PROFESSIONAL SERVICES AGREEMENT FOR PUBLIC WORKS INSPECTOR AND SUPPORT SERVICES AND AUTHORIZATION FOR PUBLIC WORKS INSPECTION SERVICES ON 7T" STREET ALLEY WATERLINE AND SEWER REPLACEMENT PROJECT CIP NO. WT1607 SUMMARY OF REQUEST: That the City Council adopt Resolution No. 6705: 1. Approving and authorizing the City Manager to execute Amendment No. 1, amending the Professional Services Agreement for Public Works Inspector and Support Services with TRANSTECH Engineers, Inc. for increased compensation in the amount not to exceed $66,000, or a total of $94,000; and 2. BACKGROUND AND ANALYSIS: At the November 14, 2016 City Council meeting, the City Council approved a Professional Services Agreement (Agreement) for Public Works Inspector and Support Services with TRANSTECH Engineers, Inc. (TRANSTECH) in the amount of $28,000 to conduct public works inspections. The Public Works staff has been satisfied with TRANSTECH services. Inspections continue to be necessary for both ongoing general public works inspections and the 7th Street Alley Waterline and Sewer Replacement Project CIP No. WT-1607. In addition, Agenda Item H staff anticipates starting construction for capital improvement projects as identified in the 5 -Year Capital Improvement Program in the near future. The City manages construction projects with a public works inspector that is present at the various construction sites. The responsibilities of the public works inspector are to perform construction oversight, inspections, and ensure compliance with Federal, State, and City standards, codes, designs, and specifications. The approved Agreement dated November 14, 2016 for the amount of $28,000 will soon be expended yet TRANSTECH services are still necessary for ongoing general public works inspections as well as for the 7th Street Alley Waterline and Sewer Replacement Project CIP No. WT1607, during the balance of the one - year term of the Agreement. Staff recommends amending the Agreement with TRANSTECH to add funds in the amount of $66,000, for a total Agreement maximum of $94,000 for the one -year term of the Agreement. The amount of $66,000 was determined based on the monthly average cost ($11,000) for inspections. The amended Agreement will ensure inspection services through the end of the FY 2016 -2017 for a total Agreement amount of $94,000. Currently, the 7th Street Alley Waterline and Sewer Replacement Project CIP No. WT1607 has expended approximately $25,000 for inspections. From the $66,000, $10,000 will be allocated for the 7th Street Alley Waterline and Sewer Replacement Project CIP No. WT1607. Staff requests that of the $94,000 total compensation of the Agreement, the City Council authorize expenditures of a "not to exceed" amount of $35,000 for public works inspection services by TRANSTECH Engineers, Inc. related to construction of the 7th Street Alley Waterline and Sewer Replacement Project CIP No. WT1607. ENVIRONMENTAL IMPACT: There is no environmental impact related to this item. LEGAL ANALYSIS: The City Attorney has reviewed and approved Amendment No. 1 as to form. FINANCIAL IMPACT: Sufficient funds have been or will be allocated for the position through the Public Works - Capital Projects and engineering inspection deposit account. Amendment No. 1 increases the compensation under the Agreement by $66,000, or a total contract amount of $94,000, for TRANSTECH services at an hourly rate of $125 per hour. TRANSTECH is paid only for the hours in which work is performed, and not a set number of hours per week. As in the past, any work performed by the Inspector that is related to a Capital Improvement Project will be charged to the project.
