—Vince Fiamengo Mr. Fiamengo was ill and unable to attend the meeting to make this presentation. CITY ATTORNEY REPORT Craig A. Steele, Interim City Attorney Mayor Deaton introduced Interim City Attorney Craig Steele. The City Attorney reported that the City Council met in Closed Session prior to the regular meeting and discussed the items identified on the agenda. Authorization was given to the City Attorney to prepare litigation challenging the adequacy of the 1-405 Environmental Impact Report/Environmental Impact Study (EIR/EIS). The City Attorney also reported that Councilmember Varipapa recused himself from this item. The City Council discussed Item B on the Closed Session agenda. No other action was taken. ORAL COMMUNICATIONS Mayor Deaton opened oral communications. Speakers: Scott Weir announced the Lions Club Beepball event being held on May 16t". Rosie Richie reported on the various events and volunteer activities of the Miss Seal Beach pageants organization. Bill Ayres spoke in support of agenda Item G and expressed concerns regarding noise associated with Item F. Gina Phillips inquired as to the status of the community gardens. Joyce Parque spoke about the bike path. Mike Buhbe offered support of Item G. Scott Levitt expressed appreciation for all of the Car Show efforts and spoke in support of Item F. Robert Kidd indicated he feels the transient population is increasing in Old Town. There being no other speakers; Mayor Deaton declared oral communications closed. COUNCIL COMMENTS Councilmember Massa-Lavitt welcomed the young people in attendance at the meeting. Councilmember Varipapa expressed appreciation for a successful meeting regarding the aquatics center over the weekend. Mayor Deaton reported that the recent Public Safety Awards Luncheon was a great event and reiterated the importance of heeding the advice of lifeguards when on the beach, and other public safety personnel when in their jurisdictions. Mayor Deaton also reported that the Shoreline recreation guide would be delivered throughout this year, the Centennial year. COUNCIL ITEMS No items at this time. CONSENT CALENDAR Sloan moved, second by Massa-Lavitt, to approve recommended actions on the consent calendar, as presented. Demands on City Treasury—Ratification. C. 2014 Environmental Cleanup Program Project No. SD1501 — Notice of Completion — Adopt Resolution No. 6554 accepting 2014 Environmental Cleanup Program Project No. SD1501 by United Storm Water, Inc. in the amount of $8,538.23 and direct the City Clerk to file a "Notice of Completion" with the Orange County Clerk-Recorder within ten (10) days from the date of acceptance and to release retention in 35 days. D. Agreement to Transfer Property or Funds for FY 2015 Homeland Security Grant Program ("HSGP") Purposes—Adopt Resolution No. 6555 allowing the City of Seal Beach to enter into an Agreement to Transfer Property or Funds for 2014 Homeland Security Grant Program Purposes ("Agreement") which will transfer equipment, technology, or services from the County of Orange ("County") to the City to enhance county-wide emergency preparedness. The City Manager will be authorized to execute any actions necessary for the purpose of obtaining federal financial assistance provided by the Department of Homeland Security ("DHS")/Federal Emergency Management Agency ("FEMA") and sub- granted through the State of California, California Governor's Office of Emergency Services and the County on behalf of the City of Seal Beach. UNFINISHED/CONTINUED BUSINESS ITEM E/WATER CONSERVATION UPDATE The Director of Public Works Sean Crumby provided the staff report and presentation for this item. Mr. Crumby introduced the water education consultants who were in attendance at the meeting. Page 3-City Council 05/11/15 NEW BUSINESS ITEM F / RFOFI IST TO AMEND THE SEAL REACH MUNICIPAL CODE_ w �,> PERTAINING TO AMPLIFIED ENTERTAINMENT The Director of Community Development Jim Basham provided the staff report for this item. Mr. Basham reported that amplified entertainment is currently prohibited under the City's Municipal Code. Deaton moved, second by Massa-Lavitt, to direct staff to prepare a proposed permitting process for City Council review and approval to allow amplified entertainment subject to certain regulations, which may require addressing how to assess noise requirements and should include remedies to violation of this matter other than closing the business. AYES: Deaton, Sloan, Miller, Massa-Lavitt, Varipapa NOES: None Motion carried Mr. Basham confirmed that this matter will first go to Planning Commission for review and then to the City Council for approval at a later date. ITFM C, / RF=OI1FST TO AMFNn THE RFAI RFAQH MUNICIPAI r...OnF PERTAINING TO RESIDENT DEVELOPMENT STANDARDS The Director of Community Development Jim Basham provided the staff report for this item. Mr. Basham reported that at some point in the recent past, requirements for ceiling height decreased from 7' 6" to 7', thus allowing three- story residences to be constructed in the RHD-20 zone in Old Town. Deaton moved, second by Sloan, to direct staff to initiate an amendment to the Zoning Ordinance to amend residential development standards to clarify that residential construction in the RHD-20 zone in Old Town is limited to two stories. AYES: Deaton, Sloan, Miller, Massa-Lavitt, Varipapa NOES: None Motion carried Mr. Basham confirmed that this matter will first go to Planning Commission for review and then to the City Council for approval at a later date. ADJOURNMENT With no objections, Mayor Deaton adjourned the meeting at 8:00 p.m. to Tuesday, May 26, 2015 at 5:30 p.m. to meet in closed session, if deemed necessary.
