Jim Basham, Director of Community Development/Interim Director of Public Works SUBJECT: AUTHORIZE THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH ANDERSON PENNA PARTNERS, INC. FOR THE WESTMINSTER AVENUE STORM DRAIN STUDY PROJECT CIP NO. ST1603 SUMMARY OF REQUEST: That the City Council adopt Resolution No. 6603 authorizing the City Manager to execute a professional services agreement with Anderson Penna Partners, Inc. in the amount of $38,480 for the Westminster Avenue Storm Drain Study Report Project CIP No. ST1603. BACKGROUND AND ANALYSIS: The study area of the Westminster Avenue Channel (Channel) is an existing concrete trapezoidal open channel that extends an estimated 3,350 feet from just west of the southeast corner of Leisure World to the Federal Storm Channel towards the end of the City's boundary. The Channel is located outside of the northerly roadway of Westminster Avenue between Seal Beach Boulevard and West City Limits. A large portion of Leisure World and surrounding development drains to the Channel. The Westminster Avenue Storm Drain Study Project CIP No. ST1603 (Project) consists of a hydrology study and analysis of the Channel to determine the size of an enclosed storm drain facility to allow the use of its property above the storm drain as a Class I bike facility. On August 19, 2015 a Request for Proposal was released and eight (8) consultants were solicited. On September 22, 2015 one (1) proposal was received from Anderson Penna Partners, Inc. (APP). Staff contacted the Agenda Item H remaining consultants to determine why proposals were not submitted. The responses were as follows: Consultant Response 1. Harris & Associates Not a rendering service of their professional expertise. 2 Bucknam Not interested due to a heavy work load. Infrastructure 3. Civil Source Not interested due to a heavy work load. .............. 4. GMU Decline proposal. 5. Anderson Penna Submitted a proposal. Partners 6 Zimmerman W. 3. Not interested due to a heavy work load of ongoing Engineering projects. 7. ARCADIS U.S. Not a rendering service of their professional expertise. 8. MWH Global Decline proposal. Staff recommends selecting APP to provide the services for the Project. APP is familiar with the City's infrastructure and provides prices that are very competitive for the market. The fee for APP to perform the services for the Project is $38,480. ENVIRONMENTAL IMPACT: No environmental review is required at this time because this item only entails awarding a contract for a study report. LEGAL ANALYSIS: The City Attorney has reviewed and approved as to form. FINANCIAL IMPACT: The FY 2015/16 Budget includes $70,000 to perform the services for the Project. RECOMMENDATION: That the City Council adopt Resolution No. 6603 authorizing the City Manager to execute a professional services agreement with Anderson Penna Partners, Inc. in the amount of $38,480 for the Westminster Avenue Storm Drain Study Report Project CIP No. ST1603. City Clerk PROFESSIONAL SERVICES AGREEMENT for Westminster Avenue Storm Drain Study Report Project CIP No. ST1603 Between PO � UNTI City of Seal Beach 211 - 8th Street Seal Beach, CA 90740 Anderson Penna Partners, Inc. 3737 Birch Street, Suite 250 Newport Beach, CA 92660 (949) 428-1500 This Professional Service Agreement ("the Agreement") is made as of October 12, 2015 (the "Effective Date"), by and between Anderson Penna Partners, Inc. ("Consultant"), a Corporation, and the City of Seal Beach ("City"), a California charter city, (collectively, "the Parties"). RECITALS A. City desires certain professional services.. B. Consultant represents that it is qualified and able to provide City with such services. NOW THEREFORE, in consideration of the Parties' performance of the promises, covenants, and conditions stated herein, the Parties hereto agree as follows. AGREEMENT 1.0 Scope of Services 1.1. Consultant shall provide those services ("Services") set forth in the attached Exhibit A, which is hereby incorporated by this reference. To the extent that there is any conflict between Exhibit A and this Agreement, this Agreement shall control. 1.2. Consultant shall perform all Services under this Agreement in accordance with the standard of care generally exercised by like professionals under similar circumstances and in a manner reasonably satisfactory to City. 1.3. In performing this Agreement, Consultant shall comply with all applicable provisions of federal, state, and local law. 1.4. Consultant will not be compensated for any work performed not specified in the Scope of Services unless the City authorizes such work in advance and in writing. The City Manger may authorize extra work to fund unforeseen conditions up to the amount approved at the time of award by the City Council. Payment for additional work in excess of this amount requires prior City Council authorization. 2.0 Term This term of this Agreement shall commence as of the Effective Date and shall continue for a term of 1 year unless previously terminated as provided by this Agreement. 3.0 Consultant's Compensation City will pay Consultant in accordance with the hourly rates shown on the fee schedule set forth in Exhibit A for Services but in no event will the City pay more than $38,480. Any additional work authorized by the City pursuant to Section 1.4 will be compensated in accordance with the fee schedule set forth in Exhibit A 2of10 4.0 Method of Payment 4.1. Consultant shall submit to City monthly invoices for all services rendered pursuant to this Agreement. Such invoices shall be submitted within 15 days of the end of the month during which the services were rendered and shall describe in detail the services rendered during the period, the days worked, number of hours worked, the hourly rates charged, and the services performed for each day in the period. City will pay Consultant within 30 days of receiving Consultant's invoice. City will not withhold any applicable federal or state payroll and other required taxes, or other authorized deductions from payments made to Consultant. 4.2. Upon 24-hour notice from City, Consultant shall allow City or City's agents or representatives to inspect at Consultant's offices during reasonable business hours all records, invoices, time cards, cost control sheets and other records maintained by Consultant in connection with this Agreement. City's rights under this Section 4.2 shall survive for two years following the termination of this Agreement. 5.0 Termination 5.1. This Agreement may be terminated by City, without cause, or by Consultant based on reasonable cause, upon giving the other party written notice thereof not less than 30 days prior to the date of termination. 5.2. This Agreement may be terminated by City upon 10 days' notice to Consultant if Consultant fails to provide satisfactory evidence of renewal or replacement of comprehensive general liability insurance as required by this Agreement at least 20 days before the expiration date of the previous policy. 6.0 Party Representatives 6.1. The City Manager is the City's representative for purposes of this Agreement. 6.2. David R. Anderson, P.E. is the Consultant's primary representative for purposes of this Agreement. 7.0 Notices 7.1. All notices permitted or required under this Agreement shall be deemed made when personally delivered or when mailed 48 hours after deposit in the United States Mail, first class postage prepaid and addressed to the party at the following addresses: 3of10 To City: City of Seal Beach 211-8th Street Seal Beach, California 90740 Attn: City Manager To Consultant: Anderson Penna Partners, Inc. 3737 Birch Street, Suite 250 Newport Beach, CA 92660 Attn: David R. Anderson, P.E. 7.2. Actual notice shall be deemed adequate notice on the date actual notice occurred, regardless of the method of service. 8.0 Independent Contractor 8.1. Consultant is an independent contractor and not an employee of the City. All services provided pursuant to this Agreement shall be performed by Consultant or under its supervision. Consultant will determine the means, methods, and details of performing the services. Any additional personnel performing services under this Agreement on behalf of Consultant shall also not be employees of City and shall at all times be under Consultant's exclusive direction and control. Consultant shall pay all wages, salaries, and other amounts due such personnel in connection with their performance of services under this Agreement and as required by law. Consultant shall be responsible for all reports and obligations respecting such additional personnel, including, but not limited to: social security taxes, income tax withholding, unemployment insurance, disability insurance, and workers' compensation insurance. 8.2. Consultant shall indemnify and hold harmless City and its elected officials, officers, employees, servants, designated volunteers, and agents serving as independent contractors in the role of City officials, from any and all liability, damages, claims, costs and expenses of any nature to the extent arising from Consultant's personnel practices. City shall have the right to offset against the amount of any fees due to Consultant under this Agreement any amount due to City from Consultant as a result of Consultant's failure to promptly pay to City any reimbursement or indemnification arising under this Section. 9.0 Subcontractors No portion of this Agreement shall be subcontracted without the prior written approval of the City. Consultant is fully responsible to City for the performance of any and all subcontractors. 4of10 10.0 Assignment Consultant shall not assign or transfer any interest in this Agreement whether by assignment or novation, without the prior written consent of City. Any purported assignment without such consent shall be void and without effect. 11.0 Insurance 11.1. Consultant shall not commence work under this Agreement until it has provided evidence satisfactory to the City that Consultant has secured all insurance required under this Section. Consultant shall furnish City with original certificates of insurance and endorsements effecting coverage required by this Agreement on forms satisfactory to the City. The certificates and endorsements for each insurance policy shall be signed by a person authorized by that insurer to bind coverage on its behalf, and shall be on forms provided by the City if requested. All certificates and endorsements shall be received and approved by the City before work commences. The City reserves the right to require complete, certified copies of all required insurance policies, at any time. 11.2. Consultant shall, at its expense, procure and maintain for the duration of the Agreement, insurance against claims for injuries to persons or damages to property that may arise from or in connection with the performance of this Agreement. Insurance is to be placed with insurers with a current A.M. Best's rating no less than A:VIII, licensed to do business in California, and satisfactory to the City. Coverage shall be at least as broad as the latest version of the following: (1) General Liability: Insurance Services Office Commercial General Liability coverage (occurrence form CG 0001); (2) Automobile Liability: Insurance Services Office Business Auto Coverage form number CA 0001, code 1 (any auto); and, if required by the City, (3) Professional Liability. Consultant shall maintain limits no less than: (1) General Liability: $2,000,000 per occurrence for bodily injury, personal injury and property damage and if Commercial General Liability Insurance or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to this Agreement/location or the general aggregate limit shall be twice the required occurrence limit; (2) Automobile Liability: $1,000,000 per accident for bodily injury and property damage; and (3) Professional Liability: $1,000,000 per claim/aggregate. 11.3. The insurance policies shall contain the following provisions, or Consultant shall provide endorsements on forms supplied or approved by the City to state: (1) coverage shall not be suspended, voided, reduced or canceled except after 30 days prior written notice by certified mail, return receipt requested, has been given to the City; (2) any failure to comply with reporting or other provisions of the policies, including breaches of warranties, shall not affect coverage provided to the City, its directors, officials, officers, (3) coverage shall be primary insurance as respects the City, its directors, officials, officers, 5of10 employees, agents and volunteers, or if excess, shall stand in an unbroken chain of coverage excess of the Consultant's scheduled underlying coverage and that any insurance or self-insurance maintained by the City, its directors, officials, officers, employees, agents and volunteers shall be excess of the Consultant's insurance and shall not be called upon to contribute with it; (4) for general liability insurance, that the City, its directors, officials, officers, employees, agents and volunteers shall be covered as additional insureds with respect to the services or operations performed by or on behalf of the Consultant, including materials, parts or equipment furnished in connection with such work; and (5) for automobile liability, that the City, its directors, officials, officers, employees, agents and volunteers shall be covered as additional insureds with respect to the ownership, operation, maintenance, use, loading or unloading of any auto owned, leased, hired or borrowed by the Consultant or for which the Consultant is responsible. 11.4. All insurance required by this Section shall contain standard separation of insureds provisions and shall not contain any special limitations on the scope of protection afforded to the City, its directors, officials, officers, employees, agents, and volunteers. 11.5. Any deductibles or self-insured retentions shall be declared to and approved by the City. Consultant guarantees that, at the option of the City, either: (1) the insurer shall reduce or eliminate such deductibles or self-insured retentions as respects the City, its directors, officials, officers, employees, agents, and volunteers; or (2) the Consultant shall procure a bond guaranteeing payment of losses and related investigation costs, claims and administrative and defense expenses. 12.0 Indemnification, Hold Harmless, and Duty to Defend Consultant shall defend, indemnify, and hold the City, its officials, officers, employees, volunteers and agents serving as independent contractors in the role of city officials (collectively "Indemnitees") free and harmless from any and all claims, demands, causes of action, costs, expenses, liability, loss, damage or injury, in law or equity, to property or persons, including wrongful death, in any manner arising out of or incident to any acts or omissions of Consultant, its employees, or its agents in connection with the performance of this Agreement, including without limitation the payment of all consequential damages and attorneys' fees and other related costs and expenses, except for such loss or damage arising from the sole negligence or willful misconduct of the City. With respect to any and all such aforesaid suits, actions, or other legal proceedings of every kind that may be brought or instituted against Indemnitees, Consultant shall defend Indemnitees, at Consultant's own cost, expense, and risk, and shall pay and satisfy any judgment, award, or decree that may be rendered against Indemnitees. Consultant shall reimburse City and its directors, officials, officers, employees, agents and/or volunteers, for any and all legal expenses and costs incurred by each of them in connection therewith or in enforcing the indemnity 6of10 herein provided. Consultant's obligation to indemnify shall not be restricted to insurance proceeds, if any, received by Consultant, the City, its directors, officials, officers, employees, agents or volunteers. All duties of Consultant under this Section shall survive termination of this Agreement. 13.0 Equal Opportunity Consultant affirmatively represents that it is an equal opportunity employer. Consultant shall not discriminate against any subcontractor, employee, or applicant for employment because of race, religion, color, national origin, handicap, ancestry, sex, sexual orientation, or age. Such non-discrimination includes, but is not limited to, all activities related to initial employment, upgrading, demotion, transfer, recruitment or recruitment advertising, layoff, or termination. 14.0 Labor Certification By its signature hereunder, Consultant certifies that it is aware of the provisions of Section 3700 of the California Labor Code that require every employer to be insured against liability for Workers' Compensation or to undertake self-insurance in accordance with the provisions of that Code, and agrees to comply with such provisions before commencing the performance of the Services. 15.0 Entire Agreement This Agreement contains the entire agreement of the parties with respect to the subject matter hereof, and supersedes all prior negotiations, understandings, or agreements. This Agreement may only be modified by a writing signed by both parties. 16.0 Severability The invalidity in whole or in part of any provisions of this Agreement shall not void or affect the validity of the other provisions of this Agreement. 17.0 Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of California. 18.0 No Third Party Rights No third party shall be deemed to have any rights hereunder against either party as a result of this Agreement. 7of10 19.0 Waiver No waiver of any default shall constitute a waiver of any other default or breach, whether of the same or other covenant or condition. No waiver, benefit, privilege, or service voluntarily given or performed by a party shall give the other party any contractual rights by custom, estoppel, or otherwise. 20.0 Prohibited Interests; Conflict of Interest 20.1. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which may be affected by the Services, or which would conflict in any manner with the performance of the Services. Consultant further covenants that, in performance of this Agreement, no person having any such interest shall be employed by it. Furthermore, Consultant shall avoid the appearance of having any interest, which would conflict in any manner with the performance of the Services. Consultant shall not accept any employment or representation during the term of this Agreement which is or may likely make Consultant "financially interested" (as provided in California Government Code §§1090 and 87100) in any decision made by City on any matter in connection with which Consultant has been retained. 20.2. Consultant further warrants and maintains that it has not employed or retained any person or entity, other than a bona fide employee working exclusively for Consultant, to solicit or obtain this Agreement. Nor has Consultant paid or agreed to pay any person or entity, other than a bona fide employee working exclusively for Consultant, any fee, commission, gift, percentage, or any other consideration contingent upon the execution of this Agreement. Upon any breach or violation of this warranty, City shall have the right, at its sole and absolute discretion, to terminate this Agreement without further liability, or to deduct from any sums payable to Consultant hereunder the full amount or value of any such fee, commission, percentage or gift. 20.3. Consultant warrants and maintains that it has no knowledge that any officer or employee of City has any interest, whether contractual, non- contractual, financial, proprietary, or otherwise, in this transaction or in the business of Consultant, and that if any such interest comes to the knowledge of Consultant at any time during the term of this Agreement, Consultant shall immediately make a complete, written disclosure of such interest to City, even if such interest would not be deemed a prohibited "conflict of interest" under applicable laws as described in this subsection. 21.0 Attorneys' Fees If either party commences an action against the other party, either legal, administrative or otherwise, arising out of or in connection with this Agreement, the prevailing party in such litigation shall be entitled to have and recover from 8of10 the losing party all of its attorneys' fees and other costs incurred in connection therewith. 22.0 Exhibits All exhibits referenced in this Agreement are hereby incorporated into the Agreement as if set forth in full herein. In the event of any material discrepancy between the terms of any exhibit so incorporated and the terms of this Agreement, the terms of this Agreement shall control. 23.0 Corporate Authority The person executing this Agreement on behalf of Consultant warrants that he or she is duly authorized to execute this Agreement on behalf of said Party and that by his or her execution, the Consultant is formally bound to the provisions of this Agreement. Approach Our project approach is framed by our understanding of the project from information acquired as a result of our review of the Request for Proposal,record drawings,field review of the project site and our extensive previous experience on drainage studies and reports.Based on this understanding,we are providing experienced staff who will take ownership of the perspective project elements and who understand their roles and responsibilities. Our project approach and proven work plan is based on a pro-active project management approach.We firmly believe in "doing it right the first time".Consequently,we realize that when pursuing project success it is critical to thoroughly define the project requirements before the work is started.The project requirement must be mutually agreed on between the client and the design team.The requirement must also be clearly communicated and understood by all disciplines and at all staff levels. We do not assume that the City staff has the full range of knowledge and experience necessary to know all of the detailed design requirements.Therefore,we will assume responsibility and take the initiative for extracting this required information from the City.The use of a carefully prepared Project Management Plan will be our key to achieving quality expectations. Our observations related to this proposal are as follows: • Based on the Channel record drawings,a portion of the existing Westminster Avenue Channel(Channel)is outside of the northerly roadway right-of-way for Westminster Avenue. w • Based on the Channel record drawings,the existing Channel longitudinal grade is 0.05%,which is extremely flat,and will wow potentially have a significant impact on the size of the proposed ' °` " N'1, N closed storm drain. • Without knowing if there are any vertical utility constraints beneath the Channel,there is a vertical drop of approximately 6 feet at the Channel junction with the Federal Storm Channel(COI S06). This vertical differential should allow for the lowering of the invert of the proposed closed conduit/box culvert,thereby allowing for more cover r� and a steeper longitudinal grade for the proposed storm drain. • The existing open channel on the east side of Seal Beach Boulevard flows underneath Westminster Avenue and continues southerly, thereby not contributing any flow to the Channel. • The existing development in the northwest corner of Westminster/Seal Beach Boulevard includes several private storm drains that preliminarily appear to drain into the Channel at the upstream end. 7 Page ANDERSON•PENNA Professional Engineering Services for the Westminster Avenue Storm Drain Study Report from Seal Beach Boulevard to Federal Storm Channel C01S06 • A large portion of Leisure World Seal Beach(LWSB)south of C01 S06 drains to the Channel via various storm drain systems. • The properties west of Apollo Drive on the south side of Westminster preliminarily appear to outlet to the longitudinal storm drain in Apollo Court,which in turns drains directly to C01 S06. • A significant amount of the Boeing parking lot preliminarily appears to drain to the south side of Westminster Avenue. • There are 7 catch basins on the south side of Westminster which we have assumed outlet to the Channel. • Westminster Avenue appears to have been constructed as a series of rolling sumps due to the flat longitudinal grades. fey llssues The following issues must be carefully considered during the course of the project. Private Property Limits -... ......_........................ .............. _._.-- _... In reviewing the record plans for the project,a portion of the existing Channel is constructed on private property owned by the Golden Rain Foundation.A determination will have to be made early in the study if this is true and if this is acceptable. This determination will be critical in developing the alternative box culvert/pipe alignments. To that end,and to assist in determining some other key constraints described below,we are recommending a small amount of ground survey and right- of-way research to tie-down some of the unknowns,so that there are no surprises when the City moves forward with the design and construction phases of the project. Drainage Experience/Reasonable Alternatives wawa APP staff has established a reputation for identifying cost-saving solutions,and in general for identifying solutions that are cost-effective.The recommendations provided by our staff are the result of significant drainage experience,including personnel that are knowledgeable in street AND utility design,which allows for solutions that are not theoretical but practical and account for the realities of existing constraints and what is and isn't practical for the adjacent roadway,including the City's ultimate goal for the Channel area.Additionally,our Team is expert at developing creative solutions in fully-developed areas.A few examples include creative use of a side-weir while designing an open channel for the SBCFCD that was retrofit between an arterial highway and UPRR tracks and the use of a significant squash box as part of a box culvert design in the City of Industry. Attention to Details Paying attention to the details—defining the public right of way limits,identifying potential utility impacts,determining the longitudinal gradient of the existing channel-is probably the most critical part of the project.This attention to detail will extend to providing the best record drawing,utility information and right-of-way information available.The experience of the APP Project Team,both in the industry as well as with LWSB projects,combined with our proven QA/QC procedures,help to assure the City that the alternatives developed are reasonable, ° thorough and are being closely scrutinized. Utility Location The location of existing utilities will have a critical role in determining the horizontal and vertical alignment of the proposed alternatives.It is essential to conduct a thorough utility search to locate the existing utilities as accurately as possible.For this reason,we recommend a detailed utility research effort as an optional task,even though the project is not at the design level. 8 1 P a g e 1 ANDERSON°PENNA Professional Engineering Services for the Westminster Avenue Storm Drain Study Report from Seal Beach Boulevard to Federal Storm Channel C01S06 Realistic Construction Costs The APP team will pay special attention to the preparation of realistic budgetary construction estimates and look for ways to minimize construction costs.Our estimates will be based on contractor bids for similar recent construction projects supplemented by direct discussion with APP's construction management personnel and local contractors.For this project,we propose to use a structural subconsultant to help refine the construction costs. Tributary Area Boundaries Accurately identifying the tributary area boundaries,especially within LWSB and on the south side of Westminster Avenue,is essential to developing accurate discharges,which will in turn determine the size of the storm drain facilities required.APP staff has significant experience working with LWSB staff,including the hiring several years ago of the previous facilities �-r coordinator(Todd Garner)as an APP employee. His knowledge of the existing storm drain facilities within LWSB will be extremely helpful. Scope of Work The following work scope items are included in our proposed fee to accomplish this project: Task 1 —Kickoff Meeting and Administration • Attend a pre-design(kick-off)meeting with City representatives to review the project in detail,and determine any specific drainage observations or problems for the existing Channel and tributary area. • Maintain communication with the City's Project Manager throughout the duration of the study. • Prepare agendas of any special items of discussion and minutes serving as a communication record and listing any required follow-up actions. • Remain cognizant of the status of each task as it proceeds and make provisions to expeditiously resolve any issues that may impede progress. • Proactively initiate communication efforts with the City to address key issues in a timely fashion and bring any potential complex issues to the attention of the Project Engineer as quickly as possible. • Coordinate project and approvals with the City. • Provide a QA/QC plan for the project to ensure quality control for the duration of the project. This task includes maintaining organization and communication over the entire project team,cost and schedule monitoring and performing a constructability review of the recommended alternative drainage system. Task 2—Retrieve and Review Record Information APP has considerable experience in researching plans and reports from different agencies,including the City,Orange County, and other agencies. All pertinent information will be collected. The specific data collected will include the following: • City topographic maps • Previous master plans and drainage studies • Record drawings for existing storm drains from City and LWSB • Right-of-way information which defines the northerly boundary of Westminster Avenue relative to the existing Channel 9 1 P a g e ANDERSON°PENNA Professional Engineering Services for the Westminster Avenue Storm Drain Study Report from Seal Beach Boulevard to Federal Storm Channel C01S06 Pertinent information(HGL control,peak discharge,etc.)from OCFCD for the C01S06 Channel As discussed earlier,the APP Team includes Todd Garner,CPII who was the primary hands-on facilities inspector and maintenance person in LWSB for more than nine years.His experience working in LWSB will be helpful to identify existing storm drain facilities within the community,in defining the tributary area boundaries,and in identifying the correct personnel in LWSB regarding any right-of-way issues that need to be resolved. Existing storm drain systems were noted in the commercial development in the northwest quadrant of the Seal Beach/Westminster intersection and in the Hampton Inn/Charles Schwab commercial development just east of Boeing on the south side of the street.Any information from the City on how these private storm drain systems drain will be helpful. Additionally,APP will meet with City maintenance and engineering staff to develop a list of any specific drainage problems that have occurred over the years. Task 3—Field Review In conjunction with the preparation of the hydrologic analysis,we generally use field reconnaissance to verify watershed and drainage boundaries. Field reconnaissance will be performed in order to confirm the location of existing drainage facilities,to review field conditions for problem areas,and to supplement data relating to watershed and drainage boundaries identified as a part of the hydrologic analysis.Of particular importance will be verifying the tributary area on the south side of Westminster.As described above,a portion of the Boeing parking lot east of Apollo drains to Westminster Avenue—it will be important to define the area as accurately as possible so that the proposed drainage facility can be sized correctly. Task 4—Hydrology Study We are proposing to use the City's topographic mapping for our base map. The topographic mapping supplemented by our field reviews will be the basis for defining the tributary boundaries for the proposed storm drain system. Our yur preliminary review reflects a tributary area of over 80 acres,with most of the tributary area,as expected,being from LWSB(see Exhibit 1 —Hydrology Map,on the following page).We will use the ultimate land use data,provided by the City in order to calculate the 10,25,and 100-year peak discharges. Hydrologic data will be developed for each subarea using the County's current hydrology methodology. Calculations will be generated with the AES computer program RATOC. Although quality control will be an on-going process throughout the project,a specific quality control review will be initiated at this stage of the project to verify tributary area boundaries and that the magnitude of the runoff is reasonable for the corresponding land use and subarea size. The subarea boundaries will also be submitted to the City for review. The analysis will focus on the mainline storm drain systems and will not include connector pipes and catch basin analysis. (Assuming the tributary area is in the 80 acre range,the 100-year discharge will be over 200 cfs,which is a significant amount of discharge).As identified above, discussions will be held with OCFCD staff to arrive at the downstream water surface control elevation. The proposed facilities will be assumed to be closed facilities,following essentially the same alignment as the existing open channel,if possible. The proposed closed-conduit storm drain facilities will be shown on the base mapping provided by the City. Alternative facilities will be identified and evaluated as discussed below,including the possibility of two parallel storm drains due to vertical and potentially horizontal right-of-way constraints. The alternative storm drains will also be analyzed using the WSPG computer program. Another specific quality control review will be initiated at this stage of the project to verify the sizing of the various alternatives. Task 7—Develop and Evaluate Alternatives APP shall develop and analyze up to three(3)possible err ; alternatives to convey the peak discharge within a closed conduit system,anticipated to be box culverts that are wider than they are high. As identified earlier,it may require multiple parallel systems to convey the runoff. For each alternative APP shall perform all necessary calculations,including hydrologic, hydraulic,and cost estimates. Preliminary right-of-way and utility impacts will also be identified,as well as the �� na .... recommended solution to joining the downstream OCFCD facility. �� Analysis of alternate plan and profile alignments will be carried ���'� � ' o out to a point where the impacts can be assessed in terms of functionality,level of protection,cost-effectiveness,construction impacts and duration of construction.APP will also make a recommendation for the preferred alternative. The cost estimates for each alternative will include quantities,unit costs,and totals. Cost estimates will typically include construction,engineering,inspection,and administration costs,as well as any anticipated right of way costs,and will be broken down by typical bid items. Ground Survey and R/W Refinement(optional task) Given the vertical constraints imposed by the prevailing flat longitudinal gradients and the horizontal constraint imposed by the record Channel drawings showing that only a portion of the Channel is within the Westminster Avenue right-of-way,we recommend a limited ground survey effort to establish more realistic upstream and downstream elevations and to establish the limits of the public right-of-way relative to the existing north edge of the roadway lanes.Our preliminary research indicates that the 40'wide strip north of Westminster Avenue(that the Channel appears to encroach into)is currently owned by the Golden Rain Foundation(LWSB). Preliminary Structural Calculations(optional task) 131Page _ ANDERSUNTENNA Professional Engineering Services for the Westminster Avenue Storm Drain Study Report from Seal Beach Boulevard to Federal Storm Channel CO1 S06 In order to provide construction cost estimates that are more realistic,considering that the structural cost estimates will be by far the dominant part of the construction costs,we recommend completing some preliminary structural engineering to refine the thicknesses and reinforcement for the various box culverts and the outlet structure.The additional effort will assist in comparing the various alternatives and also in providing a construction cost estimate that is more realistic. Task 8-Study Report Three copies of the draft Study report will be prepared that will include an executive summary,detailed description of all work,findings,conclusions,and recommendations for the study. Upon receipt of City review comments,the report will be finalized. It is anticipated that the report will include the following: • Hydrology Maps including subarea boundaries. • Existing Facilities Map indicating the location of existing drainage facilities. • Proposed Facilities Map showing the locations and sizes of the recommended drainage facilities. • Letter Report containing a summary of the study. Final deliverables shall consist of the following: • Ten(10)copies of the Final Report • Three(3)copies of the Appendices including the hydrologic and hydraulic computer analyses • One(1)set of reproducible documents and maps • One(1)digital copy of the final reports and data sets Task 9-Project Management/Quality Assurance and Quality Control The Project Management task is directed at the organization,planning and control of the project team.Activities include scheduling and monitoring of the project team,cost control and an active quality control program. Quality Control will be an ongoing task throughout the duration of the project.In addition to the Quality Control by the Project Manager,a Quality Control engineer that is not involved in the project will review the plans.The QC engineer will do a technical evaluation of the hydrology,hydraulics,alternative facility sizes and locations,and construction cost estimates.The review comments are transmitted to the Project Manager during a subsequent meeting. Second Street Storm Drain,City of Long Beach APP is providing design services in conjunction with our on-call engineering contract with the City of Long Beach. The project included the final design of a relief storm drain system to alleviate an existing deficiency on an adjacent storm drain system.Due to the extent of existing utilities within 6th Street,an extensive potholing program was required,which did locate an unknown pipeline which was not identified by USA.A hydrologic/hydraulic analysis was also completed as a part of the project.Specifications and cost estimates were also prepared as a part of this project. LOSSAN Corridor Drainage Analysis and Improvements,Orange County Transportation Authority(OCTA),South Orange County APP was recently selected for the analysis and design of seven areas adjacent to the LOSSAN Corridor in Orange County.The projects will include close coordination with the cities of Irvine,Lake Forest,Mission Viejo and San Juan Capistrano.The project includes hydrologic/hydraulic analyses, sedimentation analysis,and recommending permanent drainage solutions to several miles of closed conduits and open channel facilities that are eroding adjacent to the railroad tracks.
