Assembly Bill 1826 - Mandatory Commercial Organics Recycling Assistant City Manager Patrick Gallegos introduced Republic Services Municipal Services Manager, Michelle Clark who gave a brief introduction and introduced Rublic Services Senior Municipal Manager, Jeff Snow. ' Jeff Snow gave a presentation on Assembly Bill 1826 which was signed by Governor Brown on September 30, 2014, a phased in legislation that was designed to get organics out of the landfills. Republic Services developed a partnership with Waste Not OC, a coalition that includes the two largest food banks in Orange County. Executive Director Mike Learakos explained his involvement in the coalition and how the program works. Jeff Snow indicated that only pre- consumer items can be donated and a large portion of food waste has to be recycled. By working with Waste Not OC, this number can be minimized. To reduce the burden on businesses, Republic Services is working to bring several jurisdictions together to share and allocate resources. Additionally, he discussed rate allocation options available to the City. Throughout the presentation there was general discussion between Council, Jeff Snow, and Mike Learakos regarding AB 1826 and the process of the Waste Not OC program. Speakers: Robert Goldberg inquired about the franchise fees, the rate increase, and if there was an audit or inventory completed that is available for the public's review. Roberts, City Clerk APPROVAL OF AGENDA & WAIVER OF FULL READING OF RESOLUTIONS & ORDINANCES Mayor Pro Tern Varipapa and Council Member Moore requested that Item J be pulled from the Consent Calendar for separate consideration. City Clerk Robin Roberts reported that changes have made on Friday to the agenda and staff report regarding Item G; there was a change to the minutes clarifying the name of individual that spoke during oral communications; we received two email communications; from Robert Goldberg regarding various items on the agenda: email that went out to Council regarding various agenda items; and PowerPoint presentations were received regarding the study session AB 1826 and the West End Pump Station. PRESENTATIONS /RECOGNITIONS Recognition of Save Our Beach and Disney Winter Storm Update — West End Pump Station ORAL COMMUNICATIONS Mayor Massa -Lavitt opened oral communications. Speakers: Stanley Smalawitz, Patty Campbell, Paul Yost, Tom Stretz, Sharman Snow and Jim Klisanin spoke regarding staffing concerns and support of Chief of Police Joe Stilinovich. Mike Verecchia, Eric Gabonie and Robert Goldberg spoke regarding concerns related to Item J, Animal Control Services. John Domain spoke regarding the Entertainment Ordinance adopted at the February 13, 2017 City Council meeting. Having no further requests to speak, Mayor Massa -Lavitt closed oral communications. CITY ATTORNEY REPORT City Attorney Craig A. Steele clarified that the Ordinances on the agenda are regarding 1 Medical Marijuana and are not related to the Entertainment Ordinance. Prior to the Study Session, Council met in Closed Session and took no reportable action on the items posted on the agenda. CITY MANAGER REPORT City Manager Jill R. Ingram had nothing to report for this meeting. COUNCIL COMMENTS Council Member Sustarsic reported that she attended the UCI Policy Making Academy which continues for the next four weeks. Council Member Deaton asked the City Attorney to address the Chief of Police Joe Stilinovich issue. She thanked Save Our Beach for their service. Additionally Council Member Deaton requested an item be placed on the agenda to discuss placement of a river boom. Council Member Varipapa announced he had the pleasure of attending the Mayor's luncheon with Supervisor Steel which included topics such as homelessness issues, transition housing, sand replenishment, Coastal Commission Permit Process, needles on the beach, and the 405 express lane. Council Member Moore indicated he went on a City facility tour with City staff and Council Member Sustarsic. He also took a very comprehensive tour of Leisure World with Ronde Winkler over the weekend. Additionally, he requested that an item be placed on the agenda regarding adding a stop to the VA Hospital to the Dial -A -Ride Program. Mayor Massa -Lavitt had nothing to report. Fiscal Year 2016 -17 Fleet Replacement - Adopt Resolution No. 6715 Authorizing the purchase of fourteen replacement vehicles and equipment for the City's fleet at a total of $1,107,859.79, in accordance with the breakdown set out in this staff report; authorizing the City Manager to approve purchase orders for the new• vehicles, equipment, up- fitting and payment of all State taxes and fees required for delivery for vehicle and equipment purchases; authorizing the City Manager to execute a Purchase Order in the amount of $50,000 to Hi Standard Automotive, LLC for retrofitting the Police Fleet pursuant to Seal Beach Municipal Code Section 3.20.025(B); and authorizing the City Manager to surplus existing vehicles and equipment upon the completion of the new vehicle and equipment purchase and retrofitting. H. Approve Utility Agreement with Orange County Transportation Authority in Relation to the 1 -405 Improvement Project for New Sewer Construction — Adopt Resolution No. 6716 approving Utility Agreement No. UK102097 between the City of Seal Beach and Orange County Transportation Authority (OCTA) for the 1- 405 Freeway Improvement Project; and authorize the City Manager to execute the agreement. I. Energy Efficiency Climatec Program — Approve Resolution No. 6717 directing the termination of an installation agreement with Climatec Building Technologies Group and approving the execution of an Amendment to Lease Schedule #13- 030 and Memorandum Regarding Application of Remainder of Acquisition Fund; and authorize the Mayor to execute Amendment to Lease Schedule #13 -030 and Memorandum Regarding Application of Remainder of Acquisition Fund. (Pulled from the consent calendar for separate consideration) J. Agreement with the City of Long Beach to Provide Animal Control Services - Adopt Resolution No. 6718 authorizing the City Manager to execute the agreement between the City of Seal Beach and the City of Long Beach to ensure continuous animal control services, and to implement CPI adjustments. ITEMS REMOVED FROM THE CONSENT CALENDAR J. Agreement with the City of Long Beach to Provide Animal Control Services - Adopt Resolution No. 6718 authorizing the City Manager to execute the agreement between the City of Seal Beach and the City of Long Beach to ensure continuous animal control services, and to implement CPI adjustments. Acting Chief Miller provided a comprehensive staff report and introduced Mr. Stevens the Manager of Animal Care Services for the City of Long Beach who was available for questions. Council Member Deaton expressed that the agreement we have isn't working and wants to know how it can work better. She explained that she believes we need more than three hours a day of patrol. In response to Council Member Varipapa's questions, Mr. Stevens explained the services that they provide which include animal care services, truck services which is available 365 days a year 24 -7, always have an officer available, dispatch and phone services, licensing renewals, back -up shelters, overhead, handle daily patrols, wildlife issues, marine calls on the beach, and customer service. Most calls are in reference to injured wildlife, stray animals, and deceased animals. The contract includes canvassing neighborhoods in Seal Beach checking for expired licenses. The priority call responses include: top priority is a threat to a human, second is injured animal (dog /cat/wildlife), priority three are stray custodies. Top priorities are generally responded to within 20 minutes depending on the location. Mr. Stevens explained the affidavit process and indicated that reports are sent to the City quarterly. Mayor Massa -Lavitt inquired as to the definition of patrol. Mr. Stevens indicated that it depends on the area. Mayor Massa -Lavitt indicated that if the officer isn't getting out of the vehicle in Leisure World and only does inspections from the streets and parking lots, they would not be able to see stray animals due to the proximity of the parking lots from the housing units. Council Member Moore inquired whether response times are tracked. Mr. Stevens indicated he can make those reports available to the City. At the inquiry of Council Member Deaton a photograph may be acceptable where there are continuous issues and nuisances. Council Member Sustarsic would like to look into other options in terms of bringing the services in house or contracting with the County. Moore moved, second by Deaton, to continue the item to a date uncertain, directing staff to provide analysis on additional options for animal care services, including City staff.
