Minutes I City of Seal Beach — Planning Commission July 6, 2015 Chair Sloan called the regular meeting of the Planning Commission to order at 7:00 p.m. in the City Council Chambers and led the Salute to the Flag. ROLL CALL Present: Chair Sloan; Commissioners: Cummings, Machen, Campbell Staff Present: Jim Basham, Director of Community Development Amy Greyson, Assistant City Attorney Crystal Landavazo, Senior Planner Steven Fowler, Assistant Planner Will Chen, Code Enforcement Officer Tina Knapp, City Clerk APPROVAL OF AGENDA With no objections, Chair Sloan so ordered the approval of the agenda, as presented. ORAL COMMUNICATIONS Chair Sloan opened oral communications. There being no speakers, Chair Sloan declared oral Communications closed. CONSENT CALENDAR Campbell moved, second by Machen, to approve the recommended actions on the consent calendar, as presented. 1. Approve the Planning Commission Meeting Minutes of June 15, 2015. AYES: Sloan, Cummings, Campbell, Machen NOES: None Motion Carried 14EW BUSINESS 2. Minor Use Permit (MUP) 15-3 22 C Pacific Avenue (Formerly 22 C Surfside Avenue) Applicant: Steven M. Hanna Property Owner: Steven M. Hanna Request: Minor Use 'Permit 15-3 requesting to allow a covered roof access structure to extend above the roof height by 4 feet 4 inches as part of a new single family residence Page 2 — Planning Commission 7/6/15 located in Surfside Colony, a Residential Low 'Density (RLD-9) zoning area. Recommendation: After reviewing the application, staff recommends that the Planning Commission adopt Resolution No. 15-9, approving Minor Use Permit 15-3 with Conditions. Will Chen, Code Enforcement Officer, presented the staff report on this item. The applicant spoke in support of staffs recommendation and indicated that the Surfside community has approved this change subject to action by the Planning Commission. As a result of questions by the Commission, staff will add language throughout the Resolution regarding maximum roof height. Staff will also amend Section 5 Item 2 adding the standard language regarding new construction applying to all applicable state and local codes. Cummings moved, second by Campbell, to adopt Resolution No. 15-9, as amended, entitled "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR USE PERMIT 15-3 TO ALLOW A COVERED ROOF ACCESS STRUCTURE TO EXTEND ABOVE THE ROOF HEIGHT BY 4 FEET 4 INCHES AS PART OF A NEW SINGLE FAMILY RESIDENCE LOCATED AT 22 C PACIFIC AVENUE." AYES: Sloan, Cummings, Campbell, Machen NOES: None Motion Carried The Assistant City Attorney advised that the adoption of Resolution No. 15-9 approving MUP 15-3 is the final decision of the Planning Commission. There is a 10-day appeal period to the City Council and the appeal period begins July 7, 2015. 3. Minor Use Pen-nit (MUP) 15-9 215 Ocean Avenue' Applicant: Tori Jones Property Owner: Paul Masoner Request: Minor Use Permit 15-9 requesting to allow the alteration of an existing front porch roof, extension of an existing second floor covered deck, and a new rear deck platform, 2 feet above grade, on a nonconforming property in the Residential High Density (RHD-20) zoning area. Recommendation: After reviewing the application, staff recommends that the Planning Commission adopt Resolution No. 15-14, approving Minor Use Permit 15-9 with Conditions. Campbell moved, second by Machen, to adopt Resolution No. 15-14, entitled "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR USE PERMIT 15-9 TO ALLOW THE ALTERATION OF AN EXISTING FRONT PORCH ROOF, EXTENSION OF AN EXISTING SECOND FLOOR COVERED DECK, AND A NEW REAR! DECK PLATFORM, 2 FEET ABOVE GRADE, ON A NONCONFORMING PROPERTY IN THE RESIDENTIAL HIGH DENSITY (RHD-20) ZONING AREA AT 215 OCEAN AVENUE." AYES: Sloan, Cummings, Campbell, Machen ,NOES: None Motion Carried The Assistant City Attorney advised that the adoption of Resolution No. 15-14 approving MUP 15-9 is the final decision of the Planning Commission. There is a 10-day appeal period to the City Council and the appeal period begins July 7, 2015. 4. Minor Use Permit (MUP) 15-6 212 Central Avenue Applicant: Ron Hoover Property Owner: Tim Buzza Request: Minor Use Permit 15-3 requesting to allow an alteration of less than 25% of interior walls to convert an existing bedroom into a library, relocate the kitchen from the front of the residence to the rear and convert the existing kitchen area into a study. The request also includes replacing existing side and rear exterior doors at a residence that is nonconforming due to parking and is located in the Residential High Density (RHD-20) zoning area. Recommendation: After reviewing the application, staff recommends that the Planning Commission adopt Resolution No. 15-15, approving Minor Use Permit 15-6 with Conditions. Steven Fowler, Assistant Planner, presented the staff report on this item. The applicant spoke in support of staffs recommendation. Cummings moved, second by Machen, to adopt Resolution No. 15-15, entitled "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR USE PERMIT 15-6 TO ALLOW AN ALTERATION OF LESS THAN 25% OF INTERIOR WALLS TO CONVERT AN EXISTING BEDROOM INTO A LIBRARY, RELOCATE THE KITCHEN FROM THE FRONT OF THE RESIDENCE TO THE REAR AND CONVERT THE EXISTING Page 4— Planning Commission 7/6/15 KITCHEN AREA INTO A STUDY. THE REQUEST ALSO INCLUDES REMOVAL AND REPLACEMENT OF EXISTING SIDE AND REAR EXTERIOR DOORS AT A RESIDENCE THAT IS NONCONFORMING DUE TO PARKING AND IS LOCATED IN THE RESIDENTIAL HIGH DENSITY (RHD20) ZONING AREA. Minor Use Permit (MUP) 15-7 311 8th Street Applicant: Richard Tait Property Owner: Richard Tait Request: Minor Use Permit 15-7 requesting to allow an alteration of less than 25% of interior walls to remodel an existing kitchen by extending an existing wall and lowering a separate wall to create visibility between the kitchen and living room in a residence that is nonconforming due density and parking. The residence is located in the Residential High Density (RHD-20) zoning area., Recommendation: After reviewing the application, staff recommends that the Planning Commission adopt Resolution No. 15-16, approving Minor Use Permit 15-7 with Conditions. Steven Fowler, Assistant Planner, presented the staff report on this item. As a result of questions by the Commission, staff will amend Section 4 Item,C (first sentence) to read, "The proposed interior alterations, as conditioned below, will be located on a site that is physically adequate for type, density, and intensity of use being proposed, including provision of services, and the absence of physical constraints." Campbell moved, second by Cummings, to adopt Resolution No. 15-16, as amended, entitled "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR USE PERMIT 15-7 TO ALLOW AN ALTERATION OF LESS THAN 25% OF INTERIOR WALLS TO REMODEL AN EXISTING KITCHEN BY EXTENDING AN EXISTING WALL AND LOWERING A SEPARATE WALL TO CREATE VISIBILITY BETWEEN THE KITCHEN AND LIVING ROOM IN A RESIDENCE THAT IS NONCONFORMING DUE DENSITY AND PARKING. THE RESIDENCE IS LOCATED IN THE Page 5— Planning Commission 716115 1 RESIDENTIAL HIGH DENSITY (RHD-20) ZONING AREA AT 311 8TH STREET." AYES: Sloan, Cummings, Campbell, Machen NOES: None Motion Carried The Assistant City Attorney advised that the adoption of Resolution N6. 15-16 approving MUP 15-7 is the final decision of the Planning Commission. There is a 10-day appeal period to the City Council and the appeal period begins July 7, 2015. PUBLIC HEARING 6. Conditional Use Permit (CUP) 15-4 12535 Seal Beach Boulevard Applicant: Leslie Gentile Property Owner: Farmers & Merchants Bank Request: Conditional Use Permit 15-4 to install a temporary modular trailer to serve as a bank while the existing bank undergoes tenant improvements and to reduce the number of drive-up teller lanes from 5 to 2 in the General Commercial (GC) zone. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 15- 17, approving Conditional Use Permit 15-4. Steven Fowler, Assistant Planner, presented the staff report on this item. Chair Sloan opened the public hearing. The applicant spoke in support of staffs recommendation. There being no additional speakers, Chair Sloan closed the public hearing. Machen moved, second by Campbell, to adopt Resolution No, 15-17, entitled "A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT 15-4 TO INSTALL A TEMPORARY MODULAR TRAILER TO SERVE AS A BANK WHILE THE EXISTING BANK UNDERGOES TENANT IMPROVEMENTS AND TO REDUCE THE NUMBER OF DRIVE-UP TELLER LANES FROM 5 TO 2 LOCATED IN THE GENERAL COMMERCIAL (GC) ZONE. AT 12535 SEAL BEACH BOULEVARD." AYES: Sloan, Cummings, Campbell, Machen NOES: None Motion Carried The Assistant City Attorney advised that the adoption of Resolution No. 15-17 approving CUP 15-4 is the final decision of the Planning Commission. DIRECTOR'S REPORT Chair Sloan indicated he will be absent from the next meeting, July 20, 2015. Director Basham provided an update on the historical beach cottage. COMMISSION CONCERNS Vice Chair Cummings commented that buildings proposed at Main and PCH would look good if they matched the style of the nearby buildings. Commissioner Machen commented on the fundraising efforts of the Seal Beach Lions Club for the historical beach cottage. Chair Sloan inquired about the property on the pier.
