Miller RE: Construction of LA Fitness Club Located at 12411 Seal Beach Blvd. in the Shops at Rossmoor — 60 Day Continuance Request Dear Mayor Lavin, Mayor Pro Tern Varipapa and Honorable Council Members, I am submitting the following on behalf of Seal Beach and Rossmoor residents concerned with and opposed to the LA Fitness Development located in the Shops at Rossmoor shopping center approved by Council members. This is'a formal request for a 60 -day continuance on this matter to allow for a more thorough discussion and peer review of previously unaddressed issues created by this project. This 60 -day continuance and peer review is requested on the following grounds: L Lack of Cumulative Environmental Impact Study: No study has been provided by the City or Shops at Rossmoor Property Owner that details the cumulative environmental effect created by the Shops at Rossmoor with the new LA Fitness development. Rather, modular and incremental studies have been conducted over an extended period of time to bypass CEQA review and comprehensive EIR studies. This necessitates and demands a cumulative review of a host of issues including but certainly not limited to totality of the parking available within the Shops of Rossmoor being used to satisfy the "sufficient parking" requirement for the project in question. 2. Parking Availability Study: No prior study on parking availability has addressed present day conditions, as existing today, for the Shops at Rossmoor and the impact on the surrounding Seal Beach and Rossmoor communities. An objective a study would show a greater demand for parking within the Shops at Rossmoor, for Seal Beach residents and ultimately an impact on Rossmoor created by the proposed project which must be further surveyed, studied and addressed. 3. Inadequate Traffic Studies: Respectfully, the traffic studies, provided for this project have been perfunctory, self - serving and totally inadequate. They do not reflect current reality in this area. Specifically, studies do not adequately reflect the true impact at all intersections. As example(s), at St Cloud and Seal Beach Blvd which will most definitely be used as a back way into the development; at the intersection of Rossmoor Center Way and 2750 Iroquois Ave. • Long Beach, California • 90815 PHONE: (562) 254 -8362 • (;AF.: (562) 493 -0684 • E- N -LNIL: Nlichaet@obradovitclilaw.com July 25, 2016 Page 2 of 2 Montecito Rd; at Rossmoor Center Way and Los Alamitos Blvd. Studies are also devoid of the impact on ingress of Seal Beach residents into condominiums on Montecito and Rossmoor Center Way and egress of those residents onto Rossmoor Center Way respectively at peak hours. The immediately preceding being aside from the broader impact on the ability of these residents to find parking in Seal Beach. Current conditions have not been accounted for in these studies, nor has the cumulative effect should the project be implemented. 4. Emergency Services Access: The impact of traffic congestion on access by Emergency Services are grossly unaccounted including the creation of hazardous conditions created with the proposed fire lines given current conditions. Studies for this project have assumed these fire lines will almost always be clear when in fact the fire lines overlap with the parking of delivery vehicles for the Sprouts market. This is creating potential catastrophic legal liability to both the City and the Shops of Rossmoor Owners. All studies provided as part of this project up to the date of this memo have failed to show cumulative 24x7x365 effects on traffic, noise, parking, safety and environmental impact. Again, all project studies as of the date of this memo have failed in accounting for "real life" conditions and human behavior. Based on gross shortcomings in the studies provided as part of this project as outlined above, it is submitted that appropriate due diligence for this project has not yet been completed. Lastly, it should be highlighted that prior public record requests by members of the concerned citizens group have gone unanswered by the City. Thus, in an overabundance of transparency, this memo constitutes yet another formal public record request for all CEQA Environmental review report documentation on the subject property referred to as the Shops at Rossmoor prior to the redevelopment was initiated and completed as of 2004. This public record request includes all remediation reports for said property. With the foregoing in mind, the concerned citizens group is simply requesting a 60 -day continuance so that all appropriate documentation can be reviewed and the above noted issues more fully addressed to ascertain the true impact of the LA Fitness project not only on the citizens of Seal Beach but the neighboring community of Rossmoor. For Health /Fitness Clubs (which is land use code 492) on weekdays 1 Two ways to think about volume!loading. t One relates to the street next to the gym — what is the traffic in /out of the gym when the street has the most traffic? • For morning peak hour on the adjacent street (the highest hourly traffic volume between 7 and 9 6' 'm.) you could expect 50 to 60 trips • For evening peak hour on the adjacent street (the highest hourly traffic volume between 4 and 6 p;.m.) you could expect 130 to 140 trips The other way — what is the traffic in /out of the gym during the highest traffic time for the gym? • For the morning highest volume hour in and out of the gym, you could expect between 50 and 60 trips (not many studies.related to this area) i • For the evening highest volume hour in and out of the gym, you could expect between 150 and 160 trips * Information from latest edition of Trip Generation handbook from the Institute of Transportation Engineers. * Developer's traffic engineer, Donson Liu, had numbers that were much lower. *Mr. Liu stated no one from LSA or anyone from the developer's team had done a formal traffic study regarding the proposed LA Fitness development. 7 -22 -16
