Thanks! -Tom Questions for 2.13.2017 Council Meeting Item B: • Anthem Blue Cross— 115283 o Is this for certain employees?All Employees? This is for 3 part-time employees who are eligible (under the Affordable Care Act)for medical insurance. • Broadcast Music Inc. - $342—What is this? Annual license agreement for city-wide use of music. 1 • • Katherine Edwards- $10,085—Who is this? Is it ongoing? Hired by the City to perform investigation related to personnel matter. • Siemens:Industry, Inc - $2,619.86—Traffic response calls out—What is this? Traffic signal issues in November. • SYNOPTEK-$18,769.75—could I see services contract for this? What do they provide for this? Annual charges for web hosting and anti-spam. $4,500 for managed server, $5,500 for help desk and $8,000 for engineer. • Western Transit System —3 diff routes- Is this based on usage or monthly fees or both? Route 44— Senior Center/Senior meals, Monday through Friday (8 hours per day). Route 45 —Dial a Ride, Monday through Friday (available 8.25 hours per day). Route 46—Shopper Shuttle, weekly (Thursday only). All routes are charged the same rate ($49.25 per hour). o San Clemente is trying out Lyft as an alternative to Dial-A-Ride. Is this something worth looking at possibly as a trial-run? Staff is open to any innovate transportation options. As you may know, our main priorities when it comes to transportation is economics, efficiency, reliability and safety. We will investigate this option further and provide results; however, we can tell you briefly that San Clemente partnered with Lyft after 2 OCTA bus lines were dropped due to low passenger rates. We were able to obtain their staff report on said subject and will contact them soon to see how their beta test is working out. • Convergint Technologies LLS - $1,949— Repair door button in CM lobby? Seems expensive to fix a button /who installed this? Was there a warranty? Convergint repaired the button that operates the locking mechanism to the hallway door. This required over 13 hours to troubleshoot and permanently fix the system. The warranty had expired. • Cypress FC- $4,160—what is this? As indicated in the warrant list, refund of facility rental fees for fields. • C3 Technology-Services - $1,800.50—what is this for? Managed printer/copier services. • Earthlink Inc. - $24.95—Are they still in business? Is this really necessary? We are investigating this charge and will keep you posted. After first glance, it looks like Earthlink had provided web support services for the City. Item D: xiv— The Entertainment Permit ordinance calls fora noise limit of 50 db measured as "Lmax", or maximum peak noise level. The current "Lmax" equivalent in the noise ordinance specified in Section B.5 as the "noise standard plus 20 dB for any period of time." This would equal 55 db - 5 db (for music) + 20 dB = 70 dB Lmax. Can you confirm Entertainment Permit ordinance is 20db less than Noise Ordinance? The code section cited (SBMC§ 7.15.015.B) states: B. No person shall create any noise, or allow the creation of any noise, on property owned or occupied by such person when such noise causes the noise level to exceed the following when measured from a residential property: 1. The exterior noise standard for a cumulative period of more than 30 minutes in any hour. 2. The exterior noise;standard plus 5 db(A)for a,cumulative period of more than 15 minutes in any hour. 3. The exterior noise standard plus 10 db(A) for a cumulative period of more than 5 minutes,in any hour. 4. The exterior noise standard plus 15 db(A) for a cumulative period of more than one minute in any hour. 2 5. The exterior noise standard plus 20 db(A) for any period of time. The code section specifies that it is prohibited for a person to create a noise that exceeds 20 db for any period of time, `riotthat a person'can-.exceed the standard. At no time would any person be allowed to exceed the established nose level by 20 db.`The:50 db established as part of the Entertainment Ordinance is consistent with the noise level established for residential zones. Item E: Why is the monthly rate so much less than previous quotes? Is staff doing items that were eliminated from the quote? If so, what is the estimated cost for staff to make up for these items that are not on the quote? The monthly rate is less because staff adjusted the scope of service to fit within the approved budget for the fiscal year. Consequently, the term of the contract is only 5 months. It is staff's opinion that some of the services provided in the previous,contract will notbe-needed during the period of the proposed contract. Items such as spraying and fertilization are often best done on an as heeded basis. The City will still have the ability to have this done, however, it will just not be included in regular maintenance and would be as part of the additional work requested outside of the base contract. This will give staff the ability to monitor the contract and see how it impacts the budget. As for tasks being assumed by staff that were included in the.previous contract, this will be relatively minimal once the.agreement:is executed. The only areas that staff will be assuming will be trash pickup, clearing of cigarette butt containers and dog bag replenishment. There will not be an increase in costs to the City as these items can fit into regular maintenance rounds that maintenance staff already performs. Item F: What would be the impact of not having a director for a few months while we do a search? The impacts would be significant. Staff is quite lean and operates as efficiently as possible, but accomplishing daily operations, Council Goals, high priority projects (e.g. pier, LA Fitness, to name just two) would be very difficult and would compromise the success of the department, the customer service that is expected and objectives that need to be completed. Do we have anyone else that can do code enforcement? We do not currently have a staff person that can perform code enforcement. Director of Community Service - Can we try looking for an individual for a few months before contracting in someone?The City Manager will provide additional information to Council. Item G: Ok to grow up to 6 plants indoors at a residence. Besides that is this as restrictive as possible given the current state law? In collaboration with the City attorney's office, the ordinance was prepared to be as restrictive as possible while maintaining compliance with state legislation.
