HomeMy WebLinkAboutPC Min 2016-01-04I� City of Seal Beach — Planning Commission January 4, 2016 Chair Cummings called the regular meeting of the Planning Commission to order at 7:00 p.m. in the City Council Chambers and Commissioner Thomas led the Salute to the Flag. ROLL CALL Present: Commissioners: Machen, Cummings, Thomas, Campbell, Klinger Staff Present: Jim Basham, Director of Community Development Amy Greyson, Assistant City Attorney Crystal Landavazo, Senior Planner Steven Fowler, Assistant Planner Robin Roberts, City Clerk APPROVAL OF AGENDA With no objections, Chair Cummings so ordered the approval of the agenda as presented. ORAL COMMUNICATIONS Chair Cummings opened oral communications. Speakers: None. There being no one present to speak, Chair Cummings closed oral communications. CONSENT CALENDAR There were no consent calendar Items. NEW BUSINESS There was no new business items. CONTINUED PUBLIC HEARING (Continued from December 7, 2015) 1. Conditional Use Permit (CUP) 15 -5 12240 Seal Beach Boulevard Applicant: Ulises Araujo Request: Conditional Use Permit 15 -5 requesting to remove two gasoline pump nozzles and replace an existing 802 sq. ft. carwash and existing vacuums with a new 3,004 sq. ft. automated self -served carwash with new vacuum hoses in conjunction with an existing gasoline station and mini -mart in the General Commercial (GC) zoning area. Page 2 — Planning Commission 1/4/2016 Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 15 -30, Approving Conditional Use Permit 15 -5 and a Categorical Exemption in connection therewith. Assistant Planner Steve Fowler presented the item and provided a PowerPoint presentation. The presentation included information regarding the existing conditions, proposed changes, and amended conditions based on feedback from the December 7, 2015 Planning Commission Public Hearing, and further discussion with the property owner and resident Kim Carasso. At the conclusion of his presentation he stated staff's recommendation to conduct the continued Public Hearing and adopt Resolution No. 15 -30, approving Conditional Use Permit 15 -5 and a Categorical Exemption in connection therewith. Chair Cummings then opened the public hearing. Speakers: David Cordero, Community Outreach Coordinator for the applicant thanked the Planning Commission and planning staff for their cooperation in working on this matter. Applicant Ulises Araujo clarified that the attendant drying services will not be offered. Direct Basham stated that staff would like to add the following additional language as the last sentence to Condition 6: Additionally the attendant will be required to direct additional vehicles to the overflow lane that is located south of the gas station canopy. Further staff would like to add new Condition 23: That the gas station will be regulated by the Seal Beach Municipal Code and Resolution 15 -46, conditionally approving Conditional Use Permit 9 -98 which will remain in effect. There being no further requests to speak, Chair Cummings closed the public hearing. Motion by Campbell, second by Thomas to amend Condition 6 and add Condition 23 as read into the record and to adopt Resolution No. 15 -30, approving Conditional Use Permit 15 -5 and a Categorical Exemption in connection therewith. AYES: Machen, Cummings, Thomas, Campbell, Klinger NOES: None Motion carried PUBLIC HEARING 2. Zone Text Amendment (ZTA) 15 -4 Citywide Applicant: City of Seal Beach Request: A Zone Text Amendment (ZTA 15 -4) an ordinance of the City of Seal Beach prohibiting the cultivation of medical marijuana and commercial medical marijuana activity. Page 3 — Planning Commission 1/4/2016 Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 16 -1, to recommend that the City Council adopt the proposed Ordinance to prohibit the cultivation of marijuana in all zones. Assistant City Attorney Amy Greyson introduced the item and summarized information provided in the proposed ordinance. Ms. Greyson noted that there are no CEQA exemptions required by this action. She then discussed the legislative actions by the State of California regarding medical marijuana dispensary, cultivation and licensing, including that the City must have an ordinance adopted by March 1, 2016. There was general discussion regarding cultivation, use, and permissions of medical marijuana use. City Clerk Robin Roberts noted that Resolution 16 -1 was received as supplemental information today distributed to the Planning Commission and is available to the public. Chair Cummings then opened the public hearing. Speakers: None. There being no requests to speak, Chair Cummings closed the public hearing. Motion by Campbell, second by Klinger adopt Resolution No. 16 -1, to recommend that the City Council adopt the proposed Ordinance to prohibit the cultivation of marijuana in all zones. AYES: Machen, Cummings, Thomas, Campbell, Klinger NOES: None Motion carried DIRECTOR'S REPORT Director of Community Development Jim Basham wished everyone a Happy New Year. COMMISSION CONCERNS Commissioner Thomas noted that he will be out of town on February 1, 2016. Commissioner Klinger noted that she would be out of town on February 1, 2016. Chair Cummings would be out of town on February 15, 2016.
