Minutes Appr ed by: Director of Cbmmunity Development City of Seal Beach — Planning Commission July 18, 2016 Chair Cummings called the regular meeting of the Planning Commission to order at 7:00 p.m. in the City Council Chambers Commissioner Machen led the Salute to the Flag. ROLL CALL Present: Commissioners: Cummings, Machen, Campbell, Klinger Absent: Thomas Staff Present: Amy Greyson, Assistant City Attorney Crystal Landavazo, Senior Planner Steven Fowler, Assistant Planner Robin Roberts, City Clerk APPROVAL OF AGENDA With no objections, Chair Cummings so ordered the approval of the agenda as presented. ORAL COMMUNICATIONS Chair Cummings opened oral communications. Speakers: None. There being no one present to speak, Chair Cummings closed oral communications. CONSENT CALENDAR 1. Approval of Planning Commission Meeting Minutes from June 20, 2016. Campbell moved, second by Machen, to approve the Planning Commission minutes of June 20, 2016. AYES: Cummings, Machen, Campbell, Klinger NOES: None ABSENT: Thomas ABSTAIN: None Motion carried NEW BUSINESS 2. Minor Use Permit (MUP) 16 -5 211 12'h Street Applicant: Hratch & Araz Ghararian Request: Minor Use Permit (MUP 16 -4) to allow the alteration of interior walls and change exterior doors in an existing four unit apartment building which is nonconforming due to density and parking in the Residential High Density (RHD -20) zoning area. Page 2 — Planning Commission 7/18/2016 Recommendation: After reviewing the request, staff recommends that the Planning Commission adopt Resolution No. 16 -14, APPROVING Minor Use Permit 16 -5 with Conditions. Vice Chair Machen recused herself from the meeting due to signing a lease within a 500 foot radius of the requested permit address. Assistant Planner Steve Fowler presented a comprehensive overview of the item including a PowerPoint presentation. He read the following correction to Resolution No. 16 -14 on page 1 of 4, letter C, 3`d sentence should read: "Units B & D are one bedroom units located on the second floor, Unit C is a two- bedroom unit located on the second floor, and Unit A is a one - bedroom unit located on the first floor." Chair Cummings opened the public hearing. Speakers: None. There being no one present to speak, Chair Cummings closed the public hearing. Motion by Campbell, second by Klinger, to adopt Resolution No. 16 -14, approving Minor Use Permit 16 -5 with Conditions. AYES: Cummings, Campbell, Klinger NOES: None ABSENT: Thomas ABSTAINED: Machen Motion carried Assistant City Attorney, Amy Greyson indicated the ten day appeal period begins July 19, 2016. Vice Chair Machen returned to the dais. PUBLIC HEARING 3. Conditional Use Permit (CUP) 16 -2 12470 Seal Beach Blvd Applicant: Art Rodriguez & Associates Request: Conditional Use Permit (CUP 16 -2), a request for a conditional use permit to allow the on -site tasting of beer, wine and distilled spirits in accordance with a Type 86 Alcoholic Beverage Control (ABC) license at an existing super market within the Old Ranch Towne Center in the General Commercial (GC) zoning area. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 16- 15, APPROVING Conditional Use Permit 16 -2 with Conditions. Page 3 — Planning Commission 7/18/2016 Assistant Planner Steve Fowler presented a comprehensive overview of the item including a PowerPoint presentation. Commissioner Campbell verified with staff that the instructional tasting shall only take place between 12- 5 p.m. She also informed the Commission she posted on Next Door and the response was overwhelmingly positive with only one person expressing they had a concern about the possibility of children present. Commissioner Machen inquired whether or not minor alterations would be made to the area. Staff explained that the consumption of alcohol would be confined to one area and the intent is only to have stanchions since tastings will not be every single day. Therefore, a permanent structure will not be necessary. Chair Cummings opened the public hearing. Speakers: Perter Impala spoke on behalf of the applicant Art Rodriguez & Associates who thanked staff for their assistance and gave a brief background on the history of tastings. He also asked if the hours could be extended to 12pm -8pm to accommodate people who work and want to enjoy the tastings. There being no other speakers, Chair Cummings closed the public hearing. Motion by Campbell, second by Machen, to approve Resolution No. 16 -15, approving Conditional Use Permit 16 -2 with Conditions and modified hours from 12- 5 p.m. to 12 -8 p.m. AYES: Cummings, Machen, Klinger, Campbell NOES: None ABSENT: Thomas Motion carried Assistant City Attorney, Amy Greyson indicated the ten day appeal period begins July 19, 2016. 4. Conditional Use Permit (CUP) 16 -3 1502 Ocean Avenue Applicant: Ron Wikstrom Request: Conditional Use Permit (CUP 16 -3), a request for a conditional use permit to allow an addition to an existing kitchen and a new patio cover over an existing second floor deck in a single family residence which is nonconforming due to setbacks in the Residential High Density (RHD -20) zoning area. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 16- 16, APPROVING Conditional Use Permit 16 -3 with Conditions. Vice Chair Machen recused herself from the meeting. Zone Text Amendment 16 -1 and Specific Plan Amendment 16 -1 Main Street Specific Plan Zone Applicant: City of Seal Beach Request: Zone Text Amendment (ZTA 16 -1) and Specific Plan Amendment (SPA 16 -1), an Ordinance for the amendment of Title 11 of the City of Seal Beach Municipal Code and Main Street Specific Plan pertaining to commercial heights and development standards in the MSSP zone. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 16- 17, recommending approval of Zone Text Amendment 16- 1 and Specific Plan Amendment 16 -1 to the City Council. Senior Planner Crystal Landavazo presented a comprehensive overview of the item including a PowerPoint presentation. Commissioner Campbell inquired if you have two, twenty -five foot parcels that would give you a fifty foot parcel is that still not allowed? Staff clarified that the parcel cannot exceed a maximum width of 50 feet and two, twenty -five foot parcels could be developed concurrently with a lot line adjustment to merge into one. Commissioner Campbell stated concerns regarding commercial district zoning and would like to recommend to Council to set a height limit of 25 feet with 2 story maximum. She additionally noted zoning for Professional Office and Service Commercial should be limited to 25 feet with 2 stories. A document was provided to the City Clerk and staff was directed to report her concerns to the City Council (attached to the minutes as reference). Page 5 — Planning Commission 7/18/2016 Assistant City Attorney Amy Greyson indicated that the information provided in the public hearing notice for this item is specific to the Main Street Specific Plan and that Planning Commission should stay within the noticed action. Chair Cummings opened the public hearing. Speakers: Mike Buebe reminded the Commission that 73% of voters supported Measure Z to maintain the 25 foot height limit in Old Town and expressed his concern regarding the size of the building on Main and PCH. Seth Eaker spoke in opposition of ZTA 16 -1 noting that Main Street Specific Plan is already restrictive, that this item seems reactionary to comments regarding the building on 350 Main, that height diversity on Main Street is a positive item and that it has places additional restrictions on property and business owners. Craig Gibson spoke in favor of the matter. There being no one else to speak, Chair Cummings closed the public hearing. Commissioner Campbell commented that everything in Old Town is legally nonconforming which is different than any other area of the City. At the inquiry of Commissioner Campbell, City Attorney Greyson indicated zoning issue only require voter approval if the voters had approved the specific zoning condition. At the inquiry of Commissioner Campbell, City Clerk Robin Roberts indicated that the City had already provided the required ordinance and resolutions to the Orange County Board of Supervisors and Orange County Registrar of Voters Office with respect to the Seal Beach 2016 General Municipal Election, indicating further that last day to have a Ballot Measure to the County is August 12, 2016. Vice Chair Machen stated that she spoke with business owners who feel that lowering the building height on Main Street is restrictive, with property owners who feel the restriction will help maintain the small town feel and residents who thought that there was already a restriction pursuant to Measure Z. She further indicated that residents felt that without the height restriction Main Street would be more like Huntington Beach. She concluded that she is in favor of this item as it provides for the cohesive and eclectic charm of Main Street. Motion by Klinger, second by Campbell, to approve Resolution No. 16 -17, recommending approval of Zone Text Amendment 16 -1 and Specific Plan Amendment 16 -1 to the City Council, AYES: Cummings, Machen, Klinger NOES: Campbell ABSENT: Thomas Motion carried. Page 6 — Planning Commission 7/18/2016 DIRECTOR'S REPORT Director Basham was absent from this meeting. COMMISSION CONCERNS At the Planning Commission's request, Senior Planner Crystal Landavazo provided an update regarding the emergency Pier repairs.
