ORAL COMMUNICATIONS At this time, members of the public may address the Environmental Quality Control Board regarding any items within the subject matter jurisdiction of the Environmental Quality Control Board. Pursuant to the Brown Act, the Board cannot discuss or take action on any items not on the agenda unless authorized by law. Those members of the public wishing to speak are asked to come forward to the microphone and state their name for the record. All speakers will be limited to a period of 5 minutes. Environmental Quality Control Board February 22, 2017 DISCUSSION: The City of Seal Beach received an application for Tentative Tract Map 17925 Beach for the proposed subdivision of a 0.52 acres site which will consolidate three existing legal parcels and create five parcels out of the existing odd - shaped lots in the Residential High Density (RHD -20) zoned area. The proposed project consists of the creation of four new 28.125 ft. wide lots and one 112.5 ft. wide lot with all lots being 100 ft. deep. The proposed map indicates one single - family residential unit can be built on each of the 28.125 ft. wide lots while the 5`h lot will be maintain an existing single family residential structure with attached storage. The proposed subdivision of 3 lots into 5 constitutes a project that is subject to review under the California Environmental Quality Act (CEQA) 1970 (Public Resources Code, Section 21000 et seq.) and the State CEQA Guidelines (California Code of Regulations, Section 15000 et seq.). An Initial Study has been prepared by a third party consultant, Hodge & Associates, to assess the short-term, long -term, and cumulative environmental impacts that could result from the proposed subdivision and subsequent homes that maybe proposed. The report has been prepared to comply with Section 15063 of the State CEQA Guidelines, which sets forth the required contents of an Initial Study. These include: • A description of the project, including the location of the project • Identification of the environmental setting • Identification of environmental effects by use of a checklist, matrix, or other methods, provided that entries on the checklist or other form are briefly explained to indicate that there is some evidence to support the entries • Discussion of ways to mitigate significant effects identified, if any • Examination of whether the project is compatible with existing zoning, plans, and other applicable land use controls • The name(s) of the person(s) who prepared or participated in the preparation of the Initial Study Based on the findings of the Initial Study, the City has determined that this project would not result in significant environmental impacts with the incorporation of mitigation measures to address potential air quality, biological resources, hazards and hazardous materials, hydrology and water quality and construction noise impacts. Measures to reduce these impacts will be incorporated into the project conditions of approval. Accordingly, the City intends to adopt a Mitigated Negative Declaration pursuant to Section 21080(c) of the Public Resources Code. 2 Environmental Quality Control Board February 22, 2017 A thirty day public review period began on February 9, 2017 and will end on March 13, 2017. During this period the IS /MND has been available for public review at City Hall and all three public libraries within the City of Seal Beach. At the time of this report, staff has not received any comments. All comments received regarding this project during the public review period will be shared with the consultant and included as part of the Initial study process. RECOMMENDATION Staff recommends that the Environmental Quality Control Board take public comment and accept and forward the Initial Study/ Mitigated Negative Declaration(IS /MND) to the Planning Commission for the consolidation of 3 parcels or .52 acres of land to create 5 parcels at 232 -244 17th Street.
