RESOLUTION NO. j1~ ~ A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SEAL BEACH ESTABLISHING PROCEDURES FOR PREPARATION OF ENVIRONMENTAL IMPACT REPORTS WHEREAS, the Redevelopment Agency has established guidelines for the implementation of the California Environmental Quality Act of 1970; and WHEREAS, the Agency has established a list of consultants who are qualified to prepare Environmental Impact Reports for the Redevelopment Agency; and WHEREAS, the Agency hereby establishes procedures for preparation of Environmental Impact Reports. NOW, THEREFORE, BE IT RESOLVED that the Redevelopment Agency of the City of Seal Beach does hereby establish the following procedures for preparation of Environmental Impact Reports: 1. The criteria and procedures utilized in preparation, review and consideration of environmental impact reports as required by the Environmental Quality Act of 1970 (Public Resources Code Section 21000 et seq.) shall be as specified by resolution of the Redevelopment Agency of the City of Seal Beach. No person shall perform any activity requiring an environmental impact report without first complying with the provisions of the resolution or resolutions adopted by the Redevelopment Agency; and 2. Prior to a public hearing to consider an environmental impact report for a project proposed by other than the local agency, a fee of Fifty Dollars ($50.00) shall be paid by the applicant. This fee will be used to help offset the cost of the public hearing; and 3. A deposit, the amount of which will be determined by the Director of Planning, shall be made at the time the application for a project requiring an environmental impact report is filed. The deposit shall be in an amount necessary to cover the Agency's estimated costs of preparing and eva1uatin9 the environmental impact report. The deposit shall not be less than $250.00 and in no case exceed the sum of $10,000.00. When the Agency's costs in the preparation or the evaluation of the environmental impact report exceed the amount of the deposit the applicant shall pay the difference prior to the issuance of any'permits or other entitlements from the Agency. When the Agency's costs in the preparation and evaluation of the environmental impact report are less than the amount of the deposit the Agency shall refund the balance of the deposit to the applicant; and 4. Charges to cover the expense of compilation, analysis and review of environmental factors required in the preparation and evaluation of an environmental impact report for a project proposed by other than the local agency shall be paid by the app1ican~ for services in accordance with the following schedule: (1) (2) (3) Consultants Administrative Personnel Clerical Personnel Actual cost to the City $20.00 per hour $10.00 per hour PASSED, APPROVED AND ADOPTED by the Redevelopment Agency' of the City. of Seal Beach, California, at a meeting thereof held on the ~";lI..l day of 7htVrAJ.../ , 1975, by the following vote: ~ _' 'c. .
