June 6, 2016
Chair Cummings called the regular meeting of the Planning Commission to order
at 7:00 p.m. in the City Council Chambers and Commissioner Klinger led the
Salute to the Flag.

APPROVAL OF AGENDA
With no objections, Chair Cummings so ordered the approval of the agenda as
presented.
ORAL COMMUNICATIONS
Chair Cummings opened oral communications. Speakers: Paul Yost expressed
concern regarding the approval process on for the building on Main Street and
PCH. There being no further requests to speak, Chair Cummings closed oral
communications.
CONSENT CALENDAR
1. Approval of Planning Commission Meeting Minutes from May 2, 2016.
Campbell moved, second by Thomas, to approve the Planning Commission
minutes of May 2, 2016.

NEW BUSINESS
2. Minor Use Permit (MUP) 16 -4
25 A Surfside Avenue
Applicant: Jose Ochoa
Request: Minor Use Permit (MUP 16 -4) to allow an extension of
an existing deck and the construction of a second floor
balcony on a single family residence that is
nonconforming due to the front yard setback and
parking in Surfside Colony, Residential Low Density
(RLD -9) zoned area.
Recommendation: After reviewing the request, staff recommends that the
Planning Commission adopt Resolution No. 16 -10,
APPROVING Minor Use Permit 16 -4 with Conditions.
Assistant Planner Steve Fowler presented the item and provided a PowerPoint
presentation. He concluded that two letters of opposition.
Commissioner Campbell inquired how the Planning Commission can approve the
Minor Use Permit if the Surfside Colony Association has not approved the
proposed project and they shouldn't approve something that is in violation of their
regulations.
Assistant Planner, Steve Fowler indicated that the CC &R's are the regulations
and are put in place by the Surfside Colony. These regulations do allow for the
proposed project and the conditions require Surfside Colony approval before the
City can issue permits.
Director Basham indicated for clarification purposes that the Municipal Code
states, home owners in the Surfside community must obtain the approval of the
Surfside Colony Homeowners Association for any additions prior to issuance of
building permits. He indicated that the Planning Commission will take action first,
pursuant to the Municipal Code, followed by approval from the Surfside Colony.
From that point forward, it's up to the Surfside Colony whether or not they will
approve it. In addition, they will need to obtain approval from the Coastal
Commission.
Vice Chair Machen expressed her concerns regarding receiving the packet
without enough time to do her due diligence onsite and ask questions prior to the
Planning Commission meeting.
At the inquiry of Commissioner Thomas, Director Basham confirmed that staff's
recommendation is to approve Resolution No. 16 -10 approving Minor Use Permit
16 -4.

Chair Cummings opened the public hearing. Speakers: The applicant, Jose
Ochoa and his wife, Brianna clarified some of the issues and indicated that
Surfside Planning Commission has already reviewed and approved the plans.
Arthur Gallucci, the applicant's neighbor spoke in opposition of the property in
discussion indicating the residents didn't get notified by the Surfside Colony
Association that they met regarding this property. James Blake, Surf Side
resident, spoke in support of the proposed deck. Tim Madino, Surfside resident,
spoke in opposition and indicated that the association should have given
residents ample time to respond and doesn't think a deck is needed. Jill Quinn,
the applicant's neighbor, supports the deck as long as the Surfside Colony
Association approves it. There being no further requests to speak, Chair
Cummings closed the public hearing.
Commissioner Thomas requested clarification from staff regarding the CEQA
process.
Assistant City Attorney Greyson indicated that should the Planning Commission
wish to continue the item, the Chair should reopen the public hearing and
continue the item.
Motion by Campbell, by Machen, to reopen and continue the public hearing for
Minor Use Permit 16 -4 to the June 20th, 2016 Planning Commission meeting.

3. Planned Sign Program (PSP) 16 -2
3010 -3030 Old Ranch Parkway
Applicant: Peter Lloyd
Request: Planned Sign Program (PSP 16 -2) a request for a
conditional use permit to modify an existing planned
signed program with regard to wayfinding and
monument signs for an office park in the General
Commercial (GC) zoned area.
Recommendation: After conducting the Public Hearing, staff recommends
that the Planning Commission adopt Resolution No. 16-
11, APPROVING a Conditional Use Permit for Planned
Sign Program (PSP 16 -2) to modify an existing planned
sign program with regard to wayfinding and monument
signs, with Conditions.

Assistant Planner Steve Fowler presented the item and provided a PowerPoint
presentation. He concluded with staff's recommendation to approve the item.
Chair Cummings opened the public hearing. Speakers: Representative for the
applicant John Bisby spoke in favor of the item and provided the Commission
clarification regarding the Sign Program. There being no further requests to
speak, Chair Cummings closed the public hearing.
There was general discussion regarding the improvements of signage provided
in the sign program and the change of the business park to The Ranch.
Motion by Thomas, second by Klinger, to approve Planned Sign Program (PSP)
16 -2.

4. Planned Sign Program (PSP) 16 -1
350 Main Street
Applicant: Eric Lenore
Request: Planned Sign Program (PSP 16 -1) a request for a
conditional use permit to establish a planned sign
program (PSP 16 -1) for a two story commercial center
in the Main Street Specific Plan (MSSP) zoned area.
Assistant Planner Steve Fowler stated that Applicant Eric Lenore requested that
this matter be continued to the June 20, 2016 Planning Commission meeting.
Chair Cummings opened the public hearing. Speakers: Applicant Eric Lenore
spoke regarding his request to continue this this matter to the June 20th, 2016
Planning Commission meeting. Paul Yost expressed concern regarding the
building on this property, however stated that he approved of the sign program.
Seth Eaker spoke in support of the Main Street Specific Plan. There being no
further requests to speak, Chair Cummings closed the public hearing.
Motion by Machen, second by Klinger, to hold open the public hearing and
continue the matter of Planned Sign Program 16 -1 to the June 20th, 2016
Planning Commission meeting.

DIRECTOR'S REPORT
Director Basham gave the Commission an update on the Pier Fire Incident and
Entertainment Ordinance process, then he provided information on items that will
be presented at the upcoming June 20th, 2016 Planning Commission meeting.
COMMISSION CONCERNS
There were no concerns from the Commission.
ADJOURNMENT
With no objections, Chair Cummings adjourned the Planning Commission
meeting to June 20, 2016 at 7:00 p.m.
