HomeMy WebLinkAboutPC Min 2015-12-07City of Seal Beach — Planning Commission December 7, 2015 Chair Cummings called the regular meeting of the Planning Commission to order at 7:00 p.m. in the City Council Chambers and Commissioner Machen led the Salute to the Flag. ROLL CALL Present: Commissioners: Machen, Cummings, Thomas, Campbell, Klinger Staff Present: Jim Basham, Director of Community Development Amy Greyson, Assistant City Attorney Crystal Landavazo, Senior Planner Steven Fowler, Assistant Planner Robin Roberts, City Clerk APPROVAL OF AGENDA With no objections, Chair Cummings so ordered the approval of the agenda as presented. ORAL COMMUNICATIONS JoAnn Adams of Bogart's Coffee House expressed appreciation for the work provided by Seal Beach staff for their efforts regarding proposed Zoning Text Amendment 15 -1. She then stated her support of removing the reference of ambient noise from the amendment. There being no further requests to speak, Chair Cummings closed oral communications. CONSENT CALENDAR 1. Approval of Planning Commission Meeting Minutes from November 2, 2015 and November 16, 2015. Motion by Campbell, second by Machen, to approve the November 2, 2015 minutes as submitted. AYES: Machen, Cummings, Thomas, Campbell, Klinger NOES: None Motion carried Motion by Campbell, second by Thomas, to approve the November 16, 2015 minutes as submitted. AYES: Machen, Cummings, Thomas, Campbell, Klinger NOES: None Motion carried Page 2 — Planning Commission 12/7/2015 NEW BUSINESS 2. Minor Use Permit (MUP) 15 -15 1190 Pacific Coast Highway Suite D Applicant: Scott Levitt Request: Minor Use Permit (MUP15 -15) to allow an animal hospital to operate in a commercial suite located at 1190 Pacific Coast Highway, Suite D within the General Commercial (GC) zoning area. Recommendation: After reviewing the application, staff recommends that the Planning Commission adopt Resolution No. 15 -28, Approving Minor Use Permit 15 -15 and Approving a Categorical Exemption under CEQA in connection therewith. Senior Planner Crystal Landavazo presented the item and summarized information provided in the staff report. She stated staff received nine letters in support of MUP- 15 -15, and that staff recommended approving the item. Chair Cummings then opened the public hearing. Applicant Scott Levitt spoke in support of the item. There being no further requests to speak, Chair Cummings closed the public hearing. Motion by Campbell, second by Machen, to adopt Resolution No. 15 -28, approving Minor Use Permit 15 -15 and approving a Categorical Exemption under CEQA in connection therewith, with amended conditions to increase interior sound proofing and included doggy dispensers at the exterior entrance. AYES: Machen, Cummings, Thomas, Campbell, Klinger NOES: None Motion carried Assistant City Attorney Amy Greyson stated that the 10 -day appeal period for this matter begins tomorrow. 3. Minor Use Permit (MUP) 15 -16 131 14th Street Applicant: Bruce Boehm Request: Minor Use Permit (MUP15 -16) to allow the enlargement of two front entry doors of a duplex facing 14th Street. The residential property is nonconforming due to parking, density and front yard setback located within the Residential High Density (RHD -20) zoning area. Recommendation: After reviewing the application, staff recommends that the Planning Commission adopt Resolution No. 15 -29, Page 3 — Planning Commission 12/7/2015 Approving Minor Use Permit 15 -16 and Approving a Categorical Exemption under CEQA in connection therewith. Assistant Planner Steve Fowler presented the item, providing background information on this item and summarizing the staff report. He then stated that staff recommends adopting Resolution No. 15 -29 and approving Minor Use Permit 15 -16. Chair Cummings then opened the public hearing. Applicant Bruce Boehm spoke in support of this item and requested that the City make changes to the municipal code regarding the permit process for residential door replacement. There being no further requests to speak, Chair Cummings closed the public hearing. Commissioner Thomas thanked the applicant for his diligence in following the prescribed permitting process. Motion by Machen, second by Thomas, to adopt Resolution No. 15 -29, approving Minor Use Permit 15 -16 and approving a Categorical Exemption under CEQA in connection therewith. AYES: Machen, Cummings, Thomas, Campbell, Klinger NOES: None Motion carried Assistant City Attorney Amy Greyson stated that the 10 -day appeal period for this matter begins tomorrow. PUBLIC HEARING 4. Conditional Use Permit (CUP) 15 -5 12240 Seal Beach Boulevard Applicant: Ulises Araujo Request: Conditional Use Permit 15 -5 requesting to replace an existing 802 sq. ft. carwash, existing vacuums and 2 gasoline pump dispensers with a new 3,004 sq. ft. automated self - served carwash with new vacuum hoses in conjunction with an existing gasoline station and mini -mart in the General Commercial (GC) zoning area. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 15 -30, Approving Conditional Use Permit 15 -5 and a Categorical Exemption in connection therewith. Assistant Planner Steve Fowler presented the item and provided a PowerPoint presentation. The presentation included information regarding the existing conditions, proposed changes, noise mitigation efforts, traffic impacts, aesthetic Page 4 — Planning Commission 12/7/2015 improvements and addressed refuse concerns. He then stated that there was one letter of opposition of the item. In conclusion, Mr. Fowler stated that staff recommends that the Planning Commission conduct a public hearing and adopt Resolution No. 15 -30, approving Conditional Use Permit 15 -5 and a Categorical Exemption in connection therewith. Chair Cummings then opened the public hearing. Speakers: Assembly Member Travis Allen's representative Mr. Nguyen spoke in support of this item noting the economic value to the community. Kim Carasso thanked the applicant for the high level of community outreach and requested additional setback footage, changing the existing trees, and conditions regarding refuse. David Cordero, Community Outreach Coordinator for the applicant provided additional information regarding concerns raised by the Commission and Ms. Carasso. There was discussion regarding concerns of attendant service versus self - service, hazardous material storage and hours of operation. There were no further requests to speak. Motion by Thomas, second by Klinger to continue the Public Hearing to the January 4, 2016 Planning Commission meeting. AYES: Machen, Cummings, Thomas, Campbell, Klinger NOES: None Motion carried PUBLIC WORKSHOP 5. Zone Text Amendment (ZTA) 15 -1 Citywide Applicant: City of Seal Beach Request: An amendment to Title 11: Zoning of the City of Seal Beach Municipal Code regarding allowable incidental business activities. The amendment relates to existing rules and procedures governing amplified and unamplified entertainment as an incidental business activity. Recommendation: That the Planning Commission receive and file the report. Director of Community Development Jim Basham introduced the item and provided a PowerPoint presentation titled "Incidental Entertainment Permit Review and Permit Issuance Procedure Workshop." Director Basham explained that the City Council has asked that the Planning Commission review specific components of the proposed ordinance and provide feedback. He then reviewed the application of the proposed ordinance including allowable incidental business activities, incidental entertainment permit requirements, required findings for approval of incidental entertainment permits, compliance with operational standards, entertainment restrictions and the entertainment permit annual Page 5 — Planning Commission 12/7/2015 renewal process. Director Basham stated that Council requested feedback to the following questions: Should the City require a single individual providing incidental entertainment to obtain an Incidental Entertainment Permit through the public hearing process; should the City allow "ambient music" or prerecorded music broadcast or played inside a business or the commercial use without an Incidental Entertainment Permit and should prerecorded music continue to be subject to the City's noise ordinances; should the City include a noise standard performance level when commercial uses are adjacent to residential areas or other sensitive uses; and should the annual renewal deadline provisions be made less restrictive or allow one -year renewals without the public hearing process. During Director Basham's presentation there was general feedback regarding each posed questions. Vice Chair Machen noted, that though not addressed specifically in the presentation, she would like to add to the recommendation to Council that the proposed ordinance be enforced by staff. Chair Cummings noted the conclusion of the workshop. DIRECTOR'S REPORT Director Basham wished everyone a Merry Christmas and Happy New Year. COMMISSION CONCERNS There were no Commissioner concerns.
