Beatley, Director of Finance/City Treasurer Tim Kelsey, Recreation Manager Michael Ho, Deputy Director of Public Works/City Engineer Robin L. Roberts, City Clerk APPROVAL OF AGENDA & WAIVER OF FULL READING OF RESOLUTIONS & ORDINANCES Council Member Miller requested that Item B be pulled from the Consent Calendar for separate consideration. PRESENTATIONS/RECOGNITIONS 1 * Recognition of Rachel Fattal * Fire Prevention Week — Orange County Fire Authority * Solar Trash Compaction — "Big Belly Project" * Local Emergency — Pier Fire Incident Update ORAL COMMUNICATIONS Mayor Massa-Lavitt opened oral communications. Speakers: David Meyer requested assistance from the City to get a letter stating that they are in compliance regarding a code enforcement action or clarification of what needs to be done to be in compliance. Bruce Bennett distributed information and spoke regarding the need for the City of Seal Beach to place a matter on the agenda regarding a five-year forward looking budget. Robert Goldberg stated concern of discussions that the pier may not be built to accommodate a one story building and distributed information as well as concern regarding cost to date for services provided by Transtech. Joyce Parque spoke on a variety of concerns regarding the City. Having no further requests to speak Mayor Massa-Lavitt closed oral communications. CITY ATTORNEY REPORT City Attorney Craig Steele indicated that the City met in Closed Session regarding the matters listed on the Agenda noting that all Council Members were present. He stated that there was no reportable action regarding Item A. He then stated that on Item B, the City Council voted unanimously to direct staff to send a letter to the State Lands Commission expeditiously, outlining the City's concerns regarding the proposed lease, and that Mayor Massa-Lavitt appointed herself and Council Member Deaton to an Ad Hoc Subcommittee to negotiate the subject lease. CITY MANAGER REPORT City Manager Jill Ingram announced that the Finance Department recently hired a new employee. Account Technician Elsie Solorzano was then introduced by Director of Finance/City Treasurer Vikki Beatley. COUNCIL COMMENTS Page 4 — City Council 9/26/2016 Council Member Sloan thanked the Police Department for their increased presence in his neighborhood. Council Member Varipapa stated that he attended the Seal Beach Animal Care Center Wag N' Walk on Saturday. Mayor Massa-Lavitt announced that the October 10, 2016 City Council meeting will be cancelled because there are no business items. She then stated that she attended the candidate forum held at Leisure World. Council Member Miller stated that District 4 was planning on holding a candidate forum. He then stated that he wanted there to be a Council meeting on October 10, 2016 with the following list of items: Climatec, Zoning Text Amendment 15-1 (Amplified Entertainment) and Pier Insurance Coverage. He further asked that the following items be scheduled in the near future: Class and Comp Study, Customer Service, Biennial Actuary Study, Public Open Space and Procurement Policy. He reiterated that he wanted there to be an October 10, 2016 City Council meeting and then stated that he doesn't know what is happening regarding the Pier Project and reminded staff that Council provided a directive that the upgrades were to include being able to withstand a one story building at the end of the Pier. Mayor Massa-Lavitt reminded Council Member Miller of the timing requirements for staff reports and public hearing notices and confirmed that there would not be a City Council meeting on October 10, 2016. There was discussion between staff and the City Council regarding Council Member Miller's questions regarding insurance coverage related to the Pier Fire Incident. Council Member Deaton stated that she attended the Seal Beach Animal Care Center Wag N' Walk and thanked the Center for all that they do for animals and the community. 1 She then announced that the City Council will have a Strategic Planning Workshop on October 18, 2016. Council Member Deaton spoke regarding the Pier upgrade and outlining the timeline of repair process. She indicated that the Council City did provide a directive for the Pier to be constructed to hold a one story building. COUNCIL ITEMS There were no Council items for this meeting. CONSENT CALENDAR Deaton moved, second by Sloan, to approve the recommended actions on the Consent Calendar, except Item B, pulled from the Consent Calendar for separate consideration. Page 5 - City Council 9/26/16 ITEMS REMOVED FROM CONSENT CALENDAR B. Demands on City Treasury (Fiscal Year 2017) — September 12, 2016 — Ratification Council Member Miller expressed concerns regarding payments made to Transtech Engineers for approximately $20,000 and that we might soon be exceeding the City Manager's contract authority. City Manager Jill Ingram asked Director of Finance/City Treasurer Vikki Beatley to provide clarifications regarding Council Member Miller's concerns. She stated that her contract authority has not been exceeded and that tentatively there is an item scheduled for the October 24th City Council Agenda to approve an agreement with Transtech Engineers, as the Building Official recruitment was not successful. Director of Finance/City Treasurer Vikki Beatley spoke regarding the services provided by Transtech Engineers, noting that the payment in question is for both Interim Building Official services and Interim Building Inspector services as well as plan check services. She explained that there are purchase orders on file regarding the payment for such services and staff is preparing an item for the October 24th City Council meeting to approve an agreement with Transtech Engineers. Miller moved, second by Deaton, to ratify the Demands on the City Treasury as submitted.
