A RESOLUTION OF THE CITY COUNCIL OF TIlE CITY
OF SEAL BEACH, CALIFORNIA, RULING ON
OIJJECTIONS, DECLAIUNG ITS CONSENT TO A
PROJ'OSED INCREASE IN TREE TRIMMING FEES, AND
ORDERING SUBMllTAL OF A MEASURE
AUTHORIZING THE PROPOSED INCREASE TO A VOTE
OF THE AFFECTED LANDOWNERS
WHEREAS, the City Council of the City of Seal Beach, California, previously adopted
Ordinance Number 1273 adding Chapter 22A to the Seal Deach Municipal Code;
and,
WHEREAS, Chapter 22A authorizes the City Council to establish and fix charges and fees for
community services such as tree trimming fees; and,
WHEI{EAS, based on the authority provided by Chapter 22A, the City Council previously
adopted Resolution Number 3788 establishing monthly charges for street
sweeping and tree trimming services in the City; and,
WHEREAS, the tree trimming services currently provided by the City include only tree
trimming; and,
WHEREAS, the tree trimming fees collected pursuant to Resolution Number 3788 are intended
to pay for the direct costs of services furnished by the City; and,
WHEREAS, the tree trimming fees collected pursuant to Resolution Number 3788 fall short or
the actual costs of the tree trimming scrvices currently furnished by the City by
approximately thirty-five percent (35%); and,
WHEUEAS, in order to improve its infrastructure and enhance its ability to preserve the city's
urban forest, the City desires to expand the tree trimming services provided to
Include grinding as well as sidewalk and curb removal and replacement as
necessary; and,
WHEREAS, the City will incur additional costs to provide these additional tree trimming
services; and,
WlmREAS, the City lacks sufficient funds to provide tree trimming services and can not
continue to operate the tree trimming program at a deficit; and,
WHEREAS,
on August 9,2001, and August 10, 2001, notice of the proposed increase in tree
trinmling fees and of the time and place of the public hearing was mailed to each
owner of record of certain parcels ofland in the City in accordance with the
provisions of Article Xl1lD of the California Constitution and the Seal Beach
Municipal Code; and,

WHEREAS,
notice of the proposed increase in tree trimming fees and ofthc lime and place of
the public hearing was published as required by law on August 23, 2001, and
August 30, 2001; and,
WHEREAS, on September 24,2001, at the time and place set forth in the notice, the City
Council conducted a hearing on the proposed increase in tree trimming fees and
heard and considcrcd all objections and protests thereto; and
WHEREAS, at the public hearing held on September 24, 200 I, written protest by a majority of

the Iandowners was not presented. .

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES
HEREBY DETERMINE, RESOLVE AND ORDER AS FOLLOWS:
Section 1.
All of the foregoing recitals are true and correct.
Section 2. The charges proposed in Sections 4 and 5, below, do not exceed
the reasonable cost of providing trec trimming services and of making such services available.
Scction 3. The Surf.~ide Colony and Leisure World do not receive tree I
trimming services from the City and are, therefore, exempt from the fees set forth in Sections 4
and 5, below.
Scction 4. Except as provided in Section 5, below, the City Council hereby
consents to the lollowing proposed fee schedule for tree trimming charges in lhc City of Seal
Beach effective on the first day of January, 2002:

$2.08 per dwelhng per month
$1.25 per dwelling unit per month
$2.08 per water meter per month
Section 5. 5.1 The following uses shall pay a fee of two dollars and eight
cents ($2.08) per water meter per month for tree trimming services or four cents ($0,04) per
lineal footage of public street or highway frontage served by the City for tree trimming,
whichever is greater:
(a) Commercial and/or office centers zoned CO, C I, or C2 with a minimum total lot
size 00.5 acres;
(b)

Manufacturing uses;
Bixby Old Ranch Country Club;
Public and institutional uses;
Vacant properties with a minimum total lot size of2.5 acres.

5.2 The Seal Beach Trailer Park shall pay a fee of four cents ($0.04)
per lineal footage of public street or highway frontage served by the City for tree
trimming.
5.3 Multiple family projects in excess of sixty (60) units shall pay a
fee of one hundred forty-nine dollars and seventy-six cents ($149.76) per month lor tree
trimming services or four cents ($0.04) per hneal footage of public street or highway
frontage served by the City for tree trimming, whichever is greater.

5.4 The Surfside Colony and Leisure World shall be exempt from the
above fees.
Section 6. In accordance with the provisions of Section 6 of Article XmD of
the California Constitution, the City Council hereby orders that the proposed fecs set forth in
Sections 4 and 5, above, be authorized, and the following measure be submitted to a vote of the
qualified landowners of certain parcels ofJand in the City of Scal Beach:

increase tree trimming fees; prohibit the City Couucil
from increasing such fees m any fut~lre year by more
than the increase in the Consumer Price Index; and
require the City Council to hold a public hearing
prior to enacting any future increase '!
