THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE' SectIOn 1 On January 8, 2007, John MehIgan, on behalf of PaCIfic Gateway Retml, LLC (the "ApplIcant") filed an applIcatIOn WIth the Department of Development ServIces for CondItIonal Use PermIt 07-3 for patIO seatmg, a drIve through WIndow, and 24-hour bUSIness operatIOn In conJunctIOn WIth a Starbuck's Coffee Shop to be located In the PaCIfic Gateway Plaza retaIl development The InItIal operatIng hours are requested to be 5 AM to 11 PM Monday-Thursday, 5 AM to mIdnIght FrIday and Saturday, and 6 AM to 11 PM on Sunday SectIOn 2 Pursuant to 14 CalIfornia Code of RegulatIOns S 15305 and SII(B) of the CIty'S Local CEQA GUIdelInes, staff has determIned as follows the applIcatIOn for CUP 04-1 for the proposed 24-hour bUSIness operatIon, outdoor seatIng area, and drIve-through WIndow IS categorIcally exempt from reVIew pursuant to the CalIfornia EnVIronmental QualIty Act pursuant to 14 CalIfornia Code of RegulatIons S15301 (MInor AlteratIons m Land Use LImItatIOns), because the proposal Involves a neglIgIble expanSIOn of an eXIstmg use, pursuant to ~ 15305 (Mmor AlteratIOns m Land Use CondItIonal Use PermIt 05-12 In 2005 The SIte Plan ReVIew Included the proposed locatIOn for the drIve-through faCIlIty The CondItIOnal Use PermIt approved the hotel portIOn of the proJect (t) The 28-2504 of the CIty'S Code, the Plannmg CommIssIOn makes the follOWIng findmgs (a) CondItIonal Use 07-3 IS conSIstent WIth the provlSlons of the Land Use Element of the CIty'S General Plan, whIch prOVIdes a "LIght IndustrIal" zOnIng desIgnatIOn for the subJect property The subJect property IS further controlled by the adopted "Boemg Integrated Defense Systems SpeCIfic Plan", and IS located In applIcant/operator to mItIgate the nOIse level to comply WIth the proVISIOns of Chapter 7 15 11 ThIS CUP shall not become effectIve for any purpose unless/untIl a CIty "Acceptance of CondItIons" form has been SIgned by the applIcant m the presence of the DIrector of Development ServIces, or notarIzed and returned to the PlannIng Department, and untIl the 10 calendar-day appeal penod has elapsed 12 all tImes a drIve-through orderIng system whIch shall be approved by of the DIrector of Development ServIces ThIS drIve through operatIng system shall be approved consIderIng all potentIal effects by the system Includmg, but not lImIted to, nOIse and potentIal for graffitI 16 The term of thIS permIt shall be 12 months, begInnIng the first day of operatIOn of the busIness operatIOn At the end of the InItIal term, the applIcant may apply to the CIty for an IndefinIte extensIOn The PlannIng CommIssIOn may grant an extensIOn as dIscussed above, provIded that all CondItIons of Approval have been met and no SIgnIficant polIce or other problems have occurred The applIcant IS hereby adVIsed that a new applIcatIOn and accompanymg fee must be submItted to the City prIor to conSIderatIOn of any extensIOns 17 If any claIm, actIOn or proceedmg (collectIvely "actIOn") IS InstItuted by a thIrd party or partIes challengmg the valIdIty of the thIS approval, Developer and City shall cooperate In defendIng any such action CIty shall notIfy Developer of any such actIOn agaInst CIty WIthm ten workmg days after CIty receIves serVIce of process, except for any petItIon for mJunctIve relIef, m whIch case CIty shall notIfy Developer ImmedIately upon receIpt of notIce thereof Developer shall Indenllllfy, hold harmless and defend CIty, and any of ItS officers, employees or agents for any
