Minutes City of Seal Beach — Planning Commission September 8, 2015 Chair Sloan called the regular meeting of the Planning Commission to order at 7:00 p.m. in the City Council Chambers and Commissioner Campbell led the Salute to the Flag. ROLL CALL Present: Commissioners: Sloan, Cummings, Campbell Staff Present: Crystal Landavazo, Senior Planner Amy Greyson, Assistant City Attorney Steven Fowler, Assistant Planner Tina Knapp, City Clerk APPROVAL OF AGENDA With no objections, Chair Sloan so ordered the approval of the agenda, as presented. ORAL COMMUNICATIONS Chair Sloan opened oral communications. There being no speakers, Chair Sloan declared oral communications closed. CONSENT CALENDAR Chair Sloan reported that he watched the Planning Commission meeting of July 20, 2015 available on the City's website. Campbell moved, second by Cummings, to approve the recommended actions on the consent calendar, as presented. 1. Approve the Planning Commission Meeting Minutes of July 20, 2015. AYES: Sloan, Cummings, Campbell NOES: None Motion Carried NEW BUSINESS 2. Minor Use Permit (MUP) 15-11. 629 Southshore Drive Applicant: Jason Ybarra of TKR Construction Property Owner: Jeff& Laurie Shaw Request: Minor Use Permit 15-11 requesting to allow an interior remodel involving rearranging the layouts of an existing kitchen, two bathrooms and alteration of the front entry door within an existing single-family residence that is nonconforming due to the front yard setback and is located in the Residential Low Density (RLD-9) zoning area. Page 2— Planning Commission 9/8/15 Recommendation: After reviewing the application, staff recommends that the Planning Commission adopt Resolution No., 15-20, approving Minor Use Permit 15-11 with Conditions. Steve Fowler, Assistant Planner, presented the staff report on this item and indicated that no correspondence was received pertaining to this item. Commission Campbell confirmed that Section 3-13 of Resolution No. 15-20 should be updated to indicate that the subject property is 5,100 square feet and not 2,933 square feet. Chair Sloan confirmed that in Attachment 2 to Resolution No. 15-20, drawing A-1, the setback shown as 164" is correct. Both of these items will be corrected in the final resolution and are included in the amendments identified in the approval by the Commission. Campbell moved, second by Cummings, to adopt Resolution No. 15-20, as amended, entitled "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR USE PERMIT 15-11 TO ALLOW AN INTERIOR REMODEL INVOLVING REARRANGING THE LAYOUTS OF AN EXISTING KITCHEN AND TWO BATHROOMS AND AN ALTERATION OF THE FRONT ENTRY DOOR WITHIN AN EXISTING SINGLE- FAIVIIL Y RESIDENCE THAT IS NONCONFORMING DUE TO THE SIZE OF THE FRONT YARD SETBACK LOCATED IN THE RESIDENTIAL LOW DENSITY (RLD-9) ZONING AREA AT 629 SOUTHSHORE DRIVE." AYES: Sloan, Cummings, Campbell NOES: None Motion Carried The Assistant City Attorney advised that the adoption of Resolution No. 15-20 approving MUP 15-11 is the final decision of the Planning Commission. There is a 10-day appeal period to the City Council and the appeal period begins September 9, 2015. 3. Minor Use Permit OVIUP) 15-12 127 5 th Street Applicant: Thomas &Truly Hanson Property Owner: Thomas &Truly Hanson Request: Minor Use Permit 15-12 requesting to allow an interior remodel involving relocating the kitchen, eliminating one bedroom and a new study space within an existing single-family residence that is nonconforming due to a garage side yard setback only and is located in the Residential High Density (RHD-20) zoning area. Recommendation: After reviewing the application, staff recommends that the Planning Commission adopt Resolution No. 15-21, approving Minor Use Permit 15-12 with Conditions. Steve Fowler, Assistant Planner, presented the staff report on this item and indicated that no correspondence was received pertaining to this item. Mike Page 3 — Planning Commission 9/8/15 Buhbe, Seal Beach resident and neighbor of the project site, spoke in support of staff's recommendation. Campbell moved, second by Cummings, to adopt Resolution No. 15-21, entitled "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR USE PERMIT 15-12 TO ALLOW AN INTERIOR REMODEL INCLUDING RELOCATING THE KITCHEI\I, ELIMINATING ONE BEDROOM AND CONVERTING THE EXISTING KITCHEN AREA INTO A NEW STUDY SPACE WITHIN AN EXISTING SINGLE-FAMILY RESIDENCE THAT IS NONCONFORMING DUE TO A DETACHED GARAGE SIDE YARD SETBACK LOCATED IN THE RESIDENTIAL HIGH DENSITY (RHD-20) ZONING AREA AT TH 127 5 STREET." AYES: Sloan, Cummings, Campbell NOES: None Motion Carried PUBLIC HEARING 4. Zone Text Amendment LZIA J15-1 All Commercial Zones Applicant: City of Seal Beach Request: Zone Text Amendment 15-1 requesting an amendment to Title 1 1:Zoning of the City of Seal Beach Municipal Code regarding allowable incidental business activities. 'Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 15- 22, recommending approval of Zone Text Amendment 15-1. Crystal Landavazo, Senior Planner, presented the staff report on this item and confirmed that proper notification was made for this item and that the new Ordinance would be presented to the City Council as it is not being introduced into the Zoning Code. Commissioner Campbell expressed concerns about the administrative process, especially notificationi, redress of decisions made, and who will be administering the process. Commission Campbell indicated she is uncomfortable supporting this process unless she reviews the revised process will entail and that she feels this item takes away Planning Commission protection from the public. Commission Cummings indicated she would like to see challenges in the current processed be removed for businesses. Chair Sloan opened the public hearing. There being no speakers, Chair Sloan closed the public hearing. Cummings moved, second by Sloan, to adopt Resolution No. 15-22, entitled "A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION RECOMMENDING ADOPTION OF ZONE TEXT AMENDMENT 15-1 TO Page 4 — Planning Commission 9/8115 REPEAL SECTION 11.4.05.010.0 OF CHAPTER 11.4.05 OF TITLE 11 OF THE SEAL BEACH MUNICIPAL CODE REGARDING ALLOWABLE INCIDENTAL BUSINESS ACTIVITIES AND GRANDFATHERING-IN EXISTING BUSINESSES WITH CONDITIONAL USE PERMITS." AYES: Sloan, Cummings NOES: Campbell Motion Failed The Planning Commission compiled the following list of concerns pertaining to this item for communication to the City Council: • Clarification needs to be made as to the notification of residents, especially the manner and timeframe; • Clarification as to the specifies of the administrative process, especially identifying the party responsible for decision-making; • Clarification as to who issues are addressed and in what manner; and • Ensure adjudication of the process in an open forum to include televising .and public hearing. Sloan moved, second by Campbell, to adopt Resolution No. 15-22, with the concerns identified above, entitled "A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION RECOMMENDING ADOPTION OF ZONE TEXT AMENDMENT 15-1 TO REPEAL SECTION 11.4.05.010.0 OF CHAPTER 11.4.05 OF TITLE 11 OF THE SEAL BEACH MUNICIPAL CODE REGARDING ALLOWABLE INCIDENTAL BUSINESS ACTIVITIES AND GRANDFATHERING- IN EXISTING BUSINESSES WITH CONDITIONAL USE PERMITS." AYES: Sloan, Cummings, Campbell NOES: None Motion Carried DIRECTOR'S REPORT Senior Planner Landavazo reported that Director of Community Development Jim Basham is attending the Coast Commission this week and this is why he was not at tonight's meeting. COMMISSION CONCERNS Commissioner Cummings inquired as to whether or not inquiries have been made to-date on the former Fresh & Easy location. Staff provided an update on the development of the property at Main and PCH.
