Mayor Deaton called the special meeting of the Seal Beach City Council to order
at 5:30 p.m. in the City Hall Conference Room.

The City Attorney noted that Council Member Varipapa recused himself from
discussion of the item identified on the agenda due to his employer. The City
Attorney announced that the City Council would meet to discuss the item
identified on the closed session agenda.

The City Council met in regular session at 7:00 p.m. in the City Council
Chambers with Mayor Deaton calling the meeting to order and Council Member
Miller leading the Salute to the Flag.

APPROVAL OF AGENDA & WAIVER OF FULL READING OF RESOLUTIONS
&ORDINANCES
City Manager Ingram requested that two presentations be added to the agenda,
one from Chief Joe Bailey and one from Michael Levitt, the City's representative
to the Orange County Mosquito &Vector Control District. Council Member Miller
requested that Item E be removed from the consent calendar for separate
consideration.

PRESENTATIONS/RECOGNITIONS
Marine Safety Chief Joe Bailey reported on the highlights of this year's Junior
Lifeguard program. Chief Bailey also presented certificates of recognition from
Assemblyman Travis Allen's office to the Seal Beach winners of the Junior
Lifeguard Regionals run relay event.
Michael Levitt reported on the recent activities of the Orange County Mosquito &
Vector Control District and the new direction being taken regarding abatement of
rats. Mr. Levitt also provided tips for preventing against mosquito bites.
ORAL COMMUNICATIONS
Mayor Deaton opened oral communications. Speakers: Charles Antos spoke
regarding the lease agreement between the City and the Seal Beach Historical
Society for the red car museum and the location of the historical beach cottage.
Jacob Reichio, Old Town resident, expressed concerns regarding the City's new
parking passes and the grace period previously afforded between the prior year's
passes and the new and resulting citations. Michael Neimeyer asked that the
City take action regarding the chairs and tables on the beach in the area of Seal
Way. Matt Walker requested attention to the deterioration of the beach area
south of the pier on/around Seal Way including littering and barbecuing on the
beach. Jennifer Walker requested attention to the beach in the area of Seal Way
to eliminate the trash on the beach so that it can properly be cleaned. She also
requested enforcement of parking issues on Seal Way. Scott Newman, College

Park East, spoke about the Municipal Code prohibiting dogs in all parks in
College Park East and asked that the City Council address this matter and
achieve a compromise allowing dogs in some parks, if not all. Ronde Winkler,
President of the Golden Rain Foundation, thanked the City for a variety of recent
activities, including presentations on asbestos and solar energy and water
conservation testing that was recently conducted, and expressed appreciation for
the interaction between the City and Leisure World. Joyce Parque, Old Town,
thanked Michael Ho and Will Chen for recent clean-up of the bicycle trail and
Chief Bailey for the Junior Lifeguard program. Ms. Parque spoke about the
utilities users tax being part of the general fund, 501(c)3 designation, and
response to a recent public records request. Seth Eaker, Old Town, reported
that nominations for the Americana Awards are now being accepted, offered
support of agenda Items C, D, E, and G and reported on various Centennial
activities. There being no other speakers, Mayor Deaton declared oral
communications closed.
CITY ATTORNEY REPORT Craig A. Steele, City Attorney
The City Attorney responded to the comments made regarding the lease
agreement between the City and the Seal Beach Historical Society indicating the
agreement has been in place since 1981 and provides for the property on which
the red car is located is leased for $1 per year. Amendments to the lease are
being explored by the City Attorney's office including changing the landlord from
the Seal Beach Redevelopment Agency as it no longer exists and exploring
changing the lot line for possibly relocating the historical beach cottage. These
amendments are being explored through a letter from the City Attorney's office to
the Seal Beach Historical Society.
The City Attorney also commented that the Director of Community Development
was in contact with the Coastal Commission throughout the process of relocating
the historical cottage, which was done with the full knowledge of the Coastal
Commission. The Coastal Commission had issued a permit to demolish the
cottage to the private property owners.
The City Attorney also responded to the nature of the utilities users tax question
that was raised during Oral Communications and indicated that Municipal Code
Section 4.50.005 indicates that general taxes (the utilities users tax is a general
tax) may be expended through the general fund.
CITY MANAGER REPORT Jill R. Ingram, City Manager
The City Manager indicated that staff has been working with the Coastal
Commission on the issue of items (benches, tables) on the beach south of the
Pier and indicated that the City Council asked that staff prepare a recommended
solution, which will presented to the City Council for policy decisions in
September. The City Manager also indicated that the Gas Company and Time
Warner Cable were working near the area of the water main break on Lampson
Avenue and some ancillary issues arose resulting in phone issues at City Hall.
Deputy Director of Public Works Michael Ho indicated that a Time Warner fiber
optic line was struck, which resulted in phone issues throughout the City. The
issues should be resolved within the next 24 hours. City Manager Ingram also
indicated that any reportable gifts/dinners received by staff are accurately
reported on the annual conflict of interest statements.
COUNCIL COMMENTS
Council Member Varipapa thanked staff for a great National Night Out event and
expressed appreciation for the Junior Lifeguard program. Council Member Miller
thanked staff for the National Night Out event and Junior Lifeguard program. It
was determined that Miller would work with staff to draft a letter from the City to
the California Public Utilities Commission regarding the facilities and proposed
Verizon-Frontier asset transfer. He would also like the letter to address the issue
of Verizon's promise of installing Verizon FiOS through the entire City. Council
Member Massa-Lavitt thanked Ronde Winkler for her diligent attendance at City
Council meetings and expressed appreciation for Leisure World. Mayor Pro Tern

Sloan reported on an inspirational lunch he recently had with three WWII
veterans. Mayor Deaton addressed some of the concerns raised in Oral
Communications and confirmed with staff that the issue of benches on the beach
would be addressed at the second City Council meeting in September. Mayor
Deaton indicated that noise levels around Seal Way are being addressed and
reported that the historical cottage could not be left on the previous site as a new
home was being built on that site. Mayor Deaton further reported that the City's
historical fire engine was not purchased; it was one of the City's fire engines.
Mayor Deaton also reported that there may be amendments made to AB 1217 so
that it could re-addressed and that City Council and staff remain diligent in
following this legislation.

A. Minutes of the Regular City Council Meeting of July 27, 2015 — Approve
by minute order.
B, Demands on City Treasury—Ratification.
C. FEMA Pre-Disaster Mitigation Grant Preparation Assistance Agreement—
Adopt Resolution No. 6587 authorizing the agreement with Michael Baker
International in the amount of $5,680 and the additional requirement for
$25,000 matching funds, that the City Manager be authorized to execute
all agreements and necessary documents on behalf of the City, and that
approval be given to the Chief of Police to expend these funds as detailed
in the report.
D, Selective Traffic Enforcement Program — Adopt Resolution No. 6588
accepting the 2015/2016 California Office of Traffic Safety funding with the
restrictions imposed by the grantor,that the City Manager be authorized to
execute all agreements and necessary documents on behalf of the City,
and that approval be given to the Chief of Police to expend these funds as
detailed in the report.

E. Approval of Centennial Bricks Installation and Donation Agreement with the Seal
Beach Lions Foundation —Approve Resolution No. 6589 awarding a Purchase
Order to Golden State Constructors for $34,825 to improve areas at the four
locations of the Centennial bricks and authorizing the City Manager to execute an
agreement with the Seal Beach Lions Foundation for the donation of a clock.
F. Approve Emergency Water Main Repairs on Lampson Avenue Without
Advertising for Bids — Adopt Resolution No. 6590 declaring that the
emergency repair of the Lampson Avenue Water Main break is of urgent
necessity for the immediate preservation of life, health, and property;
authorizing staff to contract for the emergency repair without advertising
for bids; and approving Budget Amendment No. 16-02-01 to allocate
$100,000 to repair the water main break at the intersection of Lampson
Avenue and Seal Beach Boulevard, Project#WT1608.
G. City Historic Preservation Committee — Rescind Resolution No. 6584 and
adopt the amended resolution, Resolution No. 6591, establishing a City
Historic Preservation Committee for the purpose of preserving resources
that represent the history and culture of Seal Beach.

ITEM E / APPROVAL OF CENTENNIAL BRICKS INSTALLATION AND
DONATION AGREEMENT WITH THE SEAL BEACH LIONS FOUNDATION
Miller
Deputy Director of Public Works Ho presented the staff report on this item. Mr.
Ho indicated that Leisure World has been separated from this project and staff
will work with Leisure World for this District. Miller commented that the site
shown for District 4 is not necessarily the final site and consideration is being
made for installing of benches, in addition to the bricks. Mayor Deaton thanked
the Seal Beach Lions Foundation for the generous clock donation.
Miller moved, second by Massa-Lavitt, to approve Resolution No. 6589 entitled,
"A RESOLUTION OF THE SEAL BEACH CITY COUNCIL APPROVING A
PURCHASE ORDER TO GOLDEN STATE CONSTRUCTORS FOR
AUTHORIZING THE CITY MANAGER TO EXECUTE THE DONATION
AGREEMENT WITH THE SEAL BEACH LIONS FOUNDATION."

UNFINISHED/CONTINUED BUSINESS
ITEM H/QUARTERLY PARKING PROJECT UPDATE
Director of Finance Vikki Beatley provided the staff report for this item and
indicated that the consultant, Janis Rhodes, was in attendance. The Director of
Finance reported that parking permit sales have slowed and that more permits
were sold this year than in the past, perhaps due to advertising in the "Sun"
newspaper and the adherence to contractor parking. Janis Rhodes indicated
that stickers were not sold this year as when a sticker is adhered to the bumper
and removed, due to the composition of current vehicle bumpers, paint is
removed when the sticker is removed. Ms. Rhodes reported that materials have
been ordered to provide a solution for adhering permits to open air vehicles to
help eliminate the possibility of theft. In the interim, permit holders with open air
vehicles have been contacted and have been issued an alternative sticker. Staff
indicated that the challenge for beach parking placards is due to placards being
tied to specific license plates. Issuance of placards for all types of parking is
planned for the future. The citation process will be transferred to Data Ticket in
mid-September and will include Internet access to citation information. On or
about October 1St, community outreach is planned for the new citation
access/process.
Ms. Rhodes also indicated that the first samples of equipment for issuing
citations did not have as large a range as desired for picking up the RFID
information from the parking permits. The new samples are being tested this
week and the hope is to present the purchase of the equipment to City Council in
early September.
The next steps in the project are to review parking signage in Old Town and
providing power and communication lines to the beach lots for payment of
parking in these lots(waiting for off-peak season).
Chief Stilinovich indicated that a one-week grace period was allowed between
the old permits and the new. Staff confirmed that there is a manual appeal
process currently in place and the new process will include an online appeal

process component. Chief Stilinovich indicated that permits must be visible in
vehicles.
Mayor Deaton indicated that she has received complaints about the hanging
placards, which must be taken off when driving. Staff indicated that options to
the hanging placards are being explored. Mayor Deaton inquired as to putting
placards in the rear driver's side window and Chief Stilinovich responded that
uniformity is needed for enforcement and, often, the rear windows have tinting
that would make it difficult to see the placards.
Ms. Rhodes reviewed the appeals process. Staff indicated that a large quantity
of appeals of citations have been received since the new placards have been
issued.
Chief Stilinovich indicated that uniformity of placement of the placards is ideal,
Director Beatley reported that approximately 2,300 placards have been sold.

With no objections, Mayor Deaton adjourned the meeting at 8:40 p.m. to
Monday, September 14, 2015 at 5:30 p.m. to meet in closed session, if deemed
necessary. Due to a lack of business items in need of City Council action, the
August 24, 2015 meeting is hereby cancelled.
