HomeMy WebLinkAboutCC Res 6649 2016-05-230 0 RESOLUTION NUMBER 6649 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL PROCLAIMING A LOCAL EMERGENCY IN CONNECTION WITH THE FIRE ON THE SEAL BEACH PIER AND AUTHORIZING THE CITY MANAGER TO TAKE SUCH ACTIONS AS ARE NECESSARY TO PROTECT PUBLIC HEALTH, SAFETY AND PROPERTY AND ARE CONSISTENT WITH THE SEAL BEACH CITY CHARTER AND MUNICIPAL CODE THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE: SECTION 1. On May 20, 2013 a fire broke out on the Seal Beach Pier, causing extensive structural and other damage. As a result of the damage to the Pier, the City Council hereby proclaims a local emergency pursuant to Section 3.25.020(A)(1) of the Seal Beach Municipal Code. SECTION 2. The City Council hereby authorizes the City Manager to exercise her authority as Director of Emergency Services under the provisions of the Municipal Code as such actions are necessary to protect public health, safety and property as a result of the fire and damage to the Pier, until the City Council determines that the state of local emergency no longer exists. SECTION 3. The City Council hereby authorizes and directs the City Manager to obtain and contract for those services necessary for the expeditious demolition of repair of damaged portions of the Pier without a public bidding process, as permitted by Sections 3.20.025(A) and (C) of the Seal Beach Municipal Code and Section 1010 of the Seal Beach City Charter, and to execute such contracts as are necessary on behalf of the City. SECTION 4. The actions specified herein are necessary for the urgent protection of life, health, or property. SECTION 5. The City Manager is directed to maintain a separate accounting for all costs of responding to the fire, demolishing the damaged portions of the Pier and repairing the damage. SECTION 6. The City Manager is directed to schedule a recurring agenda item at each subsequent regular meeting of the City Council for the Council to review the status and need for the local emergency and for the City Manager or her designee to report on the progress of demolition and repair efforts and contracts and expenditures to date.
