SUBJECT: NOTICE OF COMPLETION FOR EMERGENCY BEACH
NOURISHMENT PROJECT NO. EM1502
SUMMARY OF REQUEST:
That the City Council adopt Resolution No. 6570:
1. Closing of a local emergency as issued on September 2, 2014 and ratified
by City Council on September 8, 2014;
2. Accepting the Emergency Beach Nourishment Project No. EM1502 by
Post Earthworks Constructors in the total amount of $565,000;
3. Direct the City Clerk to file a "Notice of Completion" with the Orange
County Clerk-Recorder within ten (10) days from the date of acceptance
and to release retention in 35 days; and
4. Approve Budget Amendment No. 15-12-01 transferring General Funds in
the amount of$737,100 to the Tidelands Account.
BACKGROUND AND ANALYSIS:
Hurricane Marie
On August 25, 2014, the City of Seal Beach experienced a large summer storm
event caused by Hurricane Marie that caused water to flow onto the public
boardwalk and public streets. Emergency measures were immediately
undertaken through the duration of the storm event. This storm event caused an
estimated loss of between 10,000 — 20,000 cubic yards of sand from the City's
beach by action of the waves pulling sand out into the Ocean; most
predominantly at the northern edge of Seal Beach at the mouth of the San
Gabriel River.
In response to Hurricane Marie on September 2, 2014, the City Manager issued
a proclamation declaring a local emergency, which was ratified by City Council
Agenda Item i
action on September 8, 2014. This action allowed for immediate action to repair
damage and to help avert potential future damage to public property from
occurring. Having adequate beach sand is paramount to protecting public
streets, the public boardwalk, and private homes and businesses.
On August 28, 2014, City staff identified an opportunity to obtain compatible
beach quality sand that could be used for immediate nourishment of the City's
beaches in response to the emergency caused by Hurricane Marie. The County
of Orange was in the process of dredging the Santa Ana River by order of FEMA.
This sand went through extensive testing for grain size compatibility and
chemical composition, and was found to be beach compatible for Seal Beach.
Those results have been reviewed by the City's coastal engineers' (Moffatt and
Nichol), and the United States Environmental Protection Agency. The County of
Orange agreed to sift or filter the sand and deliver to the City at no cost.
The City was able to immediately contract with the City's current berm contractor,
Post Brothers Construction, to receive this sand and place it on East Beach at
the narrowest location where Hurricane Marie caused the greatest erosion. That
work occurred in late 2014 and delivered approximately 32,000 cubic yards of
beach compatible sand.
The County of Orange continued their dredging of the Santa Ana River during the
winter of 2014/2015 and had an additional 52,000 cubic yards of filtered, beach
compatible sand available to the City. The County agreed to continue to provide
the material, sifted, and delivered, at no cost to the City.
On January 26, 2015, the City Council awarded a contract to Post Earthworks
Constructors to fund the second phase of the Emergency Beach Nourishment
Project in the amount of$402,100.
The project also required preparation and submission of necessary regulatory
agency permits from the California Coastal Commission, Army Corps of
Engineers, and the Regional Water Quality Control Board. Moffatt and Nichol
was hired to provide these services to the City at a fee off$60,000.
Beginning March 16, 2015, a second phase of sand delivery brought the total
amount of sand to over 80,000 cubic yards. During this phase of construction the
Navy required security on the beach. The Marine Safety Department provided
that security through the duration of the project. Overtime hours for the Marine
Safety Department are charged to this project.
During the project, the Seal Beach Naval Weapons Station partnered with the
City through this emergency nourishment and allowed access through the Navy
Base for delivery of the sand. This second phase saw almost 5,000 truckloads of
sand delivered to the beach which amounted to 52,000 cubic yards of sand.
Without access through the Navy Base, the delivery of the sand would have had
a large impact to the public.

In sum, the full cost to receive the full 84,000 cubic yards of sand, complete with
placement, and additional permitting on an emergency basis was $680,000
($8.10/cubic yard of sand). This cost is significantly lower than past beach
nourishment efforts.

*This represents estimated cost if the City chooses to partner with the next Corps
Nourishment project.
The project is now complete to the satisfaction of the City Engineer. The project
was inspected and it meets all standards and requirements within the project
specifications. It is required to formally accept the project and file a notice of
completion with the Orange County Clerk.
ENVIRONMENTAL IMPACT:
The County of Orange prepared environmental analysis to comply with the
California Environmental Quality Act (CEQA) in regards to excavation and
transportation of sand. The City's portion of the project is exempt from CEQA
pursuant to Section 15629 of the State CEQA Guidelines.
LEGAL ANALYSIS:
The City Attorney has reviewed and approved it as to form.
FINANCIAL IMPACT:
On January 26, 2015, City Council approved a budget amendment allocating
General Funds in the amount of $737,100 to cover all costs for the project. The
following is a breakdown of the costs incurred for this project:

With the cost of the sand and transportation being funded by the County of
Orange, the total cost of the project is $680,000.

A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
DECLARING WORK TO BE COMPLETED PER CONTRACT
DOCUMENTS FOR THE EMERGENCY BEACH NOURISHMENT
PROJECT NO. EM1502 AND APPROVING BUDGET
AMENDMENT NO 15-12-01 TO TRANSFER$737,100 FROM THE
GENERAL FUND TO THE TIDELANDS FUND
WHEREAS, conditions of disaster or of extreme peril to the safety of persons
and property had arisen within the City, caused by flooding and ocean tides
commencing on or about August 26, 2014;
WHEREAS, On September 2, 2014, at which time the City Council was not in
session, the City Manager, acting as the Director of Emergency Services,
proclaimed and declared the existence of a local emergency throughout the City;
WHEREAS, On September 8, 2014, The City Council ratified and extended the
City Manager's proclamation of a local emergency;
WHEREAS, on January 26, 2015 the City of Seal Beach entered into a contract
with Post Earthworks Constructors in the amount of$402,100; and
WHEREAS, the Deputy Director of Public Works/City Engineer has determined
that the work has been substantially completed in accordance with the contract
documents.
NOW, THEREFORE, THE SEAL BEACH CITY COUNCIL DOES HEREBY
RESOLVE:
Section 1 The City Council hereby terminates the proclamation of a local
emergency as ratified on September 8, 2014.
Section 2. That the work required to be performed by Post Earthworks
Constructors has been completed and accepted.
Section 2. That the total cost of amount to be paid to Post Earthworks
Constructors is$565,000 for the work performed.
Section 3. That a "Notice of Completion" be filed on behalf of the City in the
Office of the Orange County Recorder within 10 days of the date of
this resolution and release retention in 35 days.

transferring General Funds in the amount of $737,100 from the
General Fund to the Tidelands Fund.
