Subject: REVISED March 14, 2015, Agenda Item B - Approval of City Council Minutes
Robin,
I revised the email I provided to you last night. I had failed to mention Municipal Code Section 3.25.020 and that I
provided the City Council with copies of the Resolutions and Municipal Code. Below are revised proposed revisions to the
Minutes of the February 22, 2015, City Council meeting.

Regarding Agenda Item B, add a sentence ahead of the motion indicating: "It is anticipated in the first meeting
in May there will be further discussion of fees related to Business Licenses and Home Occupation Permits."
Regarding Agenda Item C, the reference to Resolution 6594 is incorrect it was Resolutions 5964 and 6503 that I
provided to the City Council. Resolution 6594 was in support of my position on Agenda Item B that exercising
contract extensions should come back to the City Council for approval.
Thus, I propose you restate the paragraph containing Resolutions 5964 and 6594 as follows:
"Council Member Miller expressed disappointment that staff was not presenting the item and stated concern
that emergency purchases were not in compliance with City policy, i.e., the City Manager is allowed to make
purchases up to $28,800 roughly, and if it is anything over that, the City Manager needs to bring it to the City
Council. He referenced the over $300,000 expenditure for El Nino should have came to the Council for
approval and referenced and provided the City Council with copies of Resolutions 5964 and 6503 and
Municipal Code Section 3.25.020 as examples of the requirement to establishment of an emergency within a
week (seven day). Council Member Deaton proposed the Council ask the City Manager in the future even if it
is an emergency she should bring it to us (the Council). Mayor Massa -Lavitt and Mayor Pro Tem Varipapa
agreed with Council Member Miller this should have came to the City Council for approval."

recommendation back to the City Council for contract audit services beginning with the
fiscal year that ends June 30, 2017.

C. Review of the City Documents Regarding Purchasing Authority (City Charter
Sections 107, 420, and 1010; Seal Beach Municipal Code Chapters 3.20 and
3.25; and City Council Resolutions 6384, 6405 and 6574) — Receive and file.

City Attorney Craig Steele stated that this information was brought to the City Council at
the direction of Council Member Miller.
Council Member Miller expressed disappointment that staff was not presenting the item
and stated concern that emergency purchases were not in compliance with City policy.
He referenced the procurement of leased storm drain pumps for the El Nino Storm, and
referenced Resolutions 5964 and 6503 as examples of proper purchasing procedures
and establishment of the existence of a local emergency respectively. He discussed the
amount of funds spent on the storm drain pumps to date and stated that he feels these
payments were made on a non - emergency basis.
There was general discussion regarding the emergency purchasing process,
purchasing authority, legal direction given with respect to the storm drain pumps, and
proper process for purchasing items of this nature in the future.
Mayor Massa -Lavitt stated that the report was received and filed.

Deaton moved, second by Varipapa, to approve the recommended actions on the
Consent Calendar, except for removed Items G and H.
