BACKGROUND:
On September 8, 2015 staff presented a draft ordinance pertaining to allowable
incidental business activities to the Planning Commission. After the presentation the
Commission recommended that noise threshold be included in the draft ordinance that
would assist the City in monitoring noise levels in conjunction with the issuance of an
incidental entertainment permit.
ANALYSIS:
The noise consultant Acoustics Group (AGI), Inc. scope of service was based upon
the City's intentions to provide a balance between the economic needs of the
businesses by offering live music and the noise sensitive residences located within
close proximity of the businesses. The study focused on Main Street to establish noise
thresholds because the majority of potential permits to conduct entertainment will
possibly occur along a three block area of Main Street. As the report analyzed and
concluded, live music on a continuous basis can become disruptive and intrusive to
sensitive receptors. AGI suggest the following noise limits for live music:
1. Live and amplified music shall be limited to the hours of 12:00 noon to 9:00
p.m., Thursday through Saturday.
2. Live and amplified music shall not exceed a maximum noise level Lmax of
50dBA when measured at any residential exterior location (front, side and
rear yard, patio and or balcony.
CONCLUSION:
Staff recommends that the Planning Commission receive and file this report along with
the recommended noise threshold.

Dear Mr. Bashim:
Acoustics Group, Inc., (AGI) has conducted a noise survey to evaluate the ambient
noise experienced within the Main Street area of Seal Beach. The following provides the
results of our survey:
INTRODUCTION
Acoustics Group, Inc., (AGI) conducted an ambient noise survey in the Main Street
area of Seal Beach from March 29 through April 14, 2016. Long term noise
measurements were conducted for a minimum of 7 continuous days to document the
ambient noise levels behind the commercial buildings on the north and south sides of
Main Street. Short term (60- minutes or less) noise measurements were conducted to
supplement the long term measurement data. Refer to Figure 1 for the project area
shaded in yellow.
NOISE
The magnitude by which noise affects its surrounding environment is measured on a
logarithmic scale in decibels (dB). Because the human ear is limited to hearing a specific
range of frequencies, the A- weighted filter system is used to form relevant results. A-
weighted sound levels are represented as dBA. Figure 2 shows typical A- weighted
exterior and interior noise levels that occur in human environments.

Several noise metrics have been developed to evaluate noise. Leq is the energy
average noise level and corresponds to a steady -state sound level that has the same
acoustical energy as the sum of all the time varying noise events. Lmax is the maximum
noise level measured during a sampling period, and Lxx are the statistical noise levels that
are exceeded xx -% of the time of the measurement. L50 is the average noise level that is
exceeded 50% of the time, 30 minutes in a 60 minute period. The one -third octave band
sound pressure level is the sound level contained within a frequency band.

NOISE ORDINANCE STANDARDS
The City of Seal Beach has adopted noise standards for regulating intrusive noise.
For residential land uses the exterior standard is an average noise level (1-50) of 55 dBA
during the daytime hours of 7:00 am to 10:00 pm and 50 dBA during the nighttime hours
of 10:00 pm to 7:00 am. For commercial land uses, the City has an exterior standard of
65 dBA at all times. For industrial, manufacturing, and oil land uses, the City has an
exterior standard of 70 dBA. The average noise level cannot be exceeded for a
cumulative period of more than 30 minutes in any hour. Higher noise levels are permitted
for shorter time durations. The maximum noise level at residential zoned properties shall
not exceed 75 dBA during the daytime and 70 dBA during the nighttime for any period of
time. Table 1 summarizes the noise standards. Refer to the Appendix for the City of Seal
Beach Noise Ordinance.

NOISE MEASUREMENTS
Noise Measurement Locations
Noise measurement locations were selected and approved by the City of Seal
Beach for the noise survey. The measurement locations are representative of typical
residential landuses that are located adjacent to commercial landuses within the Main
Street area. Table 2 summarizes the noise measurement locations selected for the
survey. Figure 3 shows the location of the noise measurement locations.

Ambient Noise Survey
AGI conducted an ambient noise survey in the Main Street area of Seal Beach
from March 29 through April 14, 2016. Bruel & Kjaer Model 2250 Precision Sound Level
Meters and Larson Davis Model 870 Precision Noise Analyzers were used to perform the
survey. For each measurement location, the noise monitor was located at the rear of the
property, adjacent to the alley. Every monitor was fitted with a weatherproof windscreen
and harness to prevent meteorological and wildlife interference. The instruments were
operated in accordance with manufacturers guidelines.
Long term ambient noise measurements were conducted at locations NM1 through
NM4 to document baseline noise levels. The measurements were conducted for a
minimum of seven (7) continuous days at each location to document the ambient noise
levels behind the commercial buildings on the north and south sides of Main Street. AGI
also conducted short term (10 -60 minute) noise measurements at locations NM1 through
NM4 to supplement the long term data. The results of the survey are presented below.

Long Term Measurements
Location NM1 - the A- weighted noise levels measured during the daytime hours
from 7:00 am to 10:00 pm ranged from a low of 38.5 dBA to a high of 71.0 dBA.
The L5o ranged from 42.5 to 48.3 dBA during the daytime and was below the City's
Noise Standard of 55 dBA. Typical noise sources experienced at NM1 during the
survey included aircraft, vehicular traffic, community noise, and wildlife (birds).
Location NM2 - the lowest A- weighted noise levels measured during the daytime
hours from 7:00 am to 10:00 pm at location NM2 ranged from 43.0 to 70.3 dBA.
The Leo ranged from 47.4 to 50.7 dBA during the daytime and was below the City's
Noise Standard of 55 dBA. Typical noise sources experienced at location NM2
included vehicular traffic, car doors, cars starting, motorcycles, door and gate
closing, car audio, community noise, dumpster, nearby mechanical equipment and
wildlife (birds). The constant noise from the nearby mechanical equipment
contributed heavily to the residual background noise experienced at this location.
Location NM3 - the lowest A- weighted noise levels measured during the daytime
hours from 7:00 am to 10:00 pm ranged from 45.2 to 71.4 dBA, respectively. The
L5o ranged from 48.2 to 49.4 dBA during the daytime and was below the City's
Noise Standard of 55 dBA. Typical noise sources experienced at NM3 included
aircraft, vehicular traffic, car doors, cars starting, community noise, dogs barking,
hammering from construction, nearby mechanical equipment and wildlife (birds).
Similar to location NM2, the constant noise from the nearby mechanical equipment
contributed heavily to the residual background noise experienced at this location.
Location NM4 - the lowest A- weighted noise levels measured during the daytime
hours from 7:00 am to 10:00 pm ranged from 39.6 to 73.1 dBA, respectively. The
L5o ranged from 42.9 to 48.7 dBA during the daytime and was below the City's
Noise Standard of 55 dBA. Typical noise sources experienced at location NM4
included aircraft, vehicular traffic, community noise, wildlife (birds) and noise from
business operations.
Tables 3 through 6 summarize the continuous Maximum, Minimum and Average
noise levels measured during the Long Term Noise Survey. Figures 4 through 7 provide
graphical plots of the Long Term Noise Data to show the diurnal noise pattern. Refer to
the Appendix for the field data sheets.

Short Term Measurements
Location NM1 -the A- weighted noise levels measured during the short term survey
on April 1, 2016 ranged from 40.4 to 87.4 dBA with an L50 of 45.9 dBA. Typical
noise sources experienced at location NM1 during the survey included aircraft,
vehicular traffic, pedestrians talking, and wildlife (birds).
Location NM2 - the A- weighted noise levels measured during the short term survey
on April 1, 2016 ranged from 48.2 to 74.2 dBA with an L50 of 50.9 dBA. Typical
noise sources experienced at location NM2 during the survey included vehicular
traffic, motorcycles, pedestrians talking, skateboarders, aircraft, wildlife (birds) and
nearby mechanical equipment. The constant noise from the nearby mechanical
equipment contributed heavily to the residual background noise experienced at
this location.
Location NM2A — because the ambient noise environment at location NM2 is
dominated by the nearby commercial mechanical equipment, an additional noise
measurement location was selected to represent this area. The A- weighted noise
levels measured during the short term survey on April 4, 2016 ranged from 42.1 to
67.6 dBA with an L50 of 47.3 dBA. Typical noise sources experienced at location
NM2 during the survey included vehicular traffic, aircraft, birds, pedestrians talking,
hammering from construction and trees rusting from the wind.
Location NM3 - the A- weighted noise level measured during the short term survey
on April 12, 2016 ranged from 46.3 to 72.2 dBA with an L50 of 49.1 dBA. Typical
noise sources experienced at location NM3 during the survey included pedestrians
talking, vehicular traffic, aircraft, refuse collection, skateboarders, siren, bicyclists
and nearby mechanical equipment. The constant noise from the nearby
mechanical equipment contributed heavily to the residual background noise
experienced at this location.
Location NM4 -the A- weighted noise levels measured during the short term survey
on April 12, 2016 ranged from 43.5 to 75.9 dBA with an L50 of 47.8 dBA. Typical
noise sources experienced at location NM4 during the evening survey included
birds, vehicular traffic, pedestrians talking, grinding from construction,
skateboarders, bicyclists and aircraft.

FINDINGS AND ASSESSMENT
The measured daytime ambient A- weighted noise levels within the Main Street
area ranged from a low of 38.5 dBA to a high of 73.1 dBA. The daytime L50 ranged from
a low of 42.5 to a high of 50.7 dBA and was below the City's Noise Standard of 55 dBA.
Location NMI was the quietest location because it was located away from commercial
businesses with operating mechanical equipment such as fans, air conditioning
condensers or refrigeration units. The ambient noise level at Locations NM2, NM3 and
NM4 included the influence of mechanical equipment and were subsequently higher than
Location NMI. Location NM4 was also affected by retail customers entering and exiting
the property.
Although the ambient background noise at NM2, NM3 and NM4 were influenced
by nearby mechanical equipment and or commercial operations, the ambient background
noise would be expected to be noticeably lower as little as two to three properties next
door. The lowest daytime ambient A- weighted noise level of 38.5 dBA is representative
of the low range of ambient noise at residential properties adjacent to Main Street. Noise
levels at the ground floor could be expected to be approximately 3 to 5 dB lower than
second floor locations.

CONCLUSION
AGI has conducted an ambient noise survey in the Main Street area of the City of
Seal Beach, CA. The measurement data indicates that existing noise levels are typical
of a residential zone abutting a commercial zone with some sporadic mixed uses. The
measurement data is within the City's Noise Standards for residential landuses and is
representative of the range of noise levels within the Main Street area.

Dear Mr. Bashim:
Acoustics Group, Inc., (AGI) has reviewed the referenced report, the existing City
of Seal Beach Noise Ordinance and discussed noise goals with staff members of the
City's Community Department. AGI understands the City's desire to balance the needs
of businesses in the Main Street area wanting to offer live music and the noise sensitive
residences located adjacent to the businesses. Live music on a continuous basis,
especially low frequency noise from sub - woofers, can become disruptive and intrusive to
residences. Therefore, AGI suggests the following noise limits for live music in the Main
Street area:
1. Live and or amplified music shall be limited to the hours of 12.00 pm to 9:00
pm, Thursday through Saturday.
2. Live and or amplified music shall not exceed a maximum noise level, Lmax,
of 50 dBA when measured at any residential exterior location (e.g., rear yard,
front yard, side yard, patio and or above ground balcony).
3. Low frequency noise from live and or amplified music shall not exceed an
Un- Weighted sound level of 50 dB at any discreet frequency between 1 to

Suggested Noise Thresholds for the City of Seal Beach, CA �i
100 Hz, at any residential exterior location (e.g., rear yard, front yard, side
yard, patio and or above ground balcony) when measured using One -third
octave band filters. If the ambient sound level at any discreet frequency
between 1 to 100 Hz exceeds 50 dB, then the ambient shall become the
standard for that frequency band.
Furthermore, it is recommended that the live music be evaluated on a trial basis for a two -
week period with simultaneous noise monitoring and noise limit enforcement.
