A RESOLUTION OF THE REDEVELOPMENT AGENCY
OF THE CITY OF SEAL BEACH ASCERTAINING THE
GENERAL PREVAILING RATE OF PER DIEM WAGES
AND THE GENERAL PREVAILING RATE FOR HOLIDAY
AND OVERTIME WORK TO BE PAID ON PUBLIC WORKS
PROJECTS WITH THE AGENCY. (1974-75)
WHEREAS, the Redevelopment Agency of the City of Seal Beach intends
to commence several public works projects during the fiscal year beginning
July 1, 1974 and ending June 30, 1975; and
WHEREAS, pursuant to the provisions of Section 1773 of the Labor Code of
the State of California, as amended by Chapter 785 of the 1971 Session of the
State Legislature, it is necessary that the Redevelopment Agency of the City
of Seal Beach ascertain and determine the general prevailing rate of per
diem wages and the general prevailing rate for holiday and overtime work
in the locality in which public work is to be performed for each craft,
classification or type of workman needed to execute the public works contract;
and
WHEREAS, said Agency has received reports ascertaining said general
rate of per diem wages and for holiday and overtime work established by
collective bargaining agreements and such rates as may have been predetermined
for federal public works within the locality and in the nearest labor market
area; and )

NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY 0 SEAL BEACH DOES
HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. The Redevelopment Agency of the City of Seal Beach does
hereby ascertain and fix the general prevailing rate of per diem wages
and the general prevailing rate for holiday and overtime work in the locality
for each craft, classification or type of workman needed to execute any
public works contract as follows, and in accordance with the schedule attached
hereto and made a part hereof as though set forth in full. In addition, the
Redevelopment Agency does further ascertain and fix the following:
(a) Any classification omitted herein shall be paid not less than
$5.045 per hour.
(b) Per diem wages shall be deemed to include employer payments for
health and welfare, pension, vacations, and similar purposes.
(c) All public works contracts shall include in the specifications a
requirement for the payment of travel and subsistence payments to
each workman needed to execute the work, as such travel and subsistence
payments are defined in any applicable collective bargaining agreement
on file with the Department of Industrial Relations in accordance
with the provisions of Section 1773.8 of the Labor Code.
(d) In accordance with the provisions of Section 1777,5 of the Labor Code,
properly indentured apprentices may be employed on a public works
project, and the provisions of Section 1777.5 shall be complied with
by the contractor or any subcontractor.
(e) No qualified employee shall be refused acceptance as an indentured
apprentice or any employment on any public works project solely on
the ground of race, creed, national origin or ancestry, or religion
of any such employee.

(f) Eight hours labor constitutes 'a legal day's work in all cases, and
the time of service of any wor,kman employed upon a public works
project is limited and restricted to eight (8) hours during anyone
calendar day, and forty (40) hours during anyone calendar week;
except that work in excess of the foregoing shall be permitted upon
compensation for all hours worked in excess of eight (8) hours per
day at not less than one and one-half (l~) times the basic rate of
pay.
, (g) The basic rates of pay hereby established are based upon a working
day of eight (8) hours, being proportionately applicable to eight
(8) hours or less employment in anyone calendar day. Holiday,
Sunday, and overtime employment is usually not permitted but if allowed,
wages shall be one and one-half (l~) times the basic per diem rate.
Holidays as used herein include the following seven legal holidays,
to wit: New Year's Day, Memorial Day, Fourth of July, Labor Day,
Veteran's Day, Thanksgiving Day, and Christmas. Where any work is
required in case of an extraordinary emergency caused by fire, flood
or danger of life and property, and for time worked on Sundays and
the aforementioned holidays, not less than one and one-half (l~)
times the basic per diem rate shall be paid.
(h) Any contractor to whom a public works contract is awarded, and any
subcontractor under him, shall also otherwise comply with the provision
of Part 7 of Division 2 of the Labor Code of the State of California,
as the same are applicable to the foregoing,
SECTION 2. This Resolution, and any amendment thereto, is hereby made a
part of any public works contract to be executed by the Redevelopment Agency
of the City of'Seal Beach and shall be included in the call for bids and in the
bid specifications. In lieu of specifying the prevailing rate of per diem wages
in the call for bids, the Agency hereby authorizes and directs that copies of
this Resolution and per diem wages schedule shall be maintained on file in
the office of the City Clerk located in the City Administration Building of
the City of Seal Beach, 211 Eighth Street, Seal Beach, California, 90740, and
shall be made available to any interested party on request. A copy of this
Resolution and the per diem wage schedule attached shall be incorporated in the
public works contract by reference or otherwise, and a copy of this Resolution
and the per diem wage schedule shall be delivered to the successful contractor
or contactors for posting on the job site. The call for bids shall incorporate
this Resolution by reference,
SECTION 3. The City Clerk is authorized and directed to cause a copy of
this Resolution and the per diem wage schedule attached hereto to be posted in
the four (4) specified public places as provided by Ordinance and published in
a n~aper of general circulation within the City at least once, on or before

SECTION 4. The per diem rate herein set forth shall be periodically
reviewed by the Agency, and this Resolution shall be amended from time to
time indicating any change in such general prevailing rate of per diem wage,
with the date of adoption of said Resolution set forth in the title of any
amended Resolution. In the event of any amendment to the per diem prevailing
wage rate during the course of the year, the Agency shall specify the change
in the first call for bids made by it hereafter,
SECTION 5. The City Clerk is directed to forward a certified copy of this
Resolution with the per diem rate schedule attached hereto, as well as any
subsequent amendment of this resolution, to the State Director of Industrial
Relations in accordance with the provisions of Section 1773.3 of the Labor Code
of the State of California.

WAGE SCALES FOR THE SIX BASIC TRADES
The wage rates listed below are in accordance with the terms of the Southern
California Master Labor Agreement for the Construction Industry and cover the
following counties: Los Angeles. Orange. Riverside. San Bernardino. Imperial.
Santa Barbara. San Luis Obispo. Kern. Inyo and Mono.
ADDITIONAL COST ITEMS: For Subsistence Allowance. Transportation and Travel
Time Allowance. Overtime. Apprentice Program Contributions. Industry Promotional
Funds. Administrative Funds. Cash Bond Deposits. etc.. contact the Local Union or
its District Council having jurisdiction.
