Ingram, City Manager FROM: Jim Basham, Interim Director of Public Works SUBJECT: AUTHORIZING SUBMITTAL OF APPLICATION FOR BEVERAGE CONTAINER RECYCLING CITY PAYMENT PROGRAM SUMMARY OF REQUEST: That the City Council adopt Resolution No. 6642 authorizing the City of Seal Beach to submit applications to CalRecyle for any and all payment programs. BACKGROUND AND ANALYSIS: The Department of Resources Recycling and Recovery (CalRecycle) administers a program that provides opportunities for beverage container recycling. The goal of this program is to reach and maintain an 80 percent recycling rate for all California refund value of beverage containers, such as aluminum, glass, plastic and bi- metal. Projects implemented by cities and counties will assist in reaching and maintaining this goal. Pursuant to Public Resources Code Section 14581(a)(3)(A) of the California Beverage Container Recycling and Litter Reduction Act, CalRecycle is distributing $10,500,000 to eligible cities and counties, specifically for beverage container recycling and litter cleanup activities. As part of the CalRecycle grant program, CalReycle requires the City to submit the attached Payment Program Resolution by June 1, 2016 or risk this year's appropriations of grant funds. ENVIRONMENTAL IMPACT: There is no environmental impact related to this item. Agenda Item G LEGAL ANALYSIS: No legal analysis is required for this item. FINANCIAL IMPACT: The City of Seal Beach participates annually in this grant program. The City applies these funds towards litter clean up, advertising, educational handouts and beverage container collections. Resolution 6642 Page 2 RESOLUTION NUMBER 6642 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL AUTHORIZING SUBMITTAL OF APPLICATION FOR PAYMENT PROGRAMS AND RELATED WHEREAS, pursuant to Public Resources Code sections 48000 et seq., 14581, and 42023.1(g), the Department of Resources Recycling and Recovery (CalRecycle) has established various payment programs to make payments to qualifying jurisdictions; and WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures governing the administration of the payment programs; and WHEREAS, CalRecycle's procedures for administering payment programs require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of the payment program. THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE: Section 1. City of Seal Beach is authorized to submit an application to CalRecycle for any and all payment programs offered; and Section 2. City Manager, or his /her designee, is hereby authorized as Signature Authority to execute all documents necessary to implement and secure payment; and, Section 3. That this authorization is effective until rescinded by the Signature Authority or this governing body.
