Crumby, P.E., Director of Public Works SUBJECT: APPROVE EMERGENCY WATER MAIN REPAIRS ON LAMPSON AVENUE WITHOUT ADVERTISING FOR BIDS SUMMARY OF REQUEST: That the City Council approve Resolution No. 6590 declaring that the emergency repair of the Lampson Avenue Water Main break is of urgent necessity for the immediate preservation of life, health, and property; authorizing staff to contract for the emergency repair without advertising for bids; and approving Budget Amendment No. 16-02-01 to allocate $100,000 to repair the water main break at the intersection of Lampson Avenue and Seal Beach Boulevard, Project #WT1608. BACKGROUND AND ANALYSIS: On Friday July 24, 2015 at 11:00 p.m., a water main break occurred on Lampson Avenue at Seal Beach Boulevard. The 50-year-old water main is a 12-inch cement mortared steel pipe. This pipe material is no longer in production. This water main is key to the City's provision of water service in this area. Due to the size and scope of the repair, City staff will need the assistance of a general pipeline contractor, Charles King Company, to complete the water pipe and pavement repair. Waiting to complete the formal process of advertising and accepting formal bids would drastically impact the City's ability to provide water service and create traffic delays for an unacceptable period of time. Traditionally, a public works project of this magnitude would require the City to undertake an extensive and time consuming process to publicly solicit bids and award a contract to the lowest responsible bidder. The normal bidding process could take between 30 and 90 additional days. Under these emergency circumstances, Seal Beach Charter Section 1010 permits the City Council to dispense with public bidding and approve the project on an emergency basis. If approved, staff anticipates beginning work on the repair immediately. Agenda Item F Staff's estimated cost of the water pipe and pavement repair is under $100,000, Once the emergency repair is complete, staff will bring back this item with a complete report. ENVIRONMENTAL IMPACT: This project is categorically exempt from review under California Environmental Quality Act ("CEQA") pursuant to Section 15301, Class 1(c) of the State CEQA Guidelines. LEGAL ANALYSIS: The City Attorney has reviewed and concurs that the City Council may decide to dispense with the formal bidding process in this case. FINANCIAL IMPACT: The funding required for this project will come from the Water Capital Improvement Fund (019). There is available fund balance to cover this project. Resolution No. 6590 Page 2 RESOLUTION NUMBER 6590 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL DECLARING THAT THE EMERGENCY REPAIR OF THE WATER MAIN BREAK AT THE INTERSECTION OF LAMPSON AVENUE AND SEAL BEACH BOULEVARD IS OF URGENT NECESSITY FOR THE PRESERVATION OF LIFE, HEALTH AND PROPERTY, AUTHORIZING STAFF TO CONTRACT FOR THE EMERGENCY REPAIR WITHOUT ADVERTISING FOR BIDS, AND APPROVING BUDGET AMENDMENT NO. 16-02-01 TO ALLOCATE $100,000 TO REPAIR THE WATER MAIN BREAK,WT1608 THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE, FIND AND DETERMINE AS FOLLOWS: 1. On July 24, 2015 a water main break occurred in the City's water main at the intersection of Lampson Avenue and Seal Beach Boulevard. 2. City staff shut down the water line where the break occurred, reducing traffic to a single lane on Lampson Avenue. Without the full operation of the main line where the break occurred, that portion of the City has reduced capacity to deliver water through the system. 3. The City Council hereby declares the following: A. The repair of the recent break in the above-described water line, Project#WT1608, is of urgent necessity for the preservation of life, health and property. B. Pursuant to the City's Charter section 1010, the Director of Public Works is authorized to contract for the repair project without advertising for bids. C. The Director of Public Works is directed to report back to the City Council at the conclusion of the project regarding the costs and expenditures for the project. D.
