Chair Cummings called the regular meeting of the Planning Commission to order
at 7:00 p.m. in the City Council Chambers and Commissioner Thomas led the
Salute to the Flag.
ROLL CALL
Present: Commissioners: Machen, Cummings, Thomas, Campbell, Klinger

APPROVAL OF AGENDA
With no objections, Chair Cummings so ordered the approval of the agenda, as
presented.
ORAL COMMUNICATIONS
Bruce Boehm expressed concerns of parking in town and suggested that parking
permits be obtained for residential buildings. There being no other speakers,
Chair Cummings declared oral communications closed.
CONSENT CALENDAR
1. Approve the Planning Commission Meeting Minutes of October 5, 2015.
Motion by Campbell, second by Thomas to approve the Planning Commission
Meeting Minutes as presented.

PUBLIC HEARINGS
2. Conditional Use Permit (CUP) 15 -8
1041 Pacific Coast Highway
Applicant: Joseph Barbara
Property Owner: Columbia Regency Retail Partners, LLC
Request: Conditional Use Permit 15 -8 requesting to allow a restaurant
to serve beer and wine with a Type 41 (On -Sale Beer and
Wine) alcohol license within the General Commercial (GC)
zoning area.
Recommendation: Staff recommends that the Planning Commission continue
CUP 15 -8 to the meeting of November 16, 2015, as
requested by the applicant on October 27, 2015.
Motion by Cummings, second by Klinger, to approve the applicant's request to
continue this public hearing matter to the November 16, 2015 Planning
Commission meeting.

3. Variance (VAR) 15 -1 & Minor Use Permit (MUP) 15 -13
131 14th Street
Applicant: Bruce Boehm
Request: Variance (VAR 15 -1) to permit a reduction of the required
front yard setback on a rectangular shaped lot and request
for Minor Use Permit (MUP15 -13) to allow the enlargement
of two front entry doors and reconfiguration of the front
exterior stairway at an existing multi -unit residential property
that is nonconforming due to parking, density and front yard
setback located within the Residential High Density (RHD-
20) zoning.
Recommendation: After conducting the Public Hearing, staff recommends that
the Planning Commission adopt Resolution No. 15 -25,
DENYING Variance 15 -1 and Minor Use Permit 15 -13.
Director Basham introduced the matter and Assistant Planner Fowler provided a
PowerPoint presentation and summarized information provided in the staff report.
He provided information on the site description, environmental assessment, and
staff analysis. Mr. Fowler noted that the applicant's requested staircase
relocation will not be consistent with surrounding properties and will not comply

with all development standards required by the Seal Beach Municipal Code. He
stated that no written responses were received after the noticing process,
however, the City received one phone call opposing the requested variance. He
then stated staff's recommendation was to conduct the Public Hearing, then
adopt Resolution No. 15 -25, denying Variance 15 -1 and Minor Use Permit 15 -13.
There was Planning Commission discussion regarding various potential stairwell
configurations, location of the front door and set back requirements.
Chair Cummings opened the Public Hearing. Speaker: Applicant Bruce Boehm
provided a brief history of the building and noted that his request is to bring the
stairwell to current building code standards. He then expressed that he would
like to build the stairs pursuant to the submitted design and his opposition to
staffs recommendation. There being no further requests to speak, Chair
Cummings closed the Public Hearing.
Motion by Klinger, second by Cummings, to adopt Resolution No. 15 -25, denying
Variance 15 -1 and Minor Use Permit 15 -13.

City Attorney Craig Steele stated that the Planning Commission's action is final
and that the appeal period begins tomorrow.
DIRECTOR'S REPORT
Director of Community Development Jim Basham welcomed newly appointed
City Clerk Robin Roberts.
COMMISSION CONCERNS
There were no concerns reported.
ADJOURNMENT
With no objections, Chair Cummings adjourned the Planning Commission
meeting at 7:45 p.m.
