Conditional Use Permit 15-6 215 Seal Beach Boulevard GENERAL PLAN DESIGNATION: COMMERCIAL—SERVICE ZONE: LC-RMD (LIMITED COMMERCIAL RESIDENTIAL MEDIUM DENSITY) SITE DESCRIPTION: Assessor's Parcel Number: 199-062-11 Lot Area: 2,587 sq. ft. Building Area: 2,350 sq. ft. Surrounding Properties: North: LC-RMD South:LC-RMD East: MIL (Military) West: RHD-20 (Residential High Density) ENVIRONMENTAL ASSESSMENT: This project is determined to be a Class 1 (Existing Facilities) Categorical Exemption pursuant to Section 15301 of the Guidelines for the California Environmental Quality Act (Public Resources Code Section 21000 et seq.)for the permitting of a modification to an existing use and alteration to an existing restroom where only minimal modifications and permits are required. LEGAL NOTIFICATION: The legal notice of this hearing was published in the Seal Beach Sun Newspaper on July 9, 2015 and mailed to property owners and occupants within a 500' radius of the subject property on July 9, 2015, with affidavits of publishing and mailing on file. VICINITY MAP- AERIAL MAP: C i t y f Seal Beach A P-1 Page 2 of 4 Conditional Use Permit 15-6 215 Seal Beach Boulevard ANALYSIS: Applicants Seretta Fielding and Jim Saunders have submitted a Conditional Use Permit (CUP) application to allow an existing preschool located at 215 Seal Beach Boulevard to increase the number of preschool students from 15 to 20 and alter an interior wall to provide a second bathroom stall. The subject site is developed with a two sto'ry building consisting of a second floor residential unit and first floor commercial preschool located on the west side of Seal Beach Boulevard, north of Central Ave. The site is surrounded by commercial uses to the north, residential uses to the south and west, and! the Naval Weapons Station to the east across Seal Beach Boulevard. Applicant Seretta Fielding is the tenant of the second floor residential unit and the owner/operator of the preschool on the first floor.The existing preschool currently operates Monday through Friday from 7:00 a.m. to 6:00 p.m. and cares for a maximum of 15 preschool students, ages 2 to 6. The preschool operates with two teachers, in accordance with state requirements of providing one teacher for every 12 children. A green Curb is located on Seal Beach Boulevard, directly in front of the preschool entrance,and is utilized as a drop off and pick up area for the preschool. The play area is located at th4 rear of the property and is enclosed with a solid vinyl fence. The preschool is considered to be a nonconforming use because it was originally established at this location in 2007 when day care centers were permitted without a CUP and the property does not have a garage. The 2010 Zoning Code update adopted new regulations for the operation and approval of Child Day Care Centers (SSMC §11.4.05.045.C). The new regulations include several provisions such as a Minimum lot size of 7,500 sq. ft., a designated drop off/pick up area, a solid fence separating the play area from residential uses, one parking space for each teacher, as well as compliance with noise requirements. The preschool on the subject site has operated and maintained a business license since its original establishment and has thus maintained its status as a nonconforming use. The Seal Beach Municipal Code Section 11.4.40.035.0 permits changes, substitutions or expansions of nonconforming uses provided the structure conforms to the requirements of the California Building Code and any structural expansion meets the requirements of the Zoning Code and California Building Code. The subject site does not conform the lot size or parking requirements set by the new code regulations but the use has operated in its current location for 8 years without resulting in complaints to the City, Tenant improvements were made to the building in 2009 to bring the building into conformance with California Building Codes. The applicant is requesting approval to increase the number of students from 15 to 20 without increasing the number of teachers because the state requires only one teacher for every 12 students. The parking nonconformity is not impacted because no additional teachers will be needed for the requested change so no additional parking spaces are required. No additions or significant alterations are needed to the building, property or operations to accommodate this request. The only alteration required as part of this request is the need for an additional restroorn stall. The state requires one stall for every 15 students,so the applicant is requesting approval to alter an existing wall to accommodate a second bathroom stall. The proposed reconfiguration of the restroom will also include providing ADA compliance. The existing preschool on the subject site is permitted to continue operating by caring for 15 students and not making any alterations to the existing building. The request to increase Page 3 of 4 Conditional Use Permit 15-6 215 Seal Beach Boulevard the number of students will not cause an increase in parking demand because the number of teachers will not increase and, with approval of the interior wall alteration,williresult in an ADA compliant restroom which will bring the building more into conformity with the California Building Code.The Seal Beach Municipal Code{SSMC§11.4.40.035.0)permits changes to nonconforming structures provided the California Building Code is met. The preschool proposes to maintain its existing operations. CONCLUSION: After conducting the public hearing and receiving public testimony, staff recommends that the Planning Commission adopt the attached Resolution No. 15-19 to approve CUP 15-6 to increase the number of preschool students from 15 to 20 in an existing preschool and relocate an interior wall to install a second bathroom stall. Seretta Fielding and Jim Saunders submitted an application to the City of Seal Beach Department of Community Development for Conditional Use Permit (CUP) 15-6 to increase the number of preschool children from 15 to 20 in an existing preschool and relocate an interior wall to install a second bathroom stall at 215 Seal Beach Boulevard (the "subject property"), which is located in the LC-RM,D (Limited Commercial — Residential Medium Density) Zone. Section 2. This project is determined to be a Class 1 (Existingii Facilities) Categorical Exemption pursuant to Section 15301 of the Guidelines for the California Environmental Quality Act (Public Resources Code Section 21000 et se q.) for the permitting of a modification to an existing use and alteration to an existing restroom where only minimal modifications and permits are required. Section 3. A duly noticed public hearing was held before the Planning Commission on July 20, 2015 to consider the application for CUP 15-6. At the public hearing, the Planning Commission received and considered all evidence 'presented, both written and oral, regarding the subject application. The record of the public hearing indicates the following: A. On June 26, 2015, the applicants submitted an applicaltion to the Community Development Department for Conditional Use Permit 15-6 to increase the number of preschool students from 15 to 20 at an existing preschool and alter an interior wall to accommodate a second bathroom stall. B. The subject site is located on the west side of Seal Beach Boulevard, north of Electric Avenue. The subject site is surrounded by commercial uses to the north, residential uses to the south and west, with military use across Seal Beach Boulevard to the east. The subject property is located in the LC-RMD (Limited Commercial — Residential Medium Density) zone. C. The subject site is a 2,587 square-foot parcel developed with a two- story 2,350 square foot mixed use building consisting of a second floor residential unit and commercial preschool on the ground floor. The subject site is considered nonconforming because it does not have a garage and the preschool began operation at time when daycares and preschools did not require a Conditional Use Permit. Page 1 of 6 Resolution No. 15-19 215 Seal Beach Blvd D. The Seal Beach Municipal Code (SBMC 11.4.40.035.C) permits changes, substitutions or expansions of nonconforming uses provided the structure conforms to the requirements of the California Building Code and any, structural expansion meets the requirements of the Zoning Code and California Building Code. E. The proposal is to continue the existing preschool, increase the number of preschool students from 15 to 20 and alter an interior wall to accommodate a second bathroom stall. The preschool proposes to maintain all existing business operations. Section 4. Based upon the facts contained in the record, including those stated in the preceding Section of this Resolution and pursuant to Chapter 111.5.20 of the Code of the City of Seal Beach, the Planning Commission makes the following findings: A. The proposed alteration is consistent with the General Plan. The General Plan specifies that the Limited Commercial Land Use designation encourages ncourages a mixture of residential and light commercial on Seal Beach Boulevard. The subject site is consistent with this commercial designation because the ground floor will 'continue to serve as a preschool and the second floor residential unit will continue to be the residence of the applicant. The proposed changes will not alter the existing use or operations on the subject site. The proposed alteration of one interior wall to accommodate the addition of a second bathroom stall will not alter the use on the site and will comply with all applicable California Building Codes. B. The proposed alteration complies with applicable provisions of the Municipal Code, The Municipal Code {SSMC 11.4.40.035.C) permits'! changes, substitutions or expansions of nonconforming uses provided the structure conforms to the requirements of the California Building Code and any structural expansion meets the requirements of the Zoning Code and California Building Code. The: proposed changes to the nonconforming site will be compliant with all applicable California Building Codes and will not alter the existing use on the property. No exterior'alterations or additional square footage is proposed as part of this change to a nonconforming property. The request encompasses an alteration in the number of students and alteration of an interior wall. C. The subject site is physically adequate for the proposed alteration. The proposal to change from 15 to 20 preschool students and alter an interior wall will not increase the parking demand for the subject site. The California Department of Social Services requires one teacher for every 12 students which requires two teachers on site for 15 or 20 students. The subject site has operated as a preschool for 8 years without generating complaints to the City of Seal Beach. The business owner lives on the subject site and proposes to maintain the existing operations. The proposed alteration to one interior wall will not result in additional square footage or a: change, in the businesses operations. Page 2 of 5 Resolution No. 15-19 215 Seal Beach Blvd D. The location, size, design, and operating characteristics of the proposed alteration would be compatible with the surrounding uses and will not adversely affect those uses or properties in the surrounding areas. The existing preschool has operated at the subject site for 8 years without adversely affecting surrounding properties. The preschool will maintain its existing hours of opelration from 7:00 a.m. to 6:00 p.m. and will maintain all of its existing operations. The alteration to one interior wall will accommodate a second bathroom stall without adding square footage. E. The establishment, maintenance, and operation of the proposed alteration would not be detrimental to the health, safety, or welfare of persons residing or working in the vicinity. The proposed increase in preschool students will not require modifications to the site beyond the alteration of one interior wall to accommodate a second bathroom stall. The proposed alteration will comply with the California Building Code and will not increase the square footage of the building. The subject site is surrounded by a mix of commercial and residential uses, which fulfills the intent of the LC-RMD zone. The preschool has operated on the subject site for 8 years without causing a detriment to those residing or working in the vicinity. The increase will not alter the existing operations of the preschool as the hours will remain the same and no changes are proposed to the daily program or number of teachers on site. Section 5. Based upon the foregoing, the Planning Commission hereby approves CUP 15-6 to increase the number of preschool children from 15 to 20 in an existing preschool and relocate an interior wall to install a second bathroom stall, at 215 Seal Beach Boulevard, subject to the following conditions. 1. Conditional Use Permit 15-6 is approved to increase the number of,, preschool children from 15 to 20 in an existing preschool and relocate an interior wall to install a second bathroom stall at 215 Seal Beach Boulevard. 2. The applicant shall comply with all restrictions placed upon the license by the State of California Department of Social Services. In connection with the City consideration of an application, the applicant must demonstrate compliance with all restrictions placed upon the issuance of such license by the California Department of Social Services. 3. The applicant shall furnish the City a copy of the CDSS license and a copy of any conditions placed on the license by the Department of Social Services,, This shall be done as soon as the license is received by the applicant from the State of California Department of Social Services. 4. The premises of the preschool must be in substantial compliance with the plan submitted with the application and maintained on file with the Community Development Department date stamped June 26, 2015. All new construction shall comply with all applicable state and local codes. 5. The hours of operation shall be 7:00 AM to 6:00 PM Monday through Friday. 6. The establishment must comply with Chapter 7.15 "Noise" of the City of Seal Beach Municipal Code. Should complaints be received regarding noise Page 3 of 5 Resolution No. 15-19 215 Seal Beach Blvd generated by the establishment, the Planning Commission reserves the right to schedule this permit for reconsideration and may require the applicant/business operator to mitigate the noise level to comply with the provisions of Chapter 7.15. 7. Any proposed alterations or upgrades to the preschool or subject site will require review and approval from the City of Seal Beach Planning Division. 8. A modification of this CUP must be applied for when: a. The establishment proposes to modify any of its current Cd 1 nditions of Approval. I b. There is a substantial change in the mode or character of operations of the preschool. 9. The Planning Commission reserves the right to revoke or modify this U P if any violation of the approved conditions occurs, any violation of the Code I�of the City of Seal Beach occurs. 10. The establishment shall have a public telephone listing. 11. The applicant will prominently display these Conditions of Approval in, a location within the businesses' customer area that is acceptable to the Community Development Director. 12. Failure to comply with any of these conditions or a substantial change in the mode or character of the preschool shall be grounds for revoking or modifying this CUP approval. 13. This CUP shall not become effective for any purpose unless/until a City "Acceptance of Conditions" form has been signed and notarized by the applicant before being returned to the Planning Department; and until the ten (10) calendar day appeal period has elapsed. 14. The applicant is required to obtain all required Building and Safety permits prior to the alteration of one interior wall, construction or demolition. 15. Approval of this request shall not waive compliance with all sections of the Municipal Code, or all other applicable City Ordinances in effect at the time of building permit issuance. 16. This CUP shall become null and void unless exercised within one year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request for extension submitted to the Community Development Department at least ninety days prior to such expiration date. 17. The applicant must indemnify, defend, and hold harmless City, its officers, agents, and employees (collectively "the City" hereinafter in this paragraph) from any and all claims and losses whatsoever occurring or resulting to any and all persons, firms, or corporations furnishing or supplying work, services,: materials, or supplies in connection with the performance of the use permitted hereby or the exercise of the rights granted herein, and any and all claims, lawsuits, or actions arising from the granting of or the exercise of the rights permitted by this Page 4 of 5 Resolution No. 95-99 215 Seal Beach Blvd Conditional Use Permit, and from any and all claims and losses occurring or resulting to any person, firm, corporation or property for damage, injury or death arising out of or connected with the performance of the use permitted hereby. Applicant's obligation to indemnify, defend, and hold harmless the City as stated herein shall include, but not be limited to, paying all fees and costs incurred by legal counsel of the City's choice in representing the City in connection with any such claims, losses, lawsuits or actions, expert witness fees, and any award of damages, judgments, verdicts, court costs or attorneys' fees in any such lawsuit or action. My three children, ages 11, 8, and 6, all attended Growing Tree from 2006-2014, and I couldn't have been more pleased with their experiences there. Growing Tree combines social development with play and academic rigor in a personalized and nurturing way.All three of my children were more than prepared for Kindergarten and have all flourished in school and social settings. I think their successes can largely be attributed to the quality of preschool education they received. Growing Tree teaches children how to act and behave in social groups. Over the years, many people have commented on how well adjusted my children are at home and out in public. Their teachers tell me year after year that they are some of the best-behaved kids they have seen. My husband and I don't take credit for this behavior, since we know raising children works best when many people who care for them and want them to succeed surround them. We believe children should have manners and treat others with respect—values that Growing Tree also espouses and our children have flourished because of their preparation in*preschool. Growing Tree also holds high academic standards without making them overwhelming for children. The teachers there work with children individually and tailor their lessons to the academic level of each student. My 8 year old could recognize all of the sight words required for Kindergarten before he even started. My 6 year old could write letters and words with ease when she entered Kindergarten. All children, regardless of their skill level when they start Growing Tree, will be prepared for school. The effects of a good preschool education are often not visible for many years after the experience. I attribute my children's successes in school to the foundation they received at Growing Tree, and I will forever be grateful to Seretta and the Growing Tree teachers for providing such a long lasting arid quality education for my children. I was hoping to have him registered in Growing Tree Pre-School so that he could start this summer. I was so sad to hear that Growing Tree was closing down at 223 Seal Beach Blvd, and that the capacity for the other building was only 15 students. Ultimately there was no space for my son. My daughter Cali,who is now 8 went to Growing Tree from 2009-2011. We had such a great experience with Serretta and the rest of the staff.They are so welcoming and truly became part of our family, I felt unbelievably comfortable leaving my daughter in their hands. Cali learned so much during this time in her life. It was heart breaking having to part ways when my daughter started school at McGaugh Elementary; not only for myself and my daughter, but the staff as well, who form an undeniable bond with each and every student. Serretta has kept in touch with me and let me know that upon approval they will be adding another restroom to their building in order to bring the capacity to 20 students, and if that was so she would be able to have my son start school this August. I was absolutely thrilled to hear this as it is hard to leave your children with someone you don't know. I have established a fantastic relationship with Seretta, and want so badly for her to be able to care for my son as she did my daughter. i I write this letter in hopes that Growing Tree's request for an additional restroom is approved. We have been residents here in Seal Beach since 2006. 1 have two sons that went to Growing Tree, and they both attended the school for 2 years. They had wonderful and nurturing teachers,who prepared them thoroughly both academically and socially for Kindergarten at McGaugh. It is quite unfortunate that Growing Tree must move this summer,but they are trying to make the best of the situation and would love to continue caring for children at the new location. However, due to space issues,they will need to add in another bathroom to allow for the increased capacity. I am asking you to keep this wonderful school in business and thriving by granting them a variance to add on another bathroom, so that they can thereby increase the school's number of students. Parking is likely the primary issue, however taking into consideration parents either walk, or make a quick stop while unloading children at school, I believe parking will be minimally affected by such a small class. Both my children attend the school and it has been an amazing experience. I have a 5 year old and 2 year old - with my 5 year old about to attend McGaugh in fall. The teachers and Seretta Fielding have been blessings to have help raise my children - considering both my husband and I work full time, the kids spend most of their days at Growing Tree. The school has been instrumental in teaching my kids all the proper skills needed for their age range. In fact, my 5 year old was just tested and he is reading at a second grade level already. What is amazing to me is the amount of love, care, and _effort Growing Tree puts into the children, families, and Seal Beach community. It is one of the main reasons we LOVE living in seal beach and I would hate for the CUP to be denied.. This would then make Growing Tree turn away children who have grown to love the teachers and consider them family. It is pretty special when you hear the kids tell the teachers "I love you" completely unprompted. I would love to talk more about this if someone wants to reach out to me directly.
