Ingram, City Manager SUBJECT: PROCLAMATION OF LOCAL EMERGENCY RELATING TO THE FIRE ON THE SEAL BEACH PIER SUMMARY OF REQUEST: That the City Council: 1. By 4/5 vote, add an item to the City Council agenda to consider and proclaim a local emergency under the provisions of the Seal Beach Municipal Code relating to the recent fire on the Seal Beach Pier; and 2. Adopt Resolution Number 6649, A RESOLUTION OF THE SEAL BEACH CITY COUNCIL PROCLAIMING A LOCAL EMERGENCY IN CONNECTION WITH THE FIRE ON THE SEAL BEACH PIER AND AUTHORIZING THE CITY MANAGER TO TAKE SUCH ACTIONS AS ARE NECESSARY TO PROTECT PUBLIC HEALTH, SAFETY AND PROPERTY AND ARE CONSISTENT WITH THE SEAL BEACH CITY CHARTER AND MUNICIPAL CODE BACKGROUND AND ANALYSIS: A major fire on the Seal Beach Pier occurred on Friday, May 20, 2016. The fire occurred after the agenda for the May 23, 2016 agenda was posted and there is a need to take a number of actions to address and repair the damage to the Pier prior to the next meeting of the City Council. Although the matter was not on tonight's posted agenda, the Brown Act permits the City Council to add an item to the posted agenda when it came to the attention of the City after the agenda was posted and there is a need to take action before the next regular meeting of the City Council. Both elements are met here and staff recommends that the City Council add the item to the agenda by at least a 4/5 vote. If the City Council adds the item to the agenda, staff also recommends that the City Council proclaim a local emergency pursuant to SBMC Section 3.25.020(A)(1) through the adoption of the attached resolution. This will give the City Manager authority to expeditiously solicit and contract for the services necessary to demolish the damaged portions of the Pier and make repairs. The Agenda Item proposed resolution requires a report on every subsequent regular meeting agenda until the emergency proclamation is rescinded by the City Council. It also requires the City Manager to separately account for and report all expenses and contracts, in case there may be state or federal funding assistance available. ENVIRONMENTAL IMPACT: Due to the emergency situation, there is no environmental required at this stage. LEGAL ANALYSIS: The City Attorney has reviewed and advised staff. FINANCIAL IMPACT: There is no financial impact related to this item. RECOMMENDATION: That the City Council add the item to the agenda by at least a 4/5 vote and adopt Resolution Number 6649.
