This Professional Service Agreement ( "the Agreement') is made as of October 12, 2015
(the "Effective Date "), by and between David Volz Design, Inc. ( "Consultant'), a
Corporation, and the City of Seal Beach ( "City "), a California charter city, (collectively,
"the Parties ").

RECITALS
A. City desires certain professional services.

B. Consultant represents that it is qualified and able to provide City with such
services.
NOW THEREFORE, in consideration of the Parties' performance of the
promises, covenants, and conditions stated herein, the Parties hereto agree as
follows.
AGREEMENT
1.0 Scope of Services
1.1. Consultant shall provide those services ( "Services ") set forth in the
attached Exhibit A, which is hereby incorporated by this reference. To the extent
that there is any conflict between Exhibit A and this Agreement, this Agreement
shall control.
1.2. Consultant shall perform all Services under this Agreement in
accordance with the standard of care generally exercised by like professionals
under similar circumstances and in a manner reasonably satisfactory to City.
1.3. In performing this Agreement, Consultant shall comply with all
applicable provisions of federal, state, and local law.
1.4. Consultant will not be compensated for any work performed not
specified in the Scope of Services unless the City authorizes such work in
advance and in writing. The City Manger may authorize extra work to fund
unforeseen conditions up to the amount approved at the time of award by the
City Council. Payment for additional work in excess of this amount requires prior
City Council authorization.
2.0 Term
This term of this Agreement shall commence as of the Effective Date and shall
continue for a term of 1 year unless previously terminated as provided by this
Agreement.
3.0 Consultant's Compensation
City will pay Consultant in accordance with the hourly rates shown on the fee
schedule set forth in Exhibit A for Services but in no event will the City pay more
than $53,286. Any additional work authorized by the City pursuant to Section 1.4
will be compensated in accordance with the fee schedule set forth in Exhibit A

4.0 Method of Payment
4.1. Consultant shall submit to City monthly invoices for all services
rendered pursuant to this Agreement. Such invoices shall be submitted within 15
days of the end of the month during which the services were rendered and shall
describe in detail the services rendered during the period, the days worked,
number of hours worked, the hourly rates charged, and the services performed
for each day in the period. City will pay Consultant within 30 days of receiving
Consultant's invoice. City will not withhold any applicable federal or state payroll
and other required taxes, or other authorized deductions from payments made to
Consultant.
4.2. Upon 24 -hour notice from City, Consultant shall allow City or City's
agents or representatives to inspect at Consultant's offices during reasonable
business hours all records, invoices, time cards, cost control sheets and other
records maintained by Consultant in connection with this Agreement. City's
rights under this Section 4.2 shall survive for two years following the termination
of this Agreement.
5.0 Termination
5.1. This Agreement may be terminated by City, without cause, or by
Consultant based on reasonable cause, upon giving the other party written notice
thereof not less than 30 days prior to the date of termination.
5.2. This Agreement may be terminated by City upon 10 days' notice to
Consultant if Consultant fails to provide satisfactory evidence of renewal or
replacement of comprehensive general liability insurance as required by this
Agreement at least 20 days before the expiration date of the previous policy.
6.0 Party Representatives
6.1. The City Manager is the City's representative for purposes of this
Agreement.
6.2. David J. Volz is the Consultant's primary representative for
purposes of this Agreement.
7.0 Notices
7.1. All notices permitted or required under this Agreement shall be
deemed made when personally delivered or when mailed 48 hours after deposit
in the United States Mail, first class postage prepaid and addressed to the party
at the following addresses:

7.2. Actual notice shall be deemed adequate notice on the date actual
notice occurred, regardless of the method of service.
8.0 Independent Contractor
8.1. Consultant is an independent contractor and not an employee of
the City. All services provided pursuant to this Agreement shall be performed by
Consultant or under its supervision. Consultant will determine the means,
methods, and details of performing the services. Any additional personnel
performing services under this Agreement on behalf of Consultant shall also not
be employees of City and shall at all times be under Consultant's exclusive
direction and control. Consultant shall pay all wages, salaries, and other
amounts due such personnel in connection with their performance of services
under this Agreement and as required by law. Consultant shall be responsible
for all reports and obligations respecting such additional personnel, including, but
not limited to: social security taxes, income tax withholding, unemployment
insurance, disability insurance, and workers' compensation insurance.
8.2. Consultant shall indemnify and hold harmless City and its elected
officials, officers, employees, servants, designated volunteers, and agents
serving as independent contractors in the role of City officials, from any and all
liability, damages, claims, costs and expenses of any nature to the extent arising
from Consultant's personnel practices. City shall have the right to offset against
the amount of any fees due to Consultant under this Agreement any amount due
to City from Consultant as a result of Consultant's failure to promptly pay to City
any reimbursement or indemnification arising under this Section.
9.0 Subcontractors
No portion of this Agreement shall be subcontracted without the prior written
approval of the City. Consultant is fully responsible to City for the performance of
any and all subcontractors.

10.0 Assignment
Consultant shall not assign or transfer any interest in this Agreement whether by
assignment or novation, without the prior written consent of City. Any purported
assignment without such consent shall be void and without effect.
11.0 Insurance
11.1. Consultant shall not commence work under this Agreement until it
has provided evidence satisfactory to the City that Consultant has secured all
insurance required under this Section. Consultant shall furnish City with original
certificates of insurance and endorsements effecting coverage required by this
Agreement on forms satisfactory to the City. The certificates and endorsements
for each insurance policy shall be signed by a person authorized by that insurer
to bind coverage on its behalf, and shall be on forms provided by the City if
requested. All certificates and endorsements shall be received and approved by
the City before work commences. The City reserves the right to require
complete, certified copies of all required insurance policies, at any time.
11.2. Consultant shall, at its expense, procure and maintain for the
duration of the Agreement, insurance against claims for injuries to persons or
damages to property that may arise from or in connection with the performance
of this Agreement. Insurance is to be placed with insurers with a current A.M.
Best's rating no less than A:VIII, licensed to do business in California, and
satisfactory to the City. Coverage shall be at least as broad as the latest version
of the following: (1) General Liability: Insurance Services Office Commercial
General Liability coverage (occurrence form CG 0001); (2) Automobile Liability:
Insurance Services Office Business Auto Coverage form number CA 0001, code
1 (any auto); and, if required by the City, (3) Professional Liability. Consultant
shall maintain limits no less than: (1) General Liability: $2,000,000 per
occurrence for bodily injury, personal injury and property damage and if
Commercial General Liability Insurance or other form with a general aggregate
limit is used, either the general aggregate limit shall apply separately to this
Agreement/location or the general aggregate limit shall be twice the required
occurrence limit; (2) Automobile Liability: $1,000,000 per accident for bodily injury
and property damage; and (3) Professional Liability: $1,000,000 per
claim /aggregate.
11.3. The insurance policies shall contain the following provisions, or
Consultant shall provide endorsements on forms supplied or approved by the
City to state: (1) coverage shall not be suspended, voided, reduced or canceled
except after 30 days prior written notice by certified mail, return receipt
requested, has been given to the City; (2) any failure to comply with reporting or
other provisions of the policies, including breaches of warranties, shall not affect
coverage provided to the City, its directors, officials, officers, (3) coverage shall
be primary insurance as respects the City, its directors, officials, officers,

employees, agents and volunteers, or if excess, shall stand in an unbroken chain
of coverage excess of the Consultant's scheduled underlying coverage and that
any insurance or self- insurance maintained by the City, its directors, officials,
officers, employees, agents and volunteers shall be excess of the Consultant's
insurance and shall not be called upon to contribute with it; (4) for general liability
insurance, that the City, its directors, officials, officers, employees, agents and
volunteers shall be covered as additional insureds with respect to the services or
operations performed by or on behalf of the Consultant, including materials, parts
or equipment furnished in connection with such work; and (5) for automobile
liability, that the City, its directors, officials, officers, employees, agents and
volunteers shall be covered as additional insureds with respect to the ownership,
operation, maintenance, use, loading or unloading of any auto owned, leased,
hired or borrowed by the Consultant or for which the Consultant is responsible.
11.4. All insurance required by this Section shall contain standard
separation of insureds provisions and shall not contain any special limitations on
the scope of protection afforded to the City, its directors, officials, officers,
employees, agents, and volunteers.
11.5. Any deductibles or self- insured retentions shall be declared to and
approved by the City. Consultant guarantees that, at the option of the City,
either: (1) the insurer shall reduce or eliminate such deductibles or self- insured
retentions as respects the City, its directors, officials, officers, employees,
agents, and volunteers; or (2) the Consultant shall procure a bond guaranteeing
payment of losses and related investigation costs, claims and administrative and
defense expenses.
12.0 Indemnification, Hold Harmless, and Duty to Defend
Consultant shall defend, indemnify, and hold the City, its officials, officers,
employees, volunteers and agents serving as independent contractors in the role
of city officials (collectively "Indemnitees ") free and harmless from any and all
claims, demands, causes of action, costs, expenses, liability, loss, damage or
injury, in law or equity, to property or persons, including wrongful death, in any
manner arising out of or incident to any acts or omissions of Consultant, its
employees, or its agents in connection with the performance of this Agreement,
including without limitation the payment of all consequential damages and
attorneys' fees and other related costs and expenses, except for such loss or
damage arising from the sole negligence or willful misconduct of the City. With
respect to any and all such aforesaid suits, actions, or other legal proceedings of
every kind that may be brought or instituted against Indemnitees, Consultant
shall defend Indemnitees, at Consultant's own cost, expense, and risk, and shall
pay and satisfy any judgment, award, or decree that may be rendered against
Indemnitees. Consultant shall reimburse City and its directors, officials, officers,
employees, agents and /or volunteers, for any and all legal expenses and costs
incurred by each of them in connection therewith or in enforcing the indemnity

herein provided. Consultant's obligation to indemnify shall not be restricted to
insurance proceeds, if any, received by Consultant, the City, its directors,
officials, officers, employees, agents or volunteers. All duties of Consultant
under this Section shall survive termination of this Agreement.
13.0 Equal Opportunity
Consultant affirmatively represents that it is an equal opportunity employer.
Consultant shall not discriminate against any subcontractor, employee, or
applicant for employment because of race, religion, color, national origin,
handicap, ancestry, sex, sexual orientation, or age. Such non - discrimination
includes, but is not limited to, all activities related to initial employment,
upgrading, demotion, transfer, recruitment or recruitment advertising, layoff, or
termination.
14.0 Labor Certification
By its signature hereunder, Consultant certifies that it is aware of the provisions
of Section 3700 of the California Labor Code that require every employer to be
insured against liability for Workers' Compensation or to undertake self- insurance
in accordance with the provisions of that Code, and agrees to comply with such
provisions before commencing the performance of the Services.
15.0 Entire Agreement
This Agreement contains the entire agreement of the parties with respect to the
subject matter hereof, and supersedes all prior negotiations, understandings, or
agreements. This Agreement may only be modified by a writing signed by both
parties.
16.0 Severability
The invalidity in whole or in part of any provisions of this Agreement shall not
void or affect the validity of the other provisions of this Agreement.
17.0 Governing Law
This Agreement shall be governed by and construed in accordance with the laws
of the State of California.
18.0 No Third Party Rights
No third party shall be deemed to have any rights hereunder against either party
as a result of this Agreement.

No waiver of any default shall constitute a waiver of any other default or breach,
whether of the same or other covenant or condition. No waiver, benefit, privilege,
or service voluntarily given or performed by a party shall give the other party any
contractual rights by custom, estoppel, or otherwise.
20.0 Prohibited Interests; Conflict of Interest
20.1. Consultant covenants that it presently has no interest and shall not
acquire any interest, direct or indirect, which may be affected by the Services, or
which would conflict in any manner with the performance of the Services.
Consultant further covenants that, in performance of this Agreement, no person
having any such interest shall be employed by it. Furthermore, Consultant shall
avoid the appearance of having any interest, which would conflict in any manner
with the performance of the Services. Consultant shall not accept any
employment or representation during the term of this Agreement which is or may
likely make Consultant "financially interested" (as provided in California
Government Code § §1090 and 87100) in any decision made by City on any
matter in connection with which Consultant has been retained.
20.2. Consultant further warrants and maintains that it has not employed
or retained any person or entity, other than a bona fide employee working
exclusively for Consultant, to solicit or obtain this Agreement. Nor has
Consultant paid or agreed to pay any person or entity, other than a bona fide
employee working exclusively for Consultant, any fee, commission, gift,
percentage, or any other consideration contingent upon the execution of this
Agreement. Upon any breach or violation of this warranty, City shall have the
right, at its sole and absolute discretion, to terminate this Agreement without
further liability, or to deduct from any sums payable to Consultant hereunder the
full amount or value of any such fee, commission, percentage or gift.
20.3. Consultant warrants and maintains that it has no knowledge that
any officer or employee of City has any interest, whether contractual, non -
contractual, financial, proprietary, or otherwise, in this transaction or in the
business of Consultant, and that if any such interest comes to the knowledge of
Consultant at any time during the term of this Agreement, Consultant shall
immediately make a complete, written disclosure of such interest to City, even if
such interest would not be deemed a prohibited "conflict of interest" under
applicable laws as described in this subsection.
21.0 Attorneys' Fees
If either party commences an action against the other party, either legal,
administrative or otherwise, arising out of or in connection with this Agreement,
the prevailing party in such litigation shall be entitled to have and recover from

the losing party all of its attorneys' fees and other costs incurred in connection
therewith.
22.0 Exhibits
All exhibits referenced in this Agreement are hereby incorporated into the
Agreement as if set forth in full herein. In the event of any material discrepancy
between the terms of any exhibit so incorporated and the terms of this
Agreement, the terms of this Agreement shall control.
23.0 Corporate Authority
The person executing this Agreement on behalf of Consultant warrants that he or
she is duly authorized to execute this Agreement on behalf of said Party and that
by his or her execution, the Consultant is formally bound to the provisions of this
Agreement.
IN WITNESS WHEREOF, the Parties hereto, through their respective authorized
representatives have executed this Agreement as of the date and year first
above written.

Eisenhower Park is a special public space for your residents and for visitors to Seal Beach. The green
space, the walkways, the views, the pier and access to the parking lot and play lot are all important
components of this park. Better pedestrian access to parking lots and the playground from Ocean
Avenue are needed improvements. The replacement of the play equipment and lighting upgrades to the
parking lots are also important elements of this improvement project. David Volz Design will put forward
creative and thoughtful concept plans that highlight solutions that fit the character and importance of
this public space. We will draw inspiration from the existing site conditions and the new memorial and
walkway we designed for this park last year.
DVD has a resume of hundreds of outstanding park designs including several beach adjacent projects.
We have identified in this proposal several recent and ongoing projects for you to review. We have
tailored our proven community- inspired design program for this planning process and your community.
DVD will deliver a comprehensive access and refurbishment plan that brings forward the community
consensus and that will meet the expectations of your civic leaders. As you review our expertise and

EXPERIENCE ON SIMILAR PROJECTS — DVD has been commissioned
to lead hundreds of public park planning projects. This body of work has
resulted in accolades from community groups and design awards. The
public projects we have been working on recently include: refurbishment
of four parks for Irvine, the design of two parks in Lawndale, a new park in
Anaheim, four parks in Lynwood, San Juan Capistrano's Los Rios Park, a
new sports complex in Stanton, a new park in Diamond Bar, and beautiful
new pathways, infrastructure and gardens for South Gate's community
center park. Also, the City of Long Beach recently opened the DVD designed
Admiral Kidd Park. This park was a featured stop on the CPRS Park
Operations Tour.
QUALIFICATIONS OF THE DESIGN TEAM - I, David Volz, will lead the
design input process. My firm has specialized in the delivery of public
projects including dozens of CPRS Award- winning parks. Mr. Gary Vasquez,
DVD's Director of Design, will provide the creative flair that

4. RESPONSE TO THE PROJECT CHALLENGES - The design expertise
required for this important park improvement project is matched by DVD's
offerings in this proposal. Our team has carefully reviewed the site, identified
development opportunities and provided, in this proposal, a proven
strategy for developing a community inspired program to refurbish and
upgrade Eisenhower Park. Park planning is our passion and we will provide
outstanding service on this important commission.
David Volz Design has a very creative park planning team, we have designed hundreds of community
parks and public landscapes. Our desire to be Seal Beach's design partner for the development of the

David Volz Design (DVD) is committed to the creative

DVD is proud of our many completed projects and our reputation in
public sector work. In fact, we have specifically limited our business to
include only public agency clients! Our public works portfolio includes
thousands of projects from city wide park master plans to construction
documents for multi - million dollar sports complexes. The following
projects are just a few examples of the facilities we have recently
designed. As you will see, parks and green spaces designed by our
firm have received awards and accolades from community groups,
civic organizations, the California Parks and Recreation Society,
American Public Works Association, Southern California Municipal
Athletic Association and several other state and national organizations.
We currently provide dozens of cities in Southern California with on-
call and on staff services. We are active and supporting members of
several professional organizations. Below is a sampling of our recent
experience which demonstrates our expertise and experience.
EL CARISO REGIONAL PARK
County of Los Angeles
The new facilities now attract more than a million visitors to the park each
year. Soccer, handball, basketball and football enthusiasts stream to the park
to enjoy the weeknight and weekend competition. The play area includes a
wide variety of play opportunities, from simple sand and water - filling activities
for the youngest or those who need to work on motor skill development,
to those which challenge the body and encourage movement. All can be
enjoyed by both the able- bodied and those who face challenges in that
area. El Cariso is now used well by families into the evenings, as it feels so
much more secure. Walkways are now well lit as enhanced pathway lighting
illuminates the paths around the play structures and throughout the park,
allowing for peaceful evening strolls. A security camera system was discreetly
installed, monitoring all activity areas to ward off misdeeds. Special designed
handball courts provide playability while allowing security personnel visual
access into the playable spaces. This was achieved by using perforated metal
side walls instead of traditional solid side walls. Water use has been greatly
reduced through the removal of large swaths of under utilized turf grass and
the inclusion of new low -water use plantings. Residents are meeting each
other for the first time through special events, sporting events, and recreation
programs that are strengthening the community image and defining a new
Sylmar.

MARYLAND AVENUE PARK

This special park is one of the hundred parks funded through the state
competitive grant program Proposition 84. Maryland Avenue Park
is located in the historic Tropico District The design team conducted
extensive community outreach to develop a park program including
opportunities for public art, historical and educational interpretive
pieces, and a partnership with the local grade school to co- manage a
neighborhood garden. Murals depicting historic Tropico fruit box labels,
plaques with history lessons, and beautiful artistic metal gates adorn the
new park. Built -in benches along a central boardwalk, an exercise area
with workout stations, a picnic pavilion, and a raised bed community
garden offer a great breadth of uses for this high - density, multi- ethnic
neighborhood tract. Neighbors of the community are meeting each other
for the first ti me in this wonderful park strengthening the community image
and defining a new Tropico District in the City of Glendale. Residents feel
safe with the park's beautiful entry gate and energy- efficient night lighting.
Environmental conservation practices are demonstrated in this half -acre
space. The formerly flat site has been graded to enhance visual interest
and guide water run -off to the new storm water collection basin below
the central boardwalk. Drought - tolerant plantings and sophisticated
irrigation systems keep the park's water use low despite the small patch
of luxurious grass.

DAVID VOLZ DESIGN PROJECT EXPERIENCE
SOUTH GATE PARK
City of South Gate
South Gate Park underwent a multi -year $5 million update to existing
facilities, installed new facilities, and incorporate unifying design
elements to make this park a great community asset. A main focus of this
beautification project was to improve the circulation of the park. Now,
the park entry ways, vehicle parking areas and recreational facilities are
connected by a 16 ft. wide grand promenade that is a visually striking
amenity paved with beautiful colored interlocking stone that weaves
through stately mature trees. A new exercise trail surfaced with golden -
colored decomposed granite meanders off the main promenade for
walking and jogging. Public art, a band shelter, picnic spaces, volleyball
courts, and restrooms were installed. New plazas and gardens at the
auditorium, and the entrances of both the sports center and the natatorium
are welcoming outdoor spaces. Sustainability measures designed into
the improvements include a reduction of energy use with the park's newly
updated energy- efficient light fixtures. Water conservation practices
are achieved with the new planting choices and irrigation design. The
enhancements have turned this much used recreation space into a more
attractive, safer park for the citizens of South Gate.

ADMIRAL KIDD PARK
City of Long Beach
In 2011, the City of Long Beach rededicated the newly renovated and
expanded Admiral Kidd Park. The park, which is named after Naval Rear
Admiral Isaac C. Kidd, features two play structures themed after two
naval destroyers which carried Admiral Kidd's namesake. A perimeter
trail connects the park's amenities, which include themed raised planter
areas and iconic tile in stone pilasters. This trail allows park visitors to
circumvent the park in a beautiful setting either on bikes or walking and
the pilasters frame the view into the park and draw inspiration from the
community's "plaza" vision forthe park. Designed with maintenance and
operational costs in mind, the existing irrigation system was expanded
and upgraded utilizing the city's existing standard smart controllers. In
addition, Admiral Kidd demonstrates a beautiful design approach to
storm water management. The undulating arroyos (bio - swales) move
like water through the park even when they are dry. This bio - swales
system collects and cleans water before it is allowed to percolate or
run -off from the site. The native trees, shrubs and meadow grasses
reminiscent of a riparian creek add to the character of the park.

LOS RIOS PARK
City of San Juan Capistrano
Located in the heart of San Juan Capistrano's Los Rios Historic District,
the Los Rios Park and on -site Montanez Adobe offers a centralized
location for visitors to enjoy the park's facilities. The Montanez Adobe
dates back to 1795 and is considered the oldest adobe in the Los Rios
Historic District. Because of its historic value, all excavation required a
certified archeologist to be on -site. An artfully designed Historic Depiction
Program Wall functions as an outdoor public gallery displaying 13
bronze plaques. The selection of construction materials complements
the architectural style of the historic district. Understanding the needs
and concerns of the community and the City, the design team created a
new park that looked old by blending in with its surroundings. A passive
park with walking trails, equestrian trails, a small tot lot, picnic area and
open "pasture- was created. As a LEED Accredited firm, the design team
used creative ways to implement environmentally sound standards to the
grounds and buildings. The spaces within the park balance recreation
for individuals and families and serves as an extension of the downtown
area. Los Rios Park is well themed to harmonize the tradition of the City
with outdoor activities that draw people in to experience its natural beauty
while promoting interest in exploring this historical area.

DAVID VOLZ, Principal in Charge, has over 30 years
of experience in the design of successful public
landscapes, streetscapes and parks. He has managed
public design projects including the master planning,
design, and construction of municipal projects for
more than 100 public agencies in California.
Mr. Volz has a broad base of experience focused in
the development process from inception through
master plan development, construction document
preparation, contract administration, and on -site
inspection. His extensive knowledge of landscaping
materials and vegetation is often called for at
commission meetings and in council reports for
agencies he has served. He has comprehensive
experience in storm water treatments, habitat
restoration, walking trails and water conservation.
He has an excellent reputation for facilitating
community outreach programs for park design
through the public input process. The public
workshop process for park design is a concept that
he always encourages. The opportunity to get first

PROJECT MANAGER
PAUL CASSAR, Project Manager, has more than 13
years of experience in landscape architecture working
on projects for public agencies. His design expertise
ranges from recreational parks to streetscapes,
school sites, as well as city design guidelines.
A benefit to Mr. Cassar's design ability is his attention
to detail and his knowledge of playground design,
the latest construction practices and materials, ADA
accessibility concerns, and his experience in the
installation of hardscape, softscape, and irrigation
systems. He brings field investigation, research, and
communication experience to each of our projects.
Mr. Cassar has been a key figure at OVD in
coordinating design development plans and
carrying them through construction drawings. He is
known for his ability to collaborate with a variety of
clients, architects, engineers and designers and to
successfully manage projects from beginning to end.
He ensures adherence to established project
schedules and cost agreements, and monitors
production for delivery of the highest quality products
to clients. He cooperates well with staff, clients, and
agencies to create successful products and works
closely with contractors during construction. He is
typically responsible for plan checking to ensure the
successful completion and delivery of projects.
He utilized his expertise in a wide variety of projects
including the Los Rios Park in San Juan Capistrano,
Balboa Boulevard in Newport Beach and El Cariso
Regional Park in the County of Los Angeles. In
addition, the Maryland Avenue Park he collaborated
on in Glendale won the APWA 2014 Project of the

APPROACH OF WORK
UNDERSTANDING & APPROACH
Eisenhower Park is well used and well loved. There are some
identified improvements that will make this park and the beach
parking lots more accessible, specifically 8th Street and 10th
Street pedestrian access routes. Updating and upgrading the
popular playground is also being contemplated.
The DVD team would like to reach out to the community for
ideas and to confirm the improvement strategies identified.
These elements and improvements are to be considered:
1. Playground Refurbishment
The existing play apparatus needs to be replaced
with new play pieces. Due to the confines of the tile
wall surrounding the space, compact pieces with a
constrained fall zone will be proposed. An on -site
community outreach workshop will all the DVD team
to listen to the public and gain inspirations for possible
new play apparatus. If the swing component is to be
replaced, a new small play structure will be proposed.
Our well experienced park design team will be ready to
explore a myriad of options from standard play pieces
to custom constructions. This site's close proximity to
the sea will require careful consideration due to rust and
corrosion on metal parts. DVD has designed several first
exposure play spaces and we can help refine options
and cost analysis.
The creative team at DVD will share our experiences with
catalogue and custom concrete play pieces, manufacture
rock structures for play, rope oriented climbers and artist
built configurations. Any of these possibilities could be
appropriate for this important play space.
2. The New Pedestrian Access Way at 8th Street
The current vehicular way from Ocean Avenue to the
southerly pier parking lot has a workable slope for an
adjacent pedestrian walkway. Our designers will consider
a walkway at the edge of the drive if there is sufficient
width or a walkway on the park site of the retaining wall
with an access point at the bottom of the ramp. This
second option could require a new wall configuration.
3. The New Pedestrian Access Way at 10th Street
This pedestrian access way could include a switch back
walk along the retaining wall and slope at the driveway
corner opposite the new memorial construction. The

into the park down slope. Cost and aesthetics will be
considered in the proposed solutions DVD puts forward.
Engineering for walls and grading will be prepared under
the guidance of our surrey and civil engineering partner,
DMS Engineers.
4. Lights and Undergrounding
The two beach parking lots, the kids' playground and the
new accessible walkways will all need to be lighted for
night use. DVD will work closely with our colleagues at
Design West Engineering to select appropriate energy -
wise fixtures, and maintainable fixture poles. Our design
layouts will be analyzed for light and glare control. Our
team will also prepare plans for undergrounding all
the wires and for constructing new switch gear for the
project.
The community outreach we are proposing for the Eisenhower
Park refurbishment project will provide us with insights related
to this park's current uses and the needs of the community.
The DVD team will take the ideas and inspirations received from
the community and refine the ideas into initial concept plans.
These conceptual layouts will be presented to city staff in an
idea consolidation meeting. The best ideas and solutions will
then be refined into conceptual plans for further consideration.
A commission workshop is proposed as the best forum to
review the concept plans. Plans will be presented and the ideas
reviewed. The DVD team will look for agreement on the elements
which will become a part of the final construction plans.
The final concept plans, which will be the focus of our planning
efforts, will be the culmination of the community's ideas being
honed into final graphic representation of the best development
strategy forth is park site. A preliminary construction budgetwill be
prepared and the finalized concept plans will then be packaged
and presented to the Parks and Recreation Commission.

Water resources are conserved through our thoughtful low wa-
ter use planting schemes, precise irrigation layout and control
systems, as well as, stormwater capture, cleaning and reuse. For
pollution prevention, best practices stormwater recycling plans
are embraced and integral to our designs. On site water deten-
tion, bio filtration, permeable pavement, and many other mea-
sures are creatively incorporated into the landscapes we design.
Our award - winning design of Rancho Mirage City Hall has been
recently highlighted by the Sustainable Sites Initiative. David
Volz Design is proud to have been chosen for this honor. The
Sustainable Sites Initiative is an interdisciplinary effort by the

With over a decade of electrical design and project management experience prior to joining Design
West in 2005, Leo Maya has worked on a wide array of projects including large commercial and
industrial buildings, health care and institutional facilities, sports field lighting street and area
lighting, golf course electrical systems, custom residences, and various dry utility designs. In
2009, Mr. Maya took over the responsibility of running the electrical production. Apart from
standard electrical and lighting design, he oversees the electrical BIM design team; solar
photovoltaic design; specialized analyses including arc flash, coordination studies and load flow
evaluation; all low voltage applications including fire alarm, security, data and signal, and A/V
systems. His continuing education in the field of the electrical engineering and lighting design,

would be happy to discuss the services and fees proposed to ensure we meet Seal Beach's expectations.
2. Engineering and survey services will be provided if needed. Final scope and fee for engineering and survey to
be determined as project progress.
3. Reimbursables, subconsultant fees, printing, postage, delivery, etc. will be billed at cost plus 15%.
4. Time and materials items will be billed at DVD's current hourly rate schedule.
